Lawrenceville, GA - April 19, 2019 - (The Ponder News) -- Last week, the House Rules Committee met to consider H.R. 2021, the “Investing for the People Act.” Representative Austin Scott (GA-08) testified about his amendment to H.R. 2021, which would have provided emergency disaster assistance funding to farmers, ranchers, and others who were harmed by 2018 natural disasters.

In October, Hurricane Michael devastated parts of South and Middle Georgia. Since then, the entire Georgia Congressional Delegation has worked to secure federal assistance for not only Georgia, but for other areas impacted by hurricanes, wildfires, flooding, and other natural disasters during 2018. Unfortunately, the Senate failed to advance disaster aid legislation due to ongoing policy disagreements. Representative Scott’s amendment was a new attempt to secure disaster aid following continued obstruction by Senate Democrats who refuse to support the compromise legislation drafted by Georgia’s Senators Isakson and Perdue.

“Georgia is the number one producer of peanuts and pecans in the United States. Our state is the second largest producer of cotton, has the fourth largest amount of total forest land area, and 24.4 million acres of available timberland for commercial use in our country,” said Congressman Woodall. “Farmers from California to New York and all the way down to Georgia work day and night to fill the refrigerators for all Americans. Each year, our farmers take enormous risks on our behalf, and as Americans, we should do everything we can to stand behind these hardworking men and women who are willing to put their family’s well-being on the line.”

“For months, I have received calls from farmers and the lenders they rely on that the financial impacts from Hurricane Michael were becoming increasingly more difficult to bear. The truth is, if Hurricane Michael had hit Americans who weren’t farmers or farmers who aren’t Americans, the stories of Washington’s apathy to get this done would be the front page of every paper,” said Congressman Austin Scott. “For months, we have stressed the magnitude of the damage to our colleagues, and for months we were promised that this was a priority for the White House and Congressional leadership from both sides of the aisle. The letter comes after Governor Gavin Newsom sent a letter to President Trump over the weekend requesting a Presidential Major Disaster Declaration for communities across California impacted by February’s flooding.

“I urge President Trump to issue a Presidential Major Disaster Declaration in order to help hundreds of families and local businesses qualify for federal resources and get back on their feet,” said Dr. Ruiz. “Our communities hurt by the Valentine’s Day floods need help to fix roads and property. I have monitored the damage and communicated our local needs to Governor Newsom and applaud his diligent response and request to the President. We must support the people who, due to road damage, endure long drives to medical appointments, loss of customers to their small business, and longer commutes to work. I will continue to track progress and advocate to bring home federal resources to fix our roads and businesses.”

Background

On April 13, Governor Gavin Newsom requested Presidential Major Disaster Declarations to bolster ongoing state and local recovery efforts following severe February storms that caused widespread flooding, mudslides, and damage to critical infrastructure across California.

If granted, the Presidential Major Disaster Declarations would help state, tribal, and local governments with recovery projects including the repair and replacement of disaster-damaged facilities and infrastructure, such as roads, bridges and utilities.

I am writing in support of Governor Gavin Newsom’s request for a Major Disaster Declaration for California communities impacted by the severe winter storms that occurred in February. As the Representative of California 36th Congressional district, I urge you to swiftly provide federal aid to the affected communities, including those I represent in Riverside County and the San Jacinto Mountains.

The major weather event that occurred in mid-February brought heavy winds and rains that caused intense flooding, mudslides, and damaged critical infrastructure including sewage systems and roadways. State Routes 243 and 74, near the town of Idyllwild in the San Jacinto Mountains, were so severely damaged that repairs are estimated to take up to two months to complete, stranding businesses and residents in the area.

I have heard from my constituents about the personal and economic toll these damages have taken on our communities. Road closures have led some residents to struggle to reach their medical appointments, and local economies have suffered due to declines in tourism. Federal aid is essential to helping these communities recover and local residents get back on their feet.

Thank you for your consideration, and I urge you to grant this disaster request as soon as possible. I look forward to working with you to ensure that the individuals affected by these storms have the necessary resources to repair their communities and local infrastructure.

Washington, D.C. - October 24, 2017 - (The Ponder News) -- No one in this chamber is immune from disaster.  Six years ago, Marcelle and I watched with great alarm as communities around Vermont felt the devastating impact of Tropical Storm Irene.  That storm washed away entire communities in our state, tearing down homes, local landmarks and bridges alike.

Republicans and Democrats in the Senate, from across the country, stood by Vermont’s side then to help us rebuild.  Because that is who we are as Americans.  We lift each other up in times of disaster.

Today, in California and across the West, families are returning to the charred ruins of their homes.  In Florida and Texas communities are trying to put their lives back together after Hurricane Harvey and Irma. And in Puerto Rico, hundreds of thousands are still without potable water, electricity, cell service, or adequate medical supplies following Hurricane Maria.  Millions of Americans need us to work together to help lift them up.

That is why it is so disappointing that President Trump seems more concerned with claiming credit for a job well done than the actual situation on the ground, particularly in Puerto Rico.  President Trump has given himself a “10 out of 10” for the Administration’s response to the devastating hurricane, but let’s look at some numbers that really matter. 

It has been 48 days since Hurricane Irma made landfall in Puerto Rico, and 34 days since Hurricane Maria tore through the island. These storms wreaked havoc on those who live there, destroying houses, and killing at least 49 people.  Yet 48 days later nearly 80 percent of the island is still without power, and over 30 percent of the population is without clean drinking water.  Roads are impassable.  Bridges are down.  Hospitals operate on generators.

The Administration was slow to respond to the disaster, and to claim that they get a “10 out of 10” for their response is to ignore the facts.  This is not a reality TV show where the participant with the highest score advances to the next round.  These are people’s lives.  These are people’s homes.  This is the hard part of governing.  This is where we roll up our sleeves and dig in for the long haul.

Today we will vote to advance a disaster package containing $36.5 billion in additional emergency relief.  The bill includes $18.7 billion for the Federal Emergency Management Agency (FEMA) Disaster Relief Fund, $16.0 billion for National Flood Insurance Program debt forgiveness, $1.2 billion for nutrition assistance, and $576.5 million to address wildfires in the Western United States. 

As Vice Chairman of the Appropriations Committee, I support this bill and urge my colleagues to do the same.  If we do not act, the Disaster Relief Fund and the Flood Insurance Program will run out of resources in a matter of days.  This money will allow FEMA, the Department of Defense, the Army Corps of Engineers, and other agencies to continue their work in all of the devastated communities, and families to begin rebuilding their homes. 

But this is still just the next step on the path to recovery.

Last week I met with the Governor of Puerto Rico, Ricardo Rosselló.  He detailed the unique challenges facing Puerto Rico.  The electric grid was almost completely destroyed.  Its infrastructure was demolished.  Houses were flattened.  At the same time, Puerto Rico faces a fiscal situation that will make it nearly impossible for it to provide the federal match required for most disaster assistance programs, and it faces a Medicaid funding crisis that may leave nearly one million people without health care in just a matter of months.

Our response cannot be business as usual.  Going forward we need to tailor disaster assistance to meet Puerto Rico’s unique challenges.  We may need to consider legislation to address its unique needs.  And, most importantly, we need to think long term.  To simply replace and repair what was destroyed would be short-sighted.

We must help Puerto Rico recover and rebuild to be more resilient and better prepared.  We should invest in the 3.4 million U.S. citizens in Puerto Rico and their infrastructure so the next disaster is not a humanitarian crisis.

This opportunity is not unique to Puerto Rico.  We must acknowledge that historic storms are now annual occurrences, and we must respond accordingly.  Across the country, from the wildfires in California to the flood damage in Florida, Texas, and the U.S. Virgin Islands, we can invest in technology, conservation and infrastructure that will mitigate further damage and make our communities more resilient.

This will require a commitment from the United States Government that is not measured in days, or weeks or months, but in years.  A commitment that does not waiver, and a commitment that does not depend on whether you live in Texas, Florida, Puerto Rico, or the U.S. Virgin Islands.

Today, I urge all Senators to support this emergency supplemental that will provide much needed assistance to disasters across the country.  But this is still just the next step on the path to recovery.

The Trump Administration has committed to putting forward a third, more comprehensive disaster package in the coming weeks.  As Vice Chairman of the Senate Appropriations Committee, I intend to hold the Administration to that commitment.

Smith Bills Take Aim at Two Unjust Policies Uncovered in Superstorm Sandy

Chris Smith (R-NJ) is leading the charge, for a second time, to reform two federal disaster relief and recovery programs, one that discriminates against faith-based organizations and another that forces individual victims to take on new debt while boxing them out of possible federal grants. These flaws surfaced during the Superstorm Sandy recovery effort and both fixes are now gaining support as Congress prepares a larger recovery package for victims of Hurricanes Harvey and Irma.

“Superstorm Sandy taught us tough lessons—in the preparation for a storm and its aftermath, it showed us some significant flaws in our federal assistance programs,” said Smith, whose constituents in coastal areas in Monmouth and Ocean counties were hit hard by the Superstorm Sandy in 2012. “The Equity for Disaster Victims Act of 2017 (H.R. 3674) and the Federal Disaster Assistance Nonprofit Fairness Act of 2017 (H.R. 2405) address injustices in our disaster recovery programs and both bills are desperately needed,” he said.

Smith’s original bill, the Federal Disaster Assistance Nonprofit Fairness Act of 2013 (H.R. 592), passed the House of Representatives just months after Superstorm Sandy hit New Jersey in a decisive 354-72 vote. Sadly, the Senate failed to act on the legislation.

Federal Disaster Assistance Nonprofit Fairness Act of 2017

The Federal Disaster Assistance Nonprofit Fairness Act of 2017 (H.R. 2405) is bipartisan legislation that would put houses of worship on an even playing field with other private non-profit organizations seeking disaster assistance. In the last 8 years, here have been many nonprofit religious organizations, churches, synagogues and other religious centers that were completely shut out of getting federal assistance despite damage they sustained and the essential services they provide in the wake of a disaster.

“Faith-based organizations are hit just as hard as other private non-profits when natural disasters strike,” Smith said. “They don’t need or want special treatment—but to be totally excluded from recovery programs is unjust and unfair. It’s ironic that houses of worship are among the first to open their doors and serve victims of natural disasters—but also the first to be turned away from disaster assistance.

FEMA’s past discriminatory policy of excluding houses of worship from disaster relief is not prescribed by any law. The Obama Administration just refused to help them. It’s discrimination and the policy must change.”

Smith’s new bill, cosponsored by lead Democrat Rep. Grace Meng (D-NY) and a dozen bipartisan Members, stipulates that FEMA provides disaster relief assistance using criteria that are neutral with regard to religion. Any funds granted to houses of worship would be allocated in accordance with FEMA’s standard policies and procedures for other private nonprofit facilities in the wake of a natural disaster.

Last week, lawmakers were encouraged by messaging from President Trump. On September 8th, the President tweeted: “Churches in Texas should be entitled to reimbursement from FEMA Relief Funds for helping victims of Hurricane Harvey (just like others).”

Smith’s second bill, The Equity for Disaster Victims Act of 2017 (H.R. 3674), would reform the federal government’s disaster relief programs to allow homeowners, small businesses and nonprofits that accepted Small Business Administration (SBA) loans following Sandy to receive federal grants for which they would otherwise be eligible except for the fact that they had accepted a federal loan. Smith’s bill would require that the grant money be used to repay the loan, thereby enabling victims to avoid further debt while allowing them to benefit from the same grants—usually run by the Department of Housing and Urban Development—that others who delayed their application later received.

“Homeowners who were encouraged—and in many cases pressured—to move quickly and apply for loans through the SBA only to learn later that such loans make them ineligible for subsequent grant programs,” Smith explained. “The current misguided rule is designed to eliminate a duplication of benefits, but instead it punishes those who follow federal advice and rewards those who procrastinate. My bill restores fairness to the equation and enables victims to qualify on equal footing for grant programs that are by nature available later in the process.”

In July of 2015, Smith testified before the House Committee on Small Business and urged SBA and HUD to provide an equitable solution. He told the committee of a New Jersey family who applied for and received an SBA home disaster loan after their homes were destroyed by Sandy.

After liquidating their retirement savings and incurring a substantial tax penalty as a result, the family applied for relief through New Jersey’s Reconstruction, Rehabilitation, Elevation and Mitigation (RREM) Program. The family was shocked to learn of their ineligibility for a grant award solely due to their acceptance of the SBA loan—a consequence that they were never informed of during the loan process. Others in a similar predicament were also denied grants.

“To qualify for the SBA loans, victims tap other assets, company pension plans, IRAs, college saving accounts—all to take on new debt so they can rebuild,” said Smith. “Allowing them access to grants to help pay back that debt helps them get back on their feet and ensures that they are not penalized for working diligently towards recovery.”

Smith noted that not only is the policy unfair, but it is not clearly explained to people desperate after a disaster. “Homeowners, from the Jersey Shore to the Gulf Coast and everywhere in between, need to know of their potential preclusion from further assistance when considering home disaster loans,” Smith said. “Post-Superstorm Sandy, these loans were the primary option offered to homeowners needing to rebuild. Those who accept home disaster loans should not be precluded from future HUD assistance just because such assistance is not yet available.”

First of all, let me say that I LOVE MY HOME STATE OF TEXAS. Here, in Texas, we pride ourselves on being able to take care of our own problems without interference from anyone -- the state, and the individuals in it. When we do need help, we know we can count on each other, because that's just the "Texas-friendly way".

The nation is awed by our resilient spirit in this time of crisis since Harvey wreaked havoc. They are amazed at the unity and cooperation we have shown, both with authorities, and with each other. I look at the victims surfacing in Harvey's wake, and I think, "Our state bird should be the Phoenix..."

You might knock us down, but we don't stay down long -- and we will never stop trying to get back up. Anything less is undignified. The Alamo proved that we don't go down without a fight, and we WILL rise from the ashes into something BIG!
