  • Bill Withers passed away on April 4, 2020. He was best known for his song, "Lean on Me".



  • In a press conference at the White House with the Coronavirus Task Force, Donald Trump was asked why he did not declare a national emergency and enact a national lockdown. Donald Trump answered the reporter saying, "Because we have what is called a United States Constitution, and I respect that very much." He went on to explain that every state has different needs, so it is better that each governor act in a way that best benefits his or her own state. He has issued national guidelines for each state to follow. That should be enough.

BOP must prioritize the health and safety of correctional staff and incarcerated individuals by taking necessary steps to mitigate the chance of an outbreak of the virus at all BOP facilities, be prepared to provide immediate and comprehensive care to our incarcerated population when COVID-19 is detected at one of our prisons or jails, and prevent transmission between BOP facilities.

    Don’t Use Taxpayer Dollars To Buy Private Companies

    ALEC Action is strongly opposed to provisions in the recently signed $2 trillion economic aid package that give the United States government part ownership in airline companies. Private sector options must be exhausted before any government involvement is considered, and a government loan to airline carriers would have been far less damaging than the federal grants in the signed proposal. The federal government should never spend taxpayer dollars to acquire ownership in private companies. The structure of government assistance should not require governmental ownership of private companies, nor should it impose regulations that interfere with a company’s ability to conduct business and pay back taxpayer dollars.

    Warren Urges FDA to Address Shortages of Drugs Prematurely Touted by President Trump as COVID-19 Treatments

    Though scientists have begun testing hydroxychloroquine and chloroquine as candidates for potential COVID-19 treatments and the FDA issued an Emergency Use Authorization for the prescription of the drugs in certain circumstances, public health experts have cautioned against their wide distribution. Despite these warnings, President Trump continues to use his platform to tout unproven treatments, resulting in inappropriate prescribing, at least one death, and reported shortages of the drugs.     The Office of the Director of National Intelligence released two reports tallying drone strikes under the Obama Administration. The first reported that there were 473 strikes between January 20, 2009, and December 31, 2015, in “areas of active hostilities” that included Afghanistan, Iraq, and Syria.     Peters Provision Allowing Airports to Discontinue PFAS To Be Signed Into Law

    EPA Refuses to "Settle" in Further Lawsuits

    Washington, D.C. - October 18, 2017 (The Ponder News) -- The Environmental Protection Agency (EPA) announced they will enact the position outlined in Congressman Jason Smith’s taxpayer protection legislation that passed the U.S. House of Representatives in September. The policy would prevent radical liberal groups from taking Missourians’ tax dollars and imposing burdensome government regulations.

    “There was a massive loophole called ‘sue and settle’ that has been hurting Missourians for years, and I’m glad the EPA has joined me in stopping this harmful practice,” said Congressman Smith.

    The wasteful “sue and settle” process occurs when a federal agency accepts a lawsuit from an outside advocacy organization and then, rather than defend itself, the agency settles the lawsuit out of court in a closed-door agreement.

    “Sue and settle” agreements usually involve the U.S. taxpayer paying attorney fees for the radical organization. Between 2009 and 2012, these lawsuits resulted in more than 100 new regulations and tens of millions of tax dollars spent on compliance costs.

    Under the Obama Administration, there were almost twice as many settlements as there were during both President Bush and President Clinton’s Administrations combined.

    In his announcement, EPA Administrator Scott Pruitt said, “The days of regulation through litigation are over. We will no longer go behind closed doors and use consent decrees and settlement agreements to resolve lawsuits filed against the Agency by special interest groups where doing so would circumvent the regulatory process set forth by Congress. Additionally, gone are the days of routinely paying tens of thousands of dollars in attorney’s fees to these groups with which we swiftly settle.”

    Like Smith’s legislation, the EPA’s directive removes the incentive for outside groups to sue the federal government by barring the federal government from paying the attorney’s fees in any environmental law case arising under the Clean Air Act, the Clean Water Act, or the Endangered Species Act.

    Congressman Smith has a track record of success in fighting against the sue and settle practice. In March, Smith introduced the Stop Taxpayer Funded Settlements Act with seven cosponsors. This legislation was attached to the Interior Appropriations Bill and approved by a bipartisan majority. The bill passed on September 14, 2017.

    “It’s wrong for Washington to leave the ‘sue and settle’ loophole open and waste Missourians hard-earned money paying attorney fees for radical environmentalist groups and other radical, left wing organizations,” said Congressman Smith. “I’m proud that my legislation to fix this problem was passed by the U.S. House of Representatives and that the EPA is following suit with closing this harmful loophole.”

    The Plan will ensure that the construction of new power plants incorporates technology that will result in a significant reduction of carbon emissions. Upon being finalized, it was estimated that the Plan could result in a 32 percent reduction in carbon emission by 2030. Such a reduction in carbon emissions is critical to addressing the growing threat posed by climate change to our states and communities. Climate change is already a threat to life and property, as it drives rising temperatures, sea levels, and worsening impacts from severe weather events.

    “If it had gone into effect, the ‘Clean Power’ Plan rule to limit greenhouse gas emissions from coal and natural gas power plants would have been one of the most expensive regulations ever imposed, causing electric rates for consumers to go up and threatening the reliability of the electric grid.

    “We hope that in its court filing the EPA will propose to rescind the so-called Clean Power Plan in its entirety. Whether it should be replaced by a more modest regulation is something that can be discussed, and it is our understanding that this is what the EPA plans to do with an Advance Notice of Proposed Rulemaking.

    “The Supreme Court blocked implementation of the rule in February 2016. There is little doubt that the court would have eventually decided that the rule is illegal. Thus the EPA under Administrator Scott Pruitt is not only doing the right thing for the economy, but is also simply following the laws that govern regulatory activity.

    “Scrapping the ‘Clean Power’ Plan is a key part of President Trump’s de-regulatory agenda, which is designed to get the economy moving again. This rule and other greenhouse gas emissions rules are depressing investment and job growth in resource and manufacturing industries.”

    60 MEMBERS OF CONGRESS CALL ON EPA TO PROTECT AMERICANS FROM DEADLY PESTICIDES

    Washington, D.C. - September 1, 2017 (The Ponder News) -- 60 Members of Congress, led by Congressman John Conyers, Jr. (D-MI) and Congressman Earl Blumenauer (D-OR), today sent a letter to Administrator of the Environmental Protection Agency (EPA), Scott Pruitt, requesting information on the steps the EPA is taking to protect Americans, bees and other pollinators from harmful pesticides.

    The letter notes that last year, “EPA scientists concluded that the agency should ban chlorpyrifos, a commonly used pesticide, on farms across the country due to significant evidence of the harmful effects it has on farmworkers and young children.” Research shows that prenatal exposures to chlorpyrifos are associated with reduced IQ, loss of working memory, attention disorders and delayed motor development. In March, the Trump Administration reversed this decision and instead chose to keep this pesticide on the market. Chlorpyrifos was previously banned for household use in 2000.

    According to news reports, EPA Administrator Pruitt met with Dow CEO Andrew Liveris on March 9th, just 20 days before reversing the Administration’s decision on pesticides. The Members wrote,

    “Given the precedent this action has created at EPA, we are deeply concerned that your agency has adopted a new standard of pesticide review and will start making pesticide registration determinations based on recommendations from pesticide manufacturers instead of basing agency decisions on sound, independent science.”
    Congressman Conyers said,

    “The science is clear. These pesticides are a severe risk to Americans’ health and pose an equally concerning risk to our food supply. It appears that the EPA, an agency long tasked with protecting Americans’ food, air and water, has spent more time listening to chemical companies and industry interests rather than its own scientists and the American people.     Ending the EPA’s Billion Dollar Green Energy Rip-Off

    Washington, D.C. - August 8, 2017 (The Ponder News) -- In recent years, the Environmental Protection Agency has created its own power of the purse independent of Congress by negotiating broad settlements with alleged violators of environmental statutes that require them to pay for the president’s—not Congress’s—political priorities. The Volkswagen settlement is the most recent example. In order to mitigate penalties paid to the U.S. Treasury for its “defeat device” scandal, the car company agreed to spend $1.2 billion on electric vehicles, despite the fact that Congress had rejected President Obama’s request for $300 million for this same purpose. The Competitive Enterprise Institute’s latest report, Ending the EPA’s Billion Dollar Green Energy Rip-Off, provides the context and the solution for ending the agency’s political slush fund.

    In November of 2016, the U.S Environmental Protection Agency (EPA) began requesting information from oil and gas producers regarding methane emissions from existing production well and facility sites. Though the surveys were requested by the EPA, costly fines would have been assessed on individual oil and gas operators for non-compliance. The EPA has withdrawn this request.

    U.S. Congressman Mac Thornberry (R-Clarendon) applauded the executive order signed by President Trump to rewrite the Obama-era regulation related to “Waters of the U.S.” (WOTUS) and has introduced legislation to solve the problem permanently. Thornberry’s bill, the “Federal Regulatory Certainty for Water Act,” H.R. 1261, clarifies the definition of “navigable waters” in the Clean Water Act (CWA) as waters that are navigable-in-fact or are permanently flowing bodies of water that physically connect to navigable waters.

    Congressman Pat Tiberi (R-OH) and Congressman Richard E. Neal (D-MA) introduced legislation that clarifies the appropriate application of the Section 199 domestic manufacturing deduction (DMD) to contract manufacturing. Under current Treasury Department regulations, the DMD is unevenly applied to U.S. companies who utilize contract manufacturing arrangements, which is contrary to Congress’s original intent to incentivize American manufacturing. Tiberi and Neal’s legislation would level the playing field for non-vertically integrated manufacturers who employ U.S. workers so that they can spur needed investment and create jobs.

    Planned Parenthood, Foster Children, Law Enforcement, Copyright Office, Department of Education, Central America, Pre-Existing Conditions, OIRA, Postal Employees, regulations, Obamacare, ALS, EPA, and Medicare

    Legislation was passed on Thursday (February 16) that eliminates an Obama Administration rule prohibiting the redirecting of Title X funding away from Planned Parenthood to health care centers that don’t provide abortions. The bill, H.J. Res. 43, uses the Congressional Review Act to eliminate the ‘midnight rule’ from the Department of Health and Human Services (HHS) that was finalized just two days before the end of President Obama’s second term. That regulation blocks states from diverting Title X family planning grants away from Planned Parenthood to community health centers, county health departments, or other providers. Congresswoman Carolyn B. Maloney (NY-12), member of the Congressional Pro-Choice Caucus and steadfast pro-choice advocate, claimed it would restrict a woman’s access to abortion.

    Congresswoman Lawrence introduced H.R. 1069, “The Timely Mental Health for Foster Youth Act”, with five original cosponsors. This bill would require mental health screenings for all children entering foster care. The legislation calls for an initial mental health assessment to take place within 30 days of a child entering foster care with a comprehensive follow-up assessment if deemed necessary.

    After The Hill reported that the White House Transition Team has proposed a budget blueprint, which would eliminate the Office of Community Oriented Policing Services (COPS), Representative Sean Patrick Maloney joined local civic and law enforcement officials to call on President Donald Trump to keep his campaign promise to support our law enforcement community and refrain from eliminating the federal Community Oriented Policing Services (COPS) Office. In addition, Rep. Maloney wrote a letter to the President asking him to protect the program. The Department of Justice’s (DOJ) COPS program provides investments to allow state and local police departments to hire police officers, test new strategies, and acquire cutting-edge technology.

    The resolution states that efforts to fight corruption must remain at the center of U.S. policy in Central America, that the Mission to Support the Fight against Corruption and Impunity in Honduras (MACCIH) and the International Commission against Impunity in Guatemala (CICIG) are important contributions to these efforts, and that the governments of Honduras, Guatemala, and El Salvador should cooperate with MACCIH and CICIG and the Attorneys General of the region.

    Congressman Markwayne Mullin (OK-2) introduced H.J.Res. 59, a Congressional Review Act (CRA) joint resolution that blocks the Environmental Protection Agency’s (EPA) Accidental Release Prevention Requirements: Risk Management Programs under the Clean Air Act Rule (RMP rule).

    The Congressional Review Act, passed in 1996, allows Congress to vote to overturn any regulation during a period of 60 days after the regulation was created. Regulations created at the end of the Obama Administration are subject to be overturned, so long as it is within the 60-day “in-session” period of Congress.

    The Secondary Payer Advancement, Rationalization, and Clarification (SPARC) Act, replaces ambiguous and uncertain Part D MSP requirements with a simplified, commonsense approach that provides beneficiaries with improved access to the care. The legislation also allows Part D Prescription Drug Plans to recover prescription drug cost deficits more quickly from primary payers.

    The House passed H.J. Res. 40, Providing for Congressional disapproval of the rule submitted by the Social Security Administration relating to Implementation of the NICS Improvement Amendments Act.

    In December of 2016, the Social Security Administration (SSA) published a rule that finalizes the criteria for sending the names of certain beneficiaries to the National Instant Criminal Background Check System (NICS). An individual’s name can be sent to the NICS if they receive disability insurance based on having a mental condition, are between the age 18 and the age of full retirement, and if the SSA determines that the individual needs a representative payee to manage their benefits. Once an individual’s name is added to the NICS list, there is no adequate due process for these individuals to have their name removed. This Joint Resolution will repeal this rule, and prevent a serious breach of Second Amendment and due process rights.

Last year, Sgt. Brandon Ketchum, a veteran from Davenport, Iowa, was turned away from a VA facility after seeking psychiatric help. After being denied care, he tragically took his own life. Sgt. Ketchum’s tragic death reinforces the need for a change at the VA to ensure any veteran who is suffering from a mental health issue gets the treatment they need and deserve. Simply put, under the Sgt. Brandon Ketchum Never Again Act, if a veteran asks for mental health care from the VA, they will get it.
