ROBOCOP Act to Require Free Robocall Blocking Technology Introduced

Washington, D.C. - April 18, 2019 - (The Ponder News) -- Congresswoman Jackie Speier (D-CA) was joined by 14 of her colleagues in the House of Representatives last week to introduce H.R. 2298, the ROBOCOP (Repeated Objectionable Bothering of Consumers on Phones) Act. This bicameral legislation would finally require telephone companies to offer free robocall blocking services to all their customers. Senator Richard Blumenthal (D-CT) has introduced the companion bill in the U.S. Senate.

An estimated 22.1 million Americans lost $9.5 billion to Robocall scams in 2016, according to a 2017 study. This epidemic of telephonic harassment skyrocketed in 2018, with the number of robocalls made to Americans exceeding 16.3 billion in the first five months of that year. And thus far efforts like the Do Not Call Registry have had little to no impact, particularly when it comes to scams and call centers located outside of the United States.

“Seldom a day goes by that I am not barraged with calls at home and on my cell phone from automated call services and scam artists. I recently received a call from a con artist claiming to work for the Social Security Administration claiming that there was a problem with my status. These schemes rob Americans, often the most vulnerable among us, of billions of dollars every year,” Rep. Speier said. “It’s clear that the Do Not Call Registry has not solved this problem and Congress can no longer wait for the FCC or telephone companies to take the necessary action. I urge the House and Senate to swiftly take up and pass the ROBOCOP Act.”

“The increase in disruptive and harassing robocalls is out of control. Consumers are demanding that we take action, which is why I’m proud to join Congresswoman Speier in introducing the ROBOCOP Act to help cut down on this vicious onslaught of scam and spam messages by requiring phone companies provide robocall blocking tech and verify that caller IDs are accurate” Sen. Blumenthal said.

The ROBOCOP Act would:

  • Direct the Federal Communications Commission (FCC) to require telecom companies to verify that caller ID is accurate.
  • Provide an exception for consumers with a legitimate need for altered caller ID, such as medical offices and domestic violence shelters.
  • Direct the FCC to require telecom companies to offer consumers optional, free robocall-blocking technology.
  • The technology would not block public safety entities and calls that the consumer consents to receive (e.g., notifications from school districts about closings and messages from doctor’s offices and law enforcement alerts).
  • Give consumers a private right of legal action against telecom companies that violate this statute.
  • Require the FCC, in consultation with the Federal Trade Commission (FTC), to provide a public report every four years to help determine whether the new rules have successfully reduced unwanted calls.
  • Authorize the FCC to create a nationwide unblocking system that will ensure consumers are in control of the calls and text messages they receive.

  • Rep. Speier’s bill has 14 cosponsors and has the support of Consumer Reports.

    “The ROBOCOP Act would provide sorely-needed relief from unwanted robocalls, a top consumer complaint. This legislation would address ‘spoofed’ calls that scammers so often use to evade call-blocking services and enforcement efforts, as well as the growing problem of unwanted text messages,” said Maureen Mahoney, Policy Analyst, Consumer Reports. “Consumer Reports commends Congresswoman Speier and Senator Blumenthal for their leadership in addressing this issue and urges Congress to take this measure up quickly.”

    The cosponsors of Rep. Speier’s bill are: Representatives Steven Cohen (D-TN), Jim Cooper (D-TN), Eliot Engel (D-NY), Raúl Grijalva (D-ZA), Zoe Lofgren (D-CA), James McGovern (D-MA), Eleanor Holmes Norton (D-DC), Chellie Pingree (D-ME), Jamie Raskin (D-MD), Tim Ryan (D-OH), Brad Sherman (D-CA), Thomas R. Suozzi (D-NY), Peter Visclosky (D-IN), and Frederica Wilson (D-FL).

    On Thursday, April 11 at 10:00 am ET, the U.S. Senate Committee on Commerce, Science, and Transportation will convene a hearing on Illegal Robocalls: Calling All to Stop the Scourge. “Robocalls have increased 370% percent in less than four years, with over five billion robocalls made just in March 2019,” said National Consumer Law Center Senior Counsel Margot Saunders, who will testify at the hearing. “The surge in consumer complaints reinforces the need for the Federal Communications Commission to strengthen the federal Telephone Consumer Protection Act’s application to autodialed calls and the right of consumers to withhold their consent to receive these and other robocalls.”

    I don't know about you, but I am getting tired of calls about extended warranties, knee braces and health insurance. Especially Obamacare. You would think that after being told 10 times, pushing the button 10 times and hung up on more times than I count, they would quit calling. It's annoying. I don't buy anything from anyone who annoys me. And, I don't give my information over the phone unless I know beyond a shadow of a doubt who I am talking to and what the information is being used for.

    Rhode Island Bus Driver Asks NLRB to Overturn Policy Blocking Vote to Remove Teamsters Union

    NASW will continue to monitor efforts to sabotage Affordable Care Act

    The Trump administration recently announced that it had ordered the Department of Justice (DOJ) to file with the Fifth Circuit Court Federal Appeals Court that it affirms a December 2018 ruling by a federal judge in Texas in Texas v. United States that invalidated the remaining portions of the Affordable Care Act (ACA). Because 16 states have challenged the decision, the judge’s ruling will not have any immediate effect. However, this latest action is an ominous sign the administration is determined to dismantle ACA, thereby eliminating essential health services to millions of low-income and indigent people.

    CAGW’s Deborah Collier Testifies Before Senate Commerce Committee on FCC’s Lifeline Program

    Washington, D.C. - September 7, 2017 (The Ponder News) -- Citizens Against Government Waste (CAGW) Director of Technology and Telecommunications Policy, Deborah Collier, testified this morning before the Senate Committee on Commerce, Science, and Transportation’s hearing on the, “Risk of Waste, Fraud and Abuse in the Federal Communications Commission’s Lifeline Program.”

    The testimony reads, in part:

    “Many Americans have heard of the ‘Obamaphones,’ made infamous by the viral 2012 video of a Cleveland woman touting the ‘free’ Lifeline program. However, few Americans realize is that Lifeline is part of the Low-Income support program, which was created in 1985 to provide subsidies for low-income households to obtain a telephone enabling them to communicate in emergencies.

    “Over the years, the Lifeline program has evolved from initially providing one landline telephone per household in need, to offering low-income, qualified subscribers a choice between a landline telephone, a wireless phone, or broadband internet service at a reduced cost (with a limit of one per household).”

    “GAO also revealed multiple instances of fraud and abuse within the program. For example, some recipients were using Craigslist to advertise the sale of Lifeline-subsidized phones and service. In other instances, Lifeline beneficiaries violated the one phone line restriction of the program by signing up for service from multiple carriers.”

    “Continued fraud and abuse within the Lifeline program has continued despite efforts to reform the verification process in 2012 and again in 2015. If Congress intends to continue the Lifeline program and make it sustainable in the future, CAGW strongly recommends that the USAC be required to implement a front end verification process, and the FCC engage in more stringent enforcement actions against companies that actively register ineligible or duplicate recipients into the program, and skirt the verification process.”

    ‘Kari’s Law’ Makes Dialing 911 Easier from Multiline Phones

    Washington, D.C. - August 7, 2017 (The Ponder News) -- U.S. Senator John Cornyn (R-TX) issued the following statement after the Senate passed the Developing Innovation and Growing the Internet of Things (DIGIT) Act, which included Kari’s Law, a bill that amends the Communications Act of 1934 to require multiline telephone systems, common in hotels and offices, to have the ability to directly dial 911 without locating an outside line first:

    “In an emergency situation, every moment counts. By ensuring all callers are able to directly dial 911, we can help save critical seconds that could mean the difference between life and death,” said Sen. Cornyn. “Following the example of the State of Texas, I’m glad my colleagues in the Senate have taken this commonsense step to help prevent tragedies across the nation.”

    Sen. Cornyn is an original co-sponsor of Kari’s Law, named after Kari Hunt, who was tragically killed in her hotel room in 2013. Kari’s daughter was unable to reach emergency personnel because she failed to dial “9” to locate an outside line on the multiline phone in the hotel room before dialing 911. The Texas legislature passed a similar state law that went into effect in 2016. A similar bill passed the House of Representatives on January 23, 2017.

    Kari Hunt was killed in her hotel room after her daughter was unable to reach emergency responders due to the hotel phone system's requirement of dialing an extra “9” to reach 911.

    “I am grateful my colleagues in the Senate have come together to pass this bill that has the potential to save many lives,” Senator Ted Cruz said. “No family should have to endure the grief inflicted upon the Hunt family, when technology that was supposed to be there in Kari's time of need was not easily accessible. I am a proud supporter of this bipartisan bill that will make dialing 911 easier and I hope it quickly becomes law.”

    ISAKSON FIGHTS FOR RURAL BROADBAND ACCESS

    Under current rules, Universal Service Fund (USF) support for broadband in rural areas comes with the outdated requirement that customers also sign up for traditional landline phone service. When rural customers decide they no longer need traditional landline phone service in favor of wireless or Internet-based phone services, rural communities served by smaller telecommunication providers lose access to USF support for broadband deployment, even if the customer continues to pay for broadband Internet service.

    Fischer, Klobuchar Lead Bipartisan Letter to FCC on Rural Broadband
