Washington, D.C. - April 22, 2019 - (The Ponder News) -- Since President Trump signed the Buy American and Hire American executive order in April 2017, U.S. Citizenship and Immigration Services (USCIS) has implemented it through rules, policy memoranda, and operational changes that protect the economic interests of U.S. workers and prevent fraud and abuse in employment-based visa programs. Later today, USCIS will host a U.S. worker listening session covering the past two years’ worth of policies and rulemaking in support of the Buy American and Hire American executive order.

“USCIS is achieving the president’s goal of putting U.S. workers first by ensuring that our immigration system benefits the American people to the greatest extent possible,” said USCIS Director L. Francis Cissna. “We still have work to do but the improvements we’ve made so far better protect U.S. workers’ jobs and wages, enhance fraud detection and prevention in employment-based visa programs, and increase the overall transparency of those programs for the American public.”

The Buy American and Hire American executive order seeks to create higher wages and employment rates for U.S. workers and protect their economic interests by rigorously enforcing and administering our immigration laws. It also directs the Department of Homeland Security, in coordination with other agencies, to advance policies to help ensure H-1B visas are awarded to the most-skilled or highest-paid beneficiaries.

Policies and Regulations Protecting U.S. Workers
  • Issued policy guidance (PDF, 80 KB) related to fees that certain H-1B petitioners must pay that ultimately help to train U.S. workers.
  • Issued policy guidance (PDF, 97 KB) instructing officers to apply the same level of scrutiny to both initial and extension requests for certain employment-based visa programs, emphasizing that the burden of proof for an immigration benefit request lies with the petitioner.
  • Issued policy guidance (PDF, 119 KB) related to petitions for H-1B workers who will work at third-party worksites.
  • Issued policy guidance (PDF, 95 KB) clarifying that a proxy vote must be irrevocable to establish the requisite control of a company in an L-1 visa petition.
  • Clarified calculation guidelines in a policy memorandum (PDF, 121 KB) for the L-1 one-year foreign employment requirement to ensure beneficiaries spend at least one year overseas.
  • Finalized a rule making simple and smart changes to the H-1B cap selection process to increase the chances of selection for beneficiaries who have earned a master’s or higher degree from a U.S. institution of higher education.

  • Fraud Detection and Prevention in Employment-Based Visa Programs
  • Announced that USCIS and the Department of Justice signed a Memorandum of Understanding (PDF, 2.00 MB) that expanded their collaboration to better detect and eliminate fraud, abuse and discrimination by employers bringing foreign workers to the United States.
  • Created H-1B and H-2B fraud reporting tip lines and strengthened information sharing with the Departments of State, Labor, and Justice to streamline and improve new and existing processes in our immigration system.
  • Enhanced our targeted site visit program to ensure that H-1B and L-1 employers and nonimmigrant workers comply with the terms of their approved petitions.

  • Transparency of Employment-Based Visa Programs
  • Created a webpage devoted to the Buy American and Hire American executive order providing additional data on various employment-based immigration programs and statistics on employment authorization documents provided to foreign nationals by classification and statutory eligibility.
  • Created the H-1B Employer Data Hub to provide information to the public on employers petitioning for H-1B workers.

    Boston, MA - April 12, 2019 - (The Ponder News) -- Governor Charlie Baker signed an Executive Order Reaffirming and Reconstituting the Governor’s Council to Address Sexual Assault and Domestic Violence. Lt. Governor Karyn Polito announced the Executive Order and the 2019 Action Plan at a meeting of the Governor’s Council to Address Sexual Assault and Domestic Violence. April is Sexual Assault Awareness Month.

    “I thank the Council and Lt. Governor Polito for their dedication to continue working together to end domestic violence and sexual assault here in the Commonwealth,” said Governor Charlie Baker. “I am confident that the addition of the Transportation and Veterans’ Services secretariats will bring valuable voices to the conversation surrounding both prevention and assisting survivors.”

    “I am proud of the progress the Council has made over the last four years, from providing law enforcement with important tools, to the kickoff of our Public Awareness Campaign that will educate the Commonwealth’s most vulnerable,” said Lt. Governor Karyn Polito. “I am pleased to announce our 2019-2020 Action Plan and look forward to working with my colleagues on the Council to keep all residents of Massachusetts safe.”

    This new Executive Order builds upon the Council’s accomplishments of the last four years and will serve as the roadmap of the Council for the second term of the Baker-Polito Administration with several structural and procedural changes to more effectively support the Council’s mission.

  • Establishes the Secretary of Transportation as a member of the Council to serve as a resource with the Massachusetts Department of Transportation to aide in the Commonwealth’s human trafficking efforts.
  • Establishes the Secretary of Veterans’ Services as a member of the Council to lead on several new initiatives generated from the Veterans, Military, and Families subcommittee.
  • Increases membership to bring additional subject matter expertise to the Council and expands the Council’s regional representation.

  • The executive order identifies key priorities for the next two years. The Council will focus on assessment and response; human trafficking; prevention and education; military, veterans and families; housing stability; and self-sufficiency. A report will be submitted to the Governor at the end of each two-year cycle.

    Public Awareness Campaign:

  • Small panel of experts to work with a vender to assist in developing acampaign; identify the audience and resources for support; & assist in monitoring the quality of the project

  • Response and Assessment:

  • Coordinate attendance for Regional Chief's Meetings across Massachusetts to discuss DV Toolkit
  • Coordinate and establish distribution process of guidelines/best practices for domestic violence high risk teams
  • Explore and identify opportunities to expand safety nets for victims and perpetrator accountability

  • Housing Stability and Self Sufficiency:

  • Explore and provide recommended safety nets for victims’ housing protections
  • Increase collaboration between SA/DV and shelter/housing systems and subsidized housing models to promote existing best practice solutions and expand housing options

  • Human Trafficking:

  • Continue to work towards expanding Child Sexual Exploitation training/policy/practice to DYS, DCF and DMH
  • Identify opportunities for increased collaboration between the High Risk Victims Unit (HRVU) of the Massachusetts State Police and District Attorney's Offices
  • Research the strategies/best practices associated with the identification, safe recovery and ongoing supports of child victims

  • Prevention and Education:

  • Complete “Skills Chart” across educational sectors and identify opportunities for adoption and implementation
  • Identify opportunities to support launch and sustainability of consistent messaging for the Statewide

  • Veteran/Military Families:

  • Governor Baker signed Executive Order 563 on April 27, 2015, which re-launched the Governor’s Council to Address Sexual Assault and Domestic Violence and elevated the Council to the Governor’s Office. Over the last four years, with Lt. Governor Karyn Polito as Chair, the Council has successfully worked to support effective implementation of key provisions of Chapter 260: An Act Relative to Domestic Violence and advanced other important initiatives, such as in undertaking a 2018 Action Plan to address five priority areas: Assessment and Response; Child Trafficking; Military, Veterans, and Families; Housing Stability and Self-Sufficiency; and Prevention and Education.

    Washington, D.C. - April 12, 2019 - (The Ponder News) -- Senator Edward J. Markey (D-Mass), member of the Environment and Public Works Committee and Foreign Relations Committee, released the following statement regarding the two executive orders issued this week by President Donald Trump. One executive order would allow the President to unilaterally approve or deny permits for construction, connection, operation, and maintenance work on international pipeline projects like the Keystone XL pipeline, bypassing the State Department and circumventing the need for environmental reviews. The other executive order would make it harder for states to protect their water quality and the environment by directing the Environmental Protection Agency (EPA) to provide new guidance on states’ use of Section 401 of the Clean Water Act, which allows states to withhold certifications or impose conditions on federal permits for activities that could result in discharges to bodies of water. The attack on Section 401 authority was opposed by the Western Governors’ Association earlier this year.

    “This Trump pipeline power grab will only benefit the American Petroleum Institute and Big Oil’s bottom line,” said Senator Markey, Chair of the Senate Climate Change Task Force. “These executive orders trample states’ rights and completely undermine the role that science and environmental reviews play in making policy and permitting decisions about pipelines projects across the country. It is Congress—not the President—that has the authority to make changes to states’ powers under the Clean Water Act. I will continue to fight this effort to turn states and communities across the country into Big Oil playgrounds.”

    EEI STATEMENT ON EMP EXECUTIVE ORDER

    “EEI and its member companies applaud President Trump's ongoing focus on protecting critical infrastructure, and we look forward to working with the Administration to ensure that industry and government continue to work closely together to protect the energy grid.

    “Grid security is a shared responsibility, and addressing dynamic threats to the energy grid requires vigilance and coordination that leverages government and industry resources. Our security strategies constantly evolve and are closely coordinated with the federal government through a partnership called the Electricity Subsector Coordinating Council (ESCC). From electric company CEOs to energy grid operators, we work closely to share threat information and partner with all levels of government to mitigate, and respond to, national-level incidents or threats to electric-sector critical infrastructure.

    “How an EMP may impact critical infrastructure is an extremely complex issue that cannot be solved with a one-size-fits-all solution. Sound policy should be informed by sound science. That is why the Electric Power Research Institute (EPRI) launched a research project in 2016 to evaluate how EMPs could impact the energy grid. Developing this scientific basis enables companies to make science-informed decisions for developing, testing, and deploying EMP-resistant grid components.

    “Next month, EPRI will share its EMP findings with the industry, policymakers, and the public, providing the necessary information for companies to better understand the potential impact of EMP incidents to the transmission system. The findings also will include recommendations for mitigation approaches and investments.

    American Federation of Teachers President Randi Weingarten on President Donald Trump's Executive Order on Free Speech

    Washington, D.C. - March 21, 2019 - (The Ponder News) -- AFT President Randi Weingarten issued the following statement after President Trump signed an executive order on free speech on college and university campuses:

    “President Trump’s concept of free speech is speech that he agrees with, which is, in fact, the antithesis of what the First Amendment seeks to protect. He has repeatedly indicated his interest in ‘shutting down’ journalists and media outlets that criticize him, and he uses hateful and many times inciteful words on a daily and public basis. With a track record like this, there is no reason to believe that the speech he wants to ‘protect’ on college campuses won’t both suppress speech and enable incitement. If the framers of the Constitution were alive today, they would tell President Trump: ‘No, no, no, sir. You can’t use executive orders to suppress the speech of those with whom you disagree.’

    “As educators, we are staunch supporters of a free exchange of ideas, the free expression that is crucial to intellectual discourse, and the responsibility that all speech must be coupled with an ability to reject that which will incite hatred or violence. Free and unfettered speech is supposed to be exactly that—free and unfettered—not subject to executive branch policing and interference.

    “This order also sets a dangerous precedent that makes public activities at our nation’s colleges and universities susceptible to punitive action if they don’t meet a predetermined, purposefully ambiguous benchmark set by a White House with a very obvious political agenda. When schools are committed to civilized discussion and debate, we should be investing in more research to defend those democratic ideals, not denying them resources.”

    President Trump issues executive order supporting free speech at universities

    “The administration is right to recognize the threats to freedom of speech on public university campuses and the need to do something about preserving the marketplace of ideas. In the course of winning more than 400 legal victories since 2006, the ADF Center for Academic Freedom has continued to encounter massive free speech and other First Amendment violations, unconstitutional policies, and many repeat offenders. We appreciate the administration’s understanding of this problem as well as actions it has taken to help, including the briefs that the Department of Justice has filed in support of ADF clients who have stood up for their freedoms in the face of having those freedoms jeopardized. Today’s university students will be tomorrow’s voters and civic leaders. That’s why it’s so important that public colleges and universities exemplify the First Amendment values they are supposed to be teaching to students.”

    Trump Signs Executive Order to Expand Broadband to Rural Communities



    Washington, D.C. - January 9, 2017 - (The Ponder News) -- After his speech at the Farmer's Convention in Nashville on Monday, President Trump signed an executive order to expand broadband internet to rural communities.

    “President Trump’s focus on expanding broadband to rural areas is good news for Missouri farmers, ranchers, and, most importantly, families,” Senator Roy Blunt - (R - MO) said. “Today, an estimated 61 percent of rural Missourians lack access to broadband. By ending the digital divide, we will help our agriculture industry thrive and meet world food demand. We will provide students and teachers access to new learning tools and educational opportunities. We will enable small businesses to compete in a global economy. And, we will expand access to quality healthcare through telemedicine.     “As a manufacturer and job creator a little over one year ago, I can appreciate that this order expands the ability of small businesses and their employees to participate in new types of health insurance arrangements which is why I supported a similar measure that passed the House earlier this year. While this order makes many positive strides concerning healthcare affordability, Congress must act to make these and other reforms permanent. More importantly, Congress cannot simply give up on our promise and accept failure on Obamacare repeal. Republicans in Congress, and particularly in the Senate, need to pick up the torch and repeal Obamacare so families in Ohio and across the country can finally have the relief they were promised.”

    “This latest act of sabotage by the failing Trump presidency against the ACA will cause a million people to lose insurance in just the first year, drive up premiums and out-of-pocket payments for the rest and cause damaging instability in the insurance markets,” DeGette said. “President Trump is trying to achieve via edict what he couldn’t do through legislation: Dismantle the ACA and replace it with a cruel system that punishes the most vulnerable.     “More federal interference, such as single-payer, is the wrong answer. Giving workers, families and small businesses more choice and flexibility is the right one. But ultimately, Congress must pass free-market reforms Republicans have advocated for years. The Senate must act.”

    “The President’s decision to cut off cost-sharing reduction payments is his most outrageous act of sabotage against our health care system yet.

    “These payments enable insurers to keep consumers’ out-of-pocket costs down. Per the nonpartisan Congressional Budget Office (CBO), ending them will cause premiums to rise and spur insurers to leave markets, in turn leaving Americans with fewer choices – the exact opposite of what the President has promised for months.

    “If the President truly believed that action was needed on Congress’s part, he would have called on Congress to act. I have cosponsored the Marketplace Certainty Act, along with dozens of my colleagues, to appropriate funding for the cost-sharing reduction payments and remove any ambiguity on this issue. But, instead, the President chose to put millions of Americans’ health care at risk.

    “Just yesterday, the President signed an Executive Order that could bring back the junk insurance policies that, before the ACA, offered little value for your money and punished sick people for their health status. Now, he’s doubled-down with a move that will hike up premiums and limit consumer choice. All of this amounts to the same ‘pay more, get less’ plan that the American people rejected in Trumpcare.

    “Make no mistake: any instability in our health care system going forward will be a direct consequence of the President’s actions over the past two days. There is no reason for the President to make this move other than to hurt Americans. I am deeply saddened that in his desperation to see the ACA fail, he has made this egregious decision.”

    “President Trump’s unilateral latest decision to stop making cost-sharing reduction payments will increase premiums for millions of Americans and will destabilize the marketplaces. The President is dead wrong when he calls these payments ‘bailouts.’ The truth is that they help people with modest means reduce their out-of-pocket healthcare costs. This action hurts the working and middle class Americans that President Trump promised to advocate for. He has now turned his back on them and is using them as a bargaining chip.”

    Trump signs executive order on Healthcare

    Washington, D.C. - October 13, 2017 - (The Ponder News) -- President Donald J. Trump signed an executive order directing his Administration to craft new policies increasing competition, choice, and affordability for health care across the American workforce.

    According to the White House, the order:

    1. directs the Secretary of Labor to consider expanding access to Association Health Plans, which could potentially allow American employers to form groups across State Lines;

    2. directs the Departments of Labor, Treasury, and Health and Human Services to consider expanding coverage through low cost shorter-term limited duration insurance; and

    3. directs the Departments of Treasury, Labor, and Health and Human Services to consider changes to Health Reimbursement Arrangements so employers can make better use of them for their employees.

    Below are statements from House Representatives about the executive order:

    Buddy Carter (R-GA, 1st)

    "Thanks to dysfunction in the Senate, Congress has not been able to deliver on our promise to repeal Obamacare and replace it with a patient-centered system." said Carter. "While I would have preferred these moves come from Congress, I am grateful President Trump acted today to deliver relief to Americans suffering under Obamacare. This Executive Order works to deliver choice and control back to patients and is a good step towards lowering health care costs. I look forward to continued work with President Trump to finally repeal Obamacare and lower health care costs for all Americans."

    Judy Chu (D-CA, 27th)

    “Donald Trump will do anything to avoid working with Democrats to improve the healthcare of Americans – including intentionally sabotaging our country's healthcare system. That is what he is doing with this executive order. It is a craven attempt by the President to justify his party’s attacks on the ACA, which has been successful at increasing coverage for millions. That is why Republicans have been unable to pass a repeal of the law. But refusing to accept his failure, Trump is trying to double down with this plan to peel healthy individuals away from the ACA marketplaces and make costs rise for consumers. By offering cheap plans with poor coverage, he is ensuring that only healthy people will buy them – leaving the sick and elderly with more expensive options. This signals a return to the segmented healthcare system we had before the ACA, where being sick could mean bankruptcy or worse. And it is the most vulnerable Americans who will pay this price to salve Trump’s ego.”

    “Make no mistake: Trump and Republicans will risk the lives of our most vulnerable to fulfill a dangerous political promise to their base. Republicans are bent on dragging us back to the days when insurance companies decided who lived or died, and I will fight this every step of the way.”

    “Instead of working with Congress to determine what’s best for Americans and their health care, the President has decided to force his political agenda on the American people. There is a reason why the GOP effort to repeal and replace the Affordable Care Act (ACA) has failed time and time again. The President wants to blame Democrats but the truth is, the proposed health care changes will hurt millions, regardless of their party affiliation. These changes are designed to allow loopholes around ACA core requirements, such as the coverage of essential health benefits.

    Associations that band together to buy insurance will be exempt from having to cover certain prescription drug benefits, maternity care, or mental health services. The executive order will allow insurance companies to offer skimpy, short-term plans that don’t actually provide good coverage. This will attract the young and healthy customers at the expense of older or sicker individuals and their families, and will destabilize the insurance markets. The American people have spoken – more than once – and they want Congress to work together to find ways to improve upon the ACA, not continue to roll back patient protections.”
