DeGette calls on HHS to lift restrictions on human fetal tissue research

In June 2019, the Trump administration banned all research using human fetal tissue within the National Institutes of Health and placed new restrictions on such research at independent labs. As a result, scientists at NIH and labs across the country have been unable to pursue promising biomedical research into conditions and diseases that affect millions – including coronavirus – because it involves the use of human fetal tissue.

Berry said, “I appreciate the Commission’s focus on ensuring every American has access to robust mobile broadband services and for a dedicated $9 billion for mobile service in rural America; however, I am extremely discouraged by the two options the Commission has proposed. The draft proposal sets up a false choice between, on the one hand, updating the FCC’s maps in line with the recently-enacted Broadband DATA Act but delaying funding for several years, and, on the other hand, moving forward using the flawed coverage data, simply for the sake of moving forward quickly. But these are plainly not the only options, nor the best options; there is no reason why the FCC cannot follow the law that Congress mandated and distribute needed funding in a timely manner, with accurate data. We should not be limiting ourselves to two inadequate options, but rather looking for real solutions to deploy mobile broadband as quickly as possible.”

The Disability Law Center (DLC) has taken several steps this week to advocate for Utahns with disabilities amid the COVID-19 pandemic. First, the DLC filed a complaint with the Department of Health and Human Services Office for Civil Rights (OCR) regarding the State’s Crisis Standards of Care on behalf of the agency and an individual who could be impacted, Jacob Hansen, an individual with cerebral palsy and cystic fibrosis. The guidelines’ Patient Prioritization Tool and Adult Triage Guidelines explicitly and implicitly deprioritize people with disabilities for care in violation of the Americans with Disabilities Act (ADA), Section 504 of the Rehabilitation Act (Section 504), and Section 1557 of the Affordable Care Act (ACA).

Burchett announces legislation to hold airlines accountable for taxpayer-funded relief

CMSS and its member societies urge federal, state and local authorities to ensure an adequate supply and distribution of PPE for every frontline healthcare professional in the United States. Physicians and other healthcare professionals can and should expect their institutions to provide appropriate means to limit occupational exposure. Physicians and other healthcare professionals should be allowed to bring their own PPE to protect themselves, colleagues, and patients when these items are in short supply at their institutions. CMSS supports the Joint Commission statement allowing the use of private PPE, but this option does not obviate an institution’s responsibility to provide adequate PPE to all healthcare personnel.

The rash and emotional decision by the Acting Secretary of the Navy to fire the Commanding Officer of the aircraft carrier USS Theodore Roosevelt is deeply troubling in this time of global crisis. The act is truly unprecedented. Normally commanding officers are relieved by their immediate superiors instead this one was fired by the Pentagon,” said Congressman Vela. The firing appears to be politically motivated as the result of a letter released to the media painting the picture of a dire situation that was dismissed by the chain of command. A situation that none of us can fully appreciate, because the situation on the ground is often far worse than what we hear in letters and phone calls.

We are particularly alarmed by the stark reversal from the Navy regarding CAPT Crozier’s leadership during this crisis. One day before CAPT Crozier was relieved of command, the Acting Secretary of the Navy stated in reference to the Captain’s 30 March request for assistance that “the fact that he wrote the letter to his chain of command to express his concerns would absolutely not result in any kind of retaliation.” It is also difficult to understand how CAPT Crozier’s decision to copy “20 or 30 people” on an email to his chain of command necessarily constitutes a breach warranting relief of command. This reversal sends a mixed message to sailors aboard the USS Theodore Roosevelt and given the remarkable show of support for CAPT Crozier by members of his crew, we are additionally worried about the impact of this decision on morale and readiness.

These reports are based upon mid-month surveys conducted on behalf of BLS, which do not reflect the full results of the last two new unemployment claims filed with state governments. The 1.35 million person increase in the number of unemployed is at least 8.5 million short of the actual number of people thrown out of work by the government’s response to the COVID-19 as demonstrated by the weekly unemployment claims reports released yesterday. This means that the actual COVID caused unemployment rate is likely between 9 and 10 percent and rising every day.

NEW DOT INITIATIVES TO PROTECT ROADSIDE FIRST RESPONDERS

Washington, D.C. - January 24, 2020 - (The Ponder News) -- U.S. Representative Cheri Bustos (D-IL-17), along with U.S. Senators Dick Durbin (D-IL) and Tammy Duckworth (D-IL), have applauded new U.S. Department of Transportation (DOT) initiatives designed to help avoid traffic accidents and save the lives of first responders rushing to aid in emergencies. The new initiatives closely mirror legislation Bustos, Durbin and Duckworth introduced last year that would establish a new national safety priority within an existing federal grant program to increase public awareness of “Move Over” laws and encourage implementation of life-saving digital alert technology. This technology is also referred to as V2X, or “vehicle-to-everything” communications systems, which can communicate with smartphones and other vehicles to alert passengers of an approaching emergency responder vehicle.

DOT’s announcement of these initiatives follows funding for a $5 million pilot program as part of a year-end bill that Bustos helped pass after Durbin secured language in the legislation. The pilot program would test and deploy these digital alert technologies to protect law enforcement, first responders, roadside crews, and others while on the job.

“We need to bring an end to the preventable tragedies we have seen along our roads and highways,” said Bustos. “That’s why I partnered with Senators Durbin and Duckworth to introduce legislation that brings awareness to our ‘Move Over’ laws and implements crash avoidance technology, and I’m pleased the Department of Transportation is taking initiatives to help address this issue. As the wife of a sheriff, I’m grateful for the work our first responders do every day and will continue to work to keep them safe.”

“We saw heartbreaking roadside accidents in Illinois last year, and we need to reverse the alarming rise in first responder roadside deaths,” Durbin said. “The initiatives announced by DOT are a helpful step forward that will provide states with resources to better enforce ‘Move Over’ laws and help keep our first responders safe.”

“One year ago this week, Illinois State Trooper Christopher Lambert was killed after being struck by a vehicle while assisting at a multi-vehicle crash. Trooper Lambert’s death and others like it reflect a troubling increase in first responder deaths that demands action,” said Duckworth. “I’m glad DOT is investing in new life-saving technologies like the First Responder Safety Technology Pilot Program, and I’ll continue to work with Senator Durbin and Representative Bustos to increase awareness of ‘Move Over’ laws and protect our first responders.”

In April 2019, Durbin paid tribute to three Illinois State Troopers who were killed after being struck by vehicles on the sides of roads and highways last year. Durbin honored Illinois State Troopers Brooke Jones-Story, Jerry Ellis, and Chris Lambert, and recognized the efforts of Lucy Kuelper, the daughter of an Illinois State Trooper who created a Facebook page to raise awareness about move over laws.

The Protecting Roadside First Responders Act, introduced by Bustos, Durbin and Duckworth last year, would establish move over law education and compliance as a national highway safety priority under existing NHTSA programs. This would allow states to apply for grant funding to execute move over law awareness campaigns, and to equip vehicles with digital alert and crash avoidance technology.

The digital alert technology, which is the focus of DOT’s new initiatives, is currently deployed by some localities around the country. This technology sends a real-time, audible, hands-free warning to motorists via navigation apps on their smartphone or their in-vehicle navigation system; notifying the driver when they are approaching an emergency responder vehicle. Deploying the technology only requires a small, inexpensive transponder to be added to emergency vehicles.

As of the Members’ introduction of the Protecting Roadside First Responders Act, 17 Illinois State Police (ISP) squad cars had been struck as a result of drivers failing to move over—twice as many as in 2018. Several suffered serious injuries and three of these incidents were fatal.

At least 37 auto-related first-responder deaths were recorded nationwide in 2019, of which 14 were officers struck by vehicles. Studies show more than 70 percent of Americans are unaware of Move Over laws like Scott’s Law in Illinois. All 50 states have Move Over laws.

Illinois’ move over law, called “Scott’s Law” was first enacted in 2002 to require motorists to slow down, and when possible, move over for all emergency vehicles with their lights on. It was later expanded in 2017 to include all pulled-over vehicles with their hazard lights on. The law is named after Chicago Fire Department Lt. Scott Gillen, who was killed in 2000 on the Bishop Ford Freeway. In July 2019, Governor Pritzker signed a bill expanding upon the law, which increases the fines for violators and charges them an additional $250 fee to establish a fund for education and enforcement of the law.

The Protecting Roadside First Responders Act would also:

  • Require NHTSA to promulgate rules mandating crash avoidance technology on all new motor vehicles, within two years, including automatic emergency braking, forward collision warnings, and lane departure warnings.
  • Require all federal fleet vehicles to have crash avoidance technology (automatic emergency braking, forward collision warnings, and lane departure warnings) within five years.
  • Require all federal fleet vehicles used for emergency response activities to be equipped with digital alert technology within five years.
  • Require research on the efficacy of Move Over laws and related public awareness campaigns as well as recommendations on how to improve these efforts to prevent roadside deaths.

    Volunteer Responder Incentive Protection Act (VRIPA) Introduced

    Washington, D.C. - April 23, 2019 - (The Ponder News) -- U.S. Senators Ben Cardin (D-Md.), a member of the Senate Finance Committee, and Susan Collins (R-Maine), the Chair of the Congressional Fire Services Caucus, introduced the Volunteer Responder Incentive Protection Act (VRIPA), bipartisan legislation to enhance communities’ ability to recruit and retain volunteer firefighters and Emergency Medical Services (EMS) personnel.

    “Local communities depend on the public service of volunteer firefighters to stay safe and secure. These modest changes will make it easier for communities across Maryland and nationwide to recruit and retain the bravest men and women who are ready to defend against whatever might come next,” said Senator Cardin. “Protecting our communities from harm is one of the most basic functions of government.”

    “Across our nation, volunteer firefighters play a critical role in helping to ensure the safety of our communities and the well-being of our neighbors. Maine is largely a rural state, and more than 90 percent of firefighters are volunteers. Without these public-spirited citizens, many smaller communities would be unable to provide firefighting and other emergency services at all,” said Senator Collins. “This bipartisan bill would protect cost-effective incentives that support the brave men and women who volunteer to protect their communities, and I urge our colleagues to join us in supporting the Volunteer Responder Incentive Protection Act.”

Passage of the Volunteer Responder Incentive Protection Act will make it easier for communities to offer incentives to their volunteers.”

    “Call and volunteer emergency responders are absolutely critical in a predominantly rural state like Maine,” said Ken Desmond, President of the Maine State Federation of Firefighters. “We thank Senator Collins for introducing this important legislation, which will support our efforts to maintain uniform and effective emergency response services throughout the State of Maine.”

    In order to bolster recruitment and retention, many fire and EMS agencies now provide benefits, including non-monetary gifts, reductions in property taxes, per-call payments, stipends, or retirement benefits. The Volunteer Responder Incentive Protection Act would allow communities to provide volunteer firefighters and EMS workers with up to $600 per year of property tax reductions or other incentives, without those benefits being subject to federal income tax and withholding. This would ease the administrative burden that local departments sometimes face when they reward their volunteers with minor benefits.

    The U.S. Senate Finance Committee has introduced the Retirement Enhancement and Savings Act, which incorporates VRIPA authored by Senators Cardin and Collins.

    First Responders, Transparancy, Sanctuary Cities, Whistleblowers, Tsunamis, Russia and Weather

    U.S. Representative Gus Bilirakis (FL-12) took to the House floor to speak on his legislation, the Medical Preparedness Allowable Use Act (H.R. 437). The bill would help boost medical countermeasures for first responders in the event of an emergency, like a terrorist attack or hurricane.

    H.R. 5 was passed in the House of Representatives on Wednesday, January 11, 2017. The six bills included in H.R. 5 include:
    Regulatory Accountability Act: Requires agencies to use less costly regulations to achieve a given objective. (Title I—Regulatory Accountability Act )

    Separation of Powers Restoration Act: Repeals the Chevron and Auer doctrines and enables judges to “end judicial deference to bureaucrats’ statutory and regulatory interpretations.” (Title II – Separation of Powers Restoration Act)

    Small Business Regulatory Flexibility Improvements Act: Requires agencies to explain how their actions affect small business owners, employees, and customers. (Title III—Small Business Regulatory Flexibility Improvements Act)

    REVIEW Act: Prevents new rules with billion-dollar annual costs from taking effect until litigation against them has been resolved. It would not affect current regulations. (Title IV—REVIEW Act)

    ALERT Act: Requires agencies to publish already-mandatory transparency reports that they regularly dodge. (Title V—ALERT Act)

    Providing Accountability Through Transparency Act: Requires agencies to publish summaries of their new rules in plain English. (Title VI—Providing Accountability Through Transparency Act)


    Rep. Rob Bishop (UT-01) introduced H. J. Res. 100, a proposed amendment to the United States Constitution that would provide states with the authority to repeal any federal rule or regulation if two-thirds of the states are in agreement.

    Congressman Diane Black (R-TN-06) and Senator Pat Toomey (R-PA) introduced the Stop Dangerous Sanctuary Cities Act on Wednesday, January 11, 2017. The legislation, introduced with the support of 59 House cosponsors and the backing of the Federation for American Immigration Reform (FAIR), would withhold key federal funding streams from jurisdictions that forbid their law enforcement officers from cooperating with federal immigration officials.

    The House of Representatives unanimously approved Congressman Rod Blum’s legislation to protect whistleblowers in the federal government by reauthorizing the Office of Special Counsel (OSC) through 2021.

    The Office of Special Counsel is responsible for protecting federal employees from retaliation for whistleblowing on violations of law, mismanagement of funds, abuse of authority, or other prohibited practices within the federal government.

    Congresswoman Suzanne Bonamici (D-OR) has introduced bipartisan legislation to help prepare coastal communities for tsunami. Several other Congressional members have sponsored the bill with Bonamici, including Representatives Peter DeFazio (D-OR), Jaime Herrera Beutler (R-WA), Eddie Bernice Johnson (D-TX), Don Young (R-AK), Earl Blumenauer (D-OR), Darrell Issa (R-CA), Denny Heck (D-WA), Dana Rohrabacher (R-CA), Pramila Jayapal (D-WA), Charlie Crist (D-FL), and Derek Kilmer (D-WA). This legislation will strengthen tsunami detection and warning systems, improve response and resiliency, and better protect communities vulnerable to tsunami. The legislation would complement local and state efforts to prepare for tsunami.

    The U.S. House unanimously approved H.R. 353, the Lucas-Bridenstine Weather Research and Forecasting Innovation Act. This legislation prioritizes protecting lives and property.

    This legislation is the product of a bipartisan effort. It directs the Administrator of the National Oceanic and Atmospheric Administration (NOAA) to focus resources and effort to:

  • Rebalance NOAA funding to place a higher priority on weather-related research and activities;
  • Emphasize developing accurate forecasts and timely warnings of high impact weather events;
  • Create programs to extend warning lead times and improve forecasts for tornadoes and hurricanes;
  • Develop a plan to utilize advanced technology to regain U.S. superiority in weather modeling and forecasts;
  • Increase focus and continue development of seasonal forecasts and how to maximize information from these forecasts; and
  • Enhance coordination among various federal government weather stakeholders.

    The legislation also authorizes and extends a NOAA pilot program already under way thanks to a partnership between the House Science Space and Technology and the House Appropriations Committee. Under this pilot program, NOAA has already issued two contracts to procure commercial satellite weather data. This pilot program could bring about a paradigm shift in how NOAA makes decisions about future procurement of critical weather data.
