Student group files suit against Arkansas State for limiting speech to 1% of campus

Washington, D.C. - December 15, 2017 - (The Ponder News) -- Alliance Defending Freedom attorneys filed a federal lawsuit Wednesday against Arkansas State University on behalf of the organizers of a student organization, Turning Point USA, to challenge the constitutionality of the ASU five-campus system’s restrictive speech policy. Among other things, the policy limits speech to roughly one percent of the Jonesboro campus.

“Public universities are supposed to be the marketplace of ideas, but those marketplaces can’t function properly when university officials stifle the ability of students to engage in free speech,” said ADF Senior Counsel Tyson Langhofer. “Arkansas State’s speech policies contain provisions that the courts have repeatedly struck down as unconstitutional at other schools. The university can demonstrate its dedication to the free exchange of ideas by modifying its policies to comport with the First Amendment.”

When ASU student Ashlyn Hoggard and another individual with Turning Point USA—a non-partisan organization that educates students about the importance of fiscal responsibility, free markets, and limited government—recently attempted to set up a table outside the student union to generate interest in forming a chapter on campus, an administrator immediately stopped them, citing the university’s speech policy.

That policy unconstitutionally restricts speech activities to small zones on campus that total about one percent of the campus, requires advance permission for students to use the speech zones, and gives university officials free reign to restrict the content and viewpoint of student speech.

“Instead of fostering a marketplace of ideas, Arkansas State is unconstitutionally limiting exposure to ideas,” said ADF Senior Counsel Casey Mattox, director of the ADF Center for Academic Freedom. “Today’s college students will be tomorrow’s judges, legislators, and voters, and with its current policies, Arkansas State is communicating to that generation that the First Amendment doesn’t matter.”

Ethan Nobles, one of more than 3,200 attorneys allied with ADF, is serving as local counsel in the lawsuit, Turning Point USA at Arkansas State University v. The Trustees of Arkansas State University, filed in the U.S. District Court for the Eastern District of Arkansas.

Sen. Coons, Colleagues Call for ACTION to Expand Opportunities for National Service

Washington, D.C. - November 4, 2017 (The Ponder News) -- In an effort to tackle national priorities and help young Americans strengthen their communities and our nation while reducing the burden of student debt, U.S. Senators Chris Coons (D-DE), Jack Reed (D-RI), and Richard Blumenthal (D-CT) introduced the America’s Call To Improve Opportunities Now (ACTION) for National Service Act. The bill would increase opportunities for service across the country and provide young Americans with the chance to select a service program in a variety of fields. In exchange for their national service, students would get help paying for college.

The ACTION for National Service Act calls for elevating the Corporation for National and Community Service to a cabinet-level agency and providing resources to help support up to one million national service positions annually, enhancing participation in notable national service programs such as AmeriCorps and Senior Corps.

Currently, about one percent of Americans serve in either the military or a national service program. Retired General Stanley A. McChrystal, who serves as Chairman of the Board for the nonprofit Service Year Alliance, has stated that expanding national service options could go a long way toward uniting Americans and bridging the military-civilian divide by fostering a better understanding of shared sacrifice. General McChrystal noted: “Right now, less than one percent of our population serves in the military and, in my view, we need to rethink and create a system where young Americans have an opportunity to serve their nation in other ways. We need to create a culture of service where we are all invested in our nation's future and feel a shared sense of responsibility to our nation and to each other.”

Since 1994, over 1 million individuals have served through the AmeriCorps program, and roughly 245,000 seniors over the age of 55 volunteer annually through the Senior Corps programs. These individuals have addressed critical community needs in education, economic development, health, and many other areas, coming to their fellow citizens’ aid in times of national disaster, including thousands who have been deployed in the wake of Hurricanes Harvey, Irma, and Maria. The bill seeks to enhance the nation’s capacity to support all those who want to serve their communities and the nation.

“Expanding national service opportunities for young Americans strengthens our communities, broadens the worldview of our next generation of American leaders, and instills in our young men and women a sense of pride in themselves and their country that can only be gained through giving back,” said Senator Coons. “As we work to make college more accessible and give our young people the opportunities they deserve to succeed, national service has to be part of the equation. I’m excited to introduce this bill and expand the impact of national service in the United States.”

This bill will grow our capacity to enlist, equip, and empower young people to address pressing challenges and give back to our nation while they earn money toward their education. It will increase volunteerism and strengthen our nation,” said Senator Reed. “Today, young people are eager to find ways to serve, and we need to do a better job of providing them with opportunities to give back. This willingness to make common cause with our fellow citizens and serve a purpose greater than ourselves is a hallmark of our nation. It’s also crucial that we invest in the education and professional development of those who have sacrificed and given so much to our nation. That’s why I’m pleased to introduce this legislation with my colleagues to help ensure that every American who wants to serve has the opportunity to do so, as well as future opportunities to get an education and build a better life. I commend Congressmen Larson, Lewis, and Kennedy for their leadership on this issue and longstanding commitment to expanding national service opportunities for all.”

I am proud to support the ACTION for National Service Act, which would elevate and protect the spirit of service embodied in AmeriCorps and other federal service programs to inspire a new class of young leaders nationwide.”

Specifically, the ACTION for National Service Act:

• Gives all those who wish to serve the opportunity to do so by providing the necessary federal funding to support at least one million service positions nationwide.

• Significantly reduces student loan debt burdens by ensuring that individuals who serve two full terms of service are rewarded with an education benefit equivalent to four years of the average in-state tuition at a public, four-year college. Current law limits the award's value to the maximum amount of a Federal Pell Grant at the time of the individual’s service.

• Makes the education benefit free from federal taxation. Currently, education benefits count as income for tax purposes.

• Elevates the existing Corporation of National and Community Service (CNCS) to a Cabinet-level federal agency, and appoints a Director of National Service with the same rank as Cabinet Secretaries. Existing CNCS programs like AmeriCorps and Senior Corps would be preserved and strengthened.

• Maintains the authority and programmatic responsibilities of state and local boards to direct federal resources to best meet community needs and be responsive to local priorities.

• Allows participants in programs outside of existing CNCS programs to be evaluated for eligibility for enhanced education benefits.

• Establishes a National Service Foundation to encourage private sector and philanthropic investment in expanding national service opportunities.

U.S. Representatives John B. Larson (D-CT), John Lewis (D-GA), and Joe Kennedy III (D-MA) have introduced similar legislation, the ACTION for National Service Act (H.R. 3140), in the U.S. House of Representatives.

Democrats Introduce Bold Legislation to Broadly Expand Access to Higher Education

Washington, D.C. - September 11, 2017 (The Ponder News) -- Representative Bobby Scott (VA-03), ranking member of the Committee on Education and the Workforce, Representative Susan Davis (CA-53), ranking member of the Subcommittee on Higher Education and Workforce Development, and Representatives Donald Norcross (NJ-01), Seth Moulton (MA-06), and Anthony Brown (MD-04), introduced the America’s College Promise Act of 2017, which would make two years of community college free and provide an affordable pathway to a four-year college degree for low-income students.

“Students and families are faced with the overwhelming burden of figuring out how to pay for college,” said Rep. Scott. “This bill will help more families gain access to quality, affordable higher education opportunities. For low-income students, this bill creates a clear pathway to a four-year degree. At a time when families feel that it is almost impossible to get a college degree at an affordable price, America’s College Promise (ACP) is a bold investment in our students to ensure they gain the skills they need to compete in a 21st century economy.”

The bill provides a federal match of $3 for every $1 invested by the state to waive community college tuition and fees for eligible students before other financial aid is applied. America’s College Promise would also help to cover a significant portion of tuition and fees— for either the first two years or last two years of college—for low-income students who choose to attend qualifying HBCUs, HSIs, AANAPISIs and other MSIs.

This legislation is a cornerstone proposal included in House Democrats’ Aim Higher initiative, a package of legislative initiatives focused on providing all students with access to a meaningful degree that costs less money and leads to a good paying job.

“Community college can be a springboard to a 4-year degree or an opportunity to develop critical workforce skills,” said Rep. Davis. “We must be expanding education opportunities at every level to allow students to find the education paths that work best for them. The America’s College Promise Act will open up even more opportunities for Americans to thrive in higher education and the workplace.”

“I’m a product of community college – it’s what took me from construction work to Congress. I know firsthand that we need to invest in our community colleges as affordable alternatives. We must encourage students to embark on a pathway that leads to a good-paying job,” said Rep. Norcross, an electrician by trade who attended Camden County College and an IBEW apprenticeship program. “Plus, as a father and grandfather, I know about the sticker shock of trying to put children through college. The cost of higher education is one of the greatest financial challenges facing American families today. It’s dragging down our economy and, more importantly, our children. The America’s College Promise Act gives our children a fair shot in the classroom and our families a fair break from that sticker shock.”

ACP was originally introduced in the 114th Congress with the goal of making community college as universal as high school. This Congress, eligibility has been expanded to allow both new and returning students to participate in America’s College Promise, in response to similar expansions in state-led Promise programs. Additionally eligibility for participation in the Pathways to HBCUs and MSIs portion of the bill has also been expanded to allow institutions to serve low-income students who may have qualified for a federal Pell Grant but were ineligible due to their immigration status.

"Far too many students are taking on the economic burden of attending college without the skills necessary to complete their degree,” said Rep. Moulton. “This bill will help provide our children the opportunity to be successful in the modern economy by eliminating barriers that stand in the way of a good education.”

“Every American should be able to earn the education and skills to compete and get ahead in the 21st century economy,” said Rep. Brown. “Community colleges are pathways to the middle class for millions of young people graduating high school, workers looking to get new skills and veterans transitioning back to civilian life. This game-changing bill will make community college free for responsible students, and create new affordable educational opportunities at diverse four-year colleges for low-income students – because in America, a quality education should be a right for everybody willing to work for it.”

ACP is supported by the Association of Community College Trustees (ACCT) and the American Association of Community Colleges (AACC).

Justice Dept. to use resources to sue universities over discrimination, document says

The document does not explicitly identify whom the Justice Department considers at risk of discrimination because of affirmative action admissions policies. But the phrasing it uses, “intentional race-based discrimination,” cuts to the heart of programs designed to bring more minorities to university campuses.

Supporters and critics of the project said it was clearly targeting admissions programs that can give members of generally disadvantaged groups, like black and Latino students, an edge over other applicants with comparable or higher test scores.

New York Congressman Demands Investigation Into Iranian Funding of US Universities Through Alavi Foundation

A New York congressman is urging US Education Secretary Betsy DeVos to investigate the funneling of millions of dollars by an Iranian regime-controlled foundation to Ivy League universities, including Harvard, Columbia and Princeton.

“Did this foundation attempt to subvert American academic institutions?” Rep. Dan Donovan (R-NY), who represents the Staten Island borough, asked concerning the donations from the New York City-based Alavi Foundation, which critics say have funded anti-Israel and pro-Iran academics.
