Supreme Court Travel Ban Decision Praised

Washington, D.C. - December 5, 2017 - (The Ponder News) -- The United States Supreme Court ruled President Trump’s travel pause may go forward while appeals continue.

Lou Barletta (R-PA, 11th) released the following statement:

“President Trump is fighting to prevent terrorists from entering the American homeland. The Supreme Court made the right decision. Those who oppose the actions our president is taking to keep American citizens safe are fighting against the man, not the policy. Until radical Islamic terrorism ceases to threaten the United States, I will continue to support President Trump’s clear authority to use all legal tools at his disposal to prevent terrorists from entering the American homeland.”

PEN America Washington Director Gabe Rottman released the following statement:

“At most, this is a temporary victory for the administration. Challenges to this unprecedented, divisive, and cruel Muslim ban will continue to work their way through the courts, and we will fight to ensure that every American can exercise their constitutional right to meet face-to-face with writers and artists from around the world. We should be a beacon for the free flow of ideas, and a haven for those who are persecuted for their beliefs, not a country that tears families apart for no reason other than hate and spite.”

Court Order on Presidential Proclamation on Visas November 13, 2017

Washington, D.C. - November 23, 2017 (The Ponder News) -- On November 13, the U.S. Court of Appeals for the Ninth Circuit granted, in part, the government’s motion for an emergency stay of the U.S. District Court for the District of Hawaii’s October 17, preliminary injunction. The preliminary injunction prohibited the U.S. government from enforcing or implementing Sections 2(a), (b), (c), (e), (g), and (h) of Presidential Proclamation 9645, “Enhancing Vetting Capabilities and Processes for Detecting Attempted Entry into the United States by Terrorists or other Public-Safety Threats.” Under the Ninth Circuit’s ruling, the earlier preliminary injunction is stayed, except as to “foreign nationals who have a credible claim of a bona fide relationship with a person or entity in the United States.” In light of the Ninth Circuit’s ruling, visa applicants who are nationals of Chad, Iran, Libya, Syria, Somalia, and Yemen and do not have a credible claim of a bona fide relationship with a person or entity in the United States are now subject to the applicable visa restrictions under the Presidential Proclamation. Consequently, any applicants who lack such a claim, if found otherwise eligible for a visa, will be denied under the Proclamation, unless they are exempt or qualify for a waiver under the Proclamation. The court orders did not affect Sections (d) and (f) of the Proclamation, so nationals from North Korea and Venezuela remain subject to the restrictions and limitations listed in the Presidential Proclamation, which went into effect at 12:01 a.m. EDT on Wednesday, October 18, 2017, with respect to nationals of those countries.

Additional Background: The President issued Presidential Proclamation 9645 on September 24, 2017. Per Section 2 of Executive Order 13780 of March 6, 2017 (Protecting the Nation from Foreign Terrorist Entry Into The United States), a global review was conducted to determine what additional information is needed from each foreign country to assess whether foreign nationals who seek to enter the United States pose a security or safety threat. As part of that review, the Department of Homeland Security (DHS) developed a comprehensive set of criteria to evaluate the information-sharing practices, policies, and capabilities of foreign governments on a worldwide basis. At the end of that review, which included a 50-day period of engagement with foreign governments aimed at improving their information sharing practices, there were seven countries whose information sharing practices were determined to be “inadequate” and for which the President deemed it necessary to impose certain restrictions on the entry of nonimmigrants and immigrants who are nationals of these countries. The President also deemed it necessary to impose restrictions on one country due to the "special concerns" it presented. These restrictions are considered important to addressing the threat these existing information-sharing deficiencies, among other things, present to the security and welfare of the United States and pressuring host governments to remedy these deficiencies.

Nationals of the eight countries are subject to various travel restrictions contained in the Proclamation, as outlined in the following table, subject to exceptions and waivers set forth in the Proclamation. In addition, under applicable court orders, applicants from Chad, Iran, Libya, Somalia, Syria, and Yemen who have a credible claim of a bona fide relationship with either a person or an entity in the United States are exempt from the restrictions in the Proclamation. Consequently, if the requirements for a particular visa classification include that the applicant have a bona fide relationship with a person or entity in the United States, then applicants qualifying for visas of those classifications are exempt from the Proclamation, based on the court orders.

American Bar Association Responds to AG Sessions comments criticizing judges

Washington, D.C. - October 28, 2017 (The Ponder News) -- The American Bar Association is alarmed by the remarks made Thursday by Attorney General Jeff Sessions about federal judges, accusing those he disagrees with of ruling on policy preference and not the law.

Ironically, Sessions complains that judges are not respecting the separation of powers and the concept of co-equal branches of government while at the same time himself disregarding the constitutional independence of the judicial branch.

Sessions said that “some judges have failed to respect our representatives in Congress and failed to appropriately respect the prerogatives and perspectives of the executive branch.” The judiciary rules on matters based on the laws and the Constitution. Their oath is “to protect and defend the Constitution of the United States” and not to protect “the prerogatives and perspectives” of the executive branch.

The courts are an important part of the justice system. While criticism of judicial decisions is a constitutionally protected right of every American and embedded in our tradition of free and open discussion about government, judges should not be attacked or diminished by another branch of government just because they do not rule in its favor. Judicial independence is critical to maintaining the rule of law in our nation.

Blumenthal Statement on Federal Court Blocking - Again - Trump Muslim Travel Ban

An independent judiciary has upheld American values as well as American law. Out of the welter of judicial rulings should emerge a simple truth: the Trump attempts to discriminate based on religion violate the spirit and letter of the American Constitution. “No legal or linguistic maneuvers by the Trump administration can disguise the travel ban’s discriminatory intent. Each rendition of this ban fuels President Trump’s anti-immigrant agenda and further obstructs our brothers and sisters from reaching safety and a better life –plain and simple. We’re heartened a federal judge in Hawaii again affirmed this truth in court. Today is yet another reminder that it’s high time for this White House to cease targeting immigrants and Muslims. White House slams decision to block travel ban

Washington, D.C. - October 17, 2017 (The Ponder News) -- The White House released this statement after a Hawaii Judge blocked implementation of Trump's latest travel ban:

"Today’s dangerously flawed district court order undercuts the President’s efforts to keep the American people safe and enforce minimum security standards for entry into the United States. The Department of Justice will vigorously defend the President’s lawful action. The proclamation restricting travel was issued after an extensive worldwide security review by the Secretary of Homeland Security, and following consultation by the President with members of the Cabinet, including the Secretaries of Homeland Security, State, and Defense and the Attorney General. The entry restrictions in the proclamation apply to countries based on their inability or unwillingness to share critical information necessary to safely vet applications, as well as a threat assessment related to terrorism, instability, and other grave national security concerns. These restrictions are vital to ensuring that foreign nations comply with the minimum security standards required for the integrity of our immigration system and the security of our Nation. We are therefore confident that the Judiciary will ultimately uphold the President’s lawful and necessary action and swiftly restore its vital protections for the safety of the American people. "

Trump Extends Travel Restrictions

Washington, D.C. - September 25, 2017 (The Ponder News) -- Congressman Lou Barletta (PA-11), a member of the House Committee on Homeland Security, applauded President Trump’s announcement that he will be using his constitutional authority to strengthen security standards for foreign nationals traveling to the United States. President Trump’s enhancement of national security measures per Executive Order 13780 temporarily suspended travel to the United States from eight countries that have strong connections to terrorism, inadequate information sharing services, and poor screening and vetting processes. Five of the countries listed in the executive order have failed to improve their vetting processes to the administration’s baseline standard, and therefore restrictions will be maintained on foreign nationals traveling from these countries. In addition, after further review of our national security protocols, Chad, North Korea, and Venezuela have been added to the original five countries and will also face enhanced restrictions.

Barletta released the following statement:

“We are a compassionate nation, one built on legal and orderly immigration, and one which has always offered a place for people seeking better lives. However, our enemies continuously seek to use our generosity against us, and the president has a duty to protect the American people first. We know that ISIS has expressed their intent to use our refugee program to sneak their fighters and sympathizers into our country because our security measures are lacking. We cannot allow this.

“It is also important to recognize that citizens of foreign nations simply do not have the right to unfettered admission to the United States. In hearings before the House Homeland Security Committee under both the Obama and Trump administrations, numerous national security experts and professionals have stated that we simply cannot accurately screen all foreign nationals because we have no information from their home countries to verify their identities. In many cases, we have no idea who is trying to enter our country. I fully support President Trump’s actions to keep America safe, which I believe are only prudent as we work on a system that allows us to verify the identity and background of applicants.”

President Trump said in a press release announcing the restrictions:

“Our government's first duty is to its people, to our citizens -- to serve their needs, to ensure their safety, to preserve their rights, and to defend their values.”

USDA’s National Veterinary Services Laboratories (NVSL) has confirmed the full subtype for the highly pathogenic H7 avian influenza reported in Lincoln County, TN. The virus has been identified as North American wild bird lineage H7N9 HPAI based upon full genome sequence analysis of the samples at the NVSL. All eight gene segments of the virus are North American wild bird lineage. This is NOT the same as the China H7N9 virus that has impacted poultry and infected humans in Asia. While the subtype is the same as the China H7N9 lineage that emerged in 2013, this is a different virus and is genetically distinct from the China H7N9 lineage.

In November of 2016, the U.S Environmental Protection Agency (EPA) began requesting information from oil and gas producers regarding methane emissions from existing production well and facility sites. Though the surveys were requested by the EPA, costly fines would have been assessed on individual oil and gas operators for non-compliance. The EPA has withdrawn this request.

U.S. Congressman Mac Thornberry (R-Clarendon) applauded the executive order signed by President Trump to rewrite the Obama-era regulation related to “Waters of the U.S.” (WOTUS) and has introduced legislation to solve the problem permanently. Thornberry’s bill, the “Federal Regulatory Certainty for Water Act,” H.R. 1261, clarifies the definition of “navigable waters” in the Clean Water Act (CWA) as waters that are navigable-in-fact or are permanently flowing bodies of water that physically connect to navigable waters.

Congressman Pat Tiberi (R-OH) and Congressman Richard E. Neal (D-MA) introduced legislation that clarifies the appropriate application of the Section 199 domestic manufacturing deduction (DMD) to contract manufacturing. Under current Treasury Department regulations, the DMD is unevenly applied to U.S. companies who utilize contract manufacturing arrangements, which is contrary to Congress’s original intent to incentivize American manufacturing. Tiberi and Neal’s legislation would level the playing field for non-vertically integrated manufacturers who employ U.S. workers so that they can spur needed investment and create jobs.

Vicky Hartzler (R-Mo.), Chairwoman of the House Armed Services Oversight and Investigations Subcommittee, on Tuesday sent a letter to President Trump urging prompt clarification of his memorandum implementing a federal hiring freeze as it pertains to Department of Defense (DOD) civilian personnel and support for complete staffing of DOD contracting personnel.

Upon returning to the nation’s capital, Congressman Denny Heck (WA-10) added his support to three bills that prevent President Trump’s harmful executive order from being administered by the United States government.

If passed, the Statue of Liberty Values Act (SOLVe Act) would prevent the executive order from having any force of law and prohibit any federal funds or fees from being used to carry it out. The Freedom of Religion Act states that the United States could not bar foreigners from coming to the United States on the basis of their religious beliefs. The No Religious Registration Act would stop the government from creating or using a database of religious affiliation for the purpose of surveillance or of classifying U.S. citizens, lawful permanent residents, and visa seekers.

The U.S. House of Representatives passed Congresswoman Jaime Herrera Beutler’s bipartisan bill to permanently extend a decades old fishery management agreement that has been vital to Washington state’s Dungeness crab fishery. The bill passed overwhelmingly by a vote of 388-0.

Congressmen Jody Hice (GA-10) and Steve Scalise (LA-01) introduced H.R. 781, the Free Speech Fairness Act, which would amend the U.S. tax code to restore free speech for 501(c)(3) organizations including churches, nonprofits, and educational institutions, so long as they are (1) made in the ordinary course of the organization’s regular and customary activities in carrying out its tax-exempt purpose, and (2) any expenditure related to this are de minimis. A companion bill, S.264, was introduced by Senator James Lankford (R-OK) in the Senate.

The House passed H.J.Res. 40, a resolution to disapprove of the Social Security Administration’s (SSA) rule to share information with the National Instant Criminal Background Check System (NICS) on individuals who receive Disability Insurance benefits. Following passage of the resolution, Congressman French Hill (R-AR, 2nd) released the following statement:

“Having a disability and seeking help through the federal government should not be a factor in considering whether or not someone is mentally capable of owning or purchasing a firearm. U.S. Representative Richard Hudson (NC-08), author of bipartisan legislation that passed the House with a veto-proof majority and aimed to strengthen vetting of Syrian and Iraqi refugees, released the following statement on President Trump's exceutive order on refugees:

"At a time of grave security threats, President Trump is right to pause the flow of refugees from countries where terrorism is rampant until we can properly vet them and implement additional screening for individuals traveling to and from these countries. The facts are President Obama's own intel official told us ISIS is trying to infiltrate the refugee program and his Homeland Security Secretary and FBI Director told us we can't properly vet all of these refugees. I do have concerns that the executive order has caused confusion for those with green cards and will work with my colleagues and the administration to clarify it."

Water, Power, and Oceans Subcommittee Ranking Member Jared Huffman (D-CA) and House Natural Resources Committee Ranking Member Raúl M. Grijalva (D-AZ) sent a letter to President Trump today urging him to rescind the “one in, two out” executive order on federal rules issued earlier this week and an earlier memorandum instituting a regulatory freeze. These two actions have the combined effect of preventing the National Marine Fisheries Service (NMFS) from opening or closing commercial and recreational fishing seasons in federal waters; making in-season adjustments to conservation and management measures; or implementing new or revised fishery management plans without first seeking a waiver from the Trump administration.
