830 Groups Urge Congress to Halt Broadband, Electricity and Water Shutoffs in Next COVID-19 Relief Bill

Washington, D.C. - April 17, 2020 - (The Ponder News) -- On Monday, 830 utility-justice, environmental, faith, digital-rights and civil-rights groups sent a letter to Congress calling for the next congressional COVID-19 relief package to include a moratorium on broadband, electricity and water shutoffs.

The letter also calls for stimulus funds to address the systemic issues that lead to shutoffs. These issues include racial and economic inequities that can be addressed with improved affordable broadband programs including Lifeline; distributed solar energy; and percentage-of-income water-affordability initiatives.

The coronavirus crisis has triggered unemployment to levels that are unprecedented in U.S. history, and this has disproportionately harmed low-income households and communities of color. These households are facing disconnections and unaffordable rates for utility services that are first lines of defense during this national health emergency.

Congress failed to include any utility-service protections in earlier coronavirus-relief packages despite vast public support for such measures. Today’s letter calls for a nationwide moratorium on all utility disconnections. The letter also advocates for reconnections for lost services and forgiveness of late fees and bill payments for economically distressed people. The letter, led by the Center for Biological Diversity, Food & Water Action, Free Press Action and Partnerships for Southern Equity, calls on Congress to extend these protections for six months after the emergency ends, allowing people to recover economically without the burden of debt.

“Unfortunately, millions of families each year are cut off from their utility services, and the coronavirus emergency exacerbates and highlights the urgency of these chronic issues,” the letter reads. “These utility services must be retained to ensure basic family survival and to fight the health pandemic at ground zero.”

“Right now, an affordable broadband connection can mean the difference between being employed or unemployed, healthy or sick, connected with the outside world or trapped in isolation,” said Dana Floberg, policy manager at Free Press Action. “As the pandemic forces people out of work, millions more people, especially low-income families and communities of color, will find themselves unable to pay for broadband. No one should lose access to lifesaving and necessary communications tools during this crisis. Congress must act swiftly. We must end the shutoffs that leave vulnerable families digitally stranded and fund the emergency broadband-connectivity programs to get and keep impacted communities online.”

“It’s unconscionable that Senate Republicans chose to protect corporate America over families in the last rescue package,” said Jean Su, director of the Center for Biological Diversity’s energy justice program. “Families are facing impossible choices between paying for food or electricity, water or health care. Congress should ensure that all utilities are kept on and should invest in long-term solutions like community solar that aren’t dependent on dirty corporate-utility power that can be cut off in a crisis.”

“Our nation is in crisis and we are once again woefully underprepared to address the systemic injustices exacerbated by this pandemic head on,” said Chandra Farley, just energy director at the Partnership for Southern Equity. “Low-income households, particularly Black and Latino households that already spend a larger portion of their income on home-energy costs, need a national moratorium on utility shutoffs now. As bills continue to rise due to utility-rate hikes and expensive, dirty-energy infrastructure, Congress should invest in the economic engine of energy efficiency and pollution-free, clean energy that we know can lower utility bills and improve the overall health of historically marginalized communities.”

“There is absolutely no excuse left for Congress to exclude basic human needs from the next coronavirus stimulus package, or in general,” said Rianna Eckel, senior national water organizer at Food & Water Action. “People are facing the reality of living through a summer without running water right now. We need national action to protect every single person in this country from inhumane utility shutoffs, nothing less.”

Berry said, “I appreciate the Commission’s focus on ensuring every American has access to robust mobile broadband services and for a dedicated $9 billion for mobile service in rural America; however, I am extremely discouraged by the two options the Commission has proposed. The draft proposal sets up a false choice between, on the one hand, updating the FCC’s maps in line with the recently-enacted Broadband DATA Act but delaying funding for several years, and, on the other hand, moving forward using the flawed coverage data, simply for the sake of moving forward quickly. But these are plainly not the only options, nor the best options; there is no reason why the FCC cannot follow the law that Congress mandated and distribute needed funding in a timely manner, with accurate data. We should not be limiting ourselves to two inadequate options, but rather looking for real solutions to deploy mobile broadband as quickly as possible.”

The Disability Law Center (DLC) has taken several steps this week to advocate for Utahns with disabilities amid the COVID-19 pandemic. First, the DLC filed a complaint with the Department of Health and Human Services Office for Civil Rights (OCR) regarding the State’s Crisis Standards of Care on behalf of the agency and an individual who could be impacted, Jacob Hansen, an individual with cerebral palsy and cystic fibrosis. The guidelines’ Patient Prioritization Tool and Adult Triage Guidelines explicitly and implicitly deprioritize people with disabilities for care in violation of the Americans with Disabilities Act (ADA), Section 504 of the Rehabilitation Act (Section 504), and Section 1557 of the Affordable Care Act (ACA).

Boozman Applauds USDA Broadband Investment in Arkansas

Washington, D.C. - January 24, 2020 - (The Ponder News) -- U.S. Senator John Boozman (R-AR) applauded the United States Department of Agriculture’s (USDA) $7.1 million broadband investment in rural Arkansas. The grant will support two high-speed broadband infrastructure projects to improve rural broadband for 1,250 homes in Baxter, Marion and Stone counties.

“Improving broadband in rural Arkansas is critical to helping families, businesses and communities stay connected in today’s world. As a rural state, there are more challenges to providing Arkansans access to the minimum speed of wired broadband that experts agree is functional: 25 megabits per second. The ReConnect Program is an important tool that allows USDA to close the digital divide and improve broadband access in rural America,” Boozman said.

USDA announced it awarded grant funds to the Yelcot Telephone Company and the Mountain View Telephone Company.

Last year, Boozman expressed his support for USDA’s Reconnect Programin a Senate Agriculture, Nutrition, and Forestry Committee hearing with USDA Secretary Sonny Perdue. Boozman, a member of the Senate Appropriations Committee, helped secure funding for the ReConnect program. He is a co-chair of the Senate Broadband Caucus, a bipartisan group aimed at closing the digital divide.

The U.S. Department of Agriculture (USDA) is now accepting online applications for funding through the new ReConnect Rural Broadband Pilot Program. These funds will enable the federal government to partner with the private sector and rural communities to build modern broadband infrastructure in areas with insufficient internet service. Insufficient service is defined as connection speeds of less than 10 megabits per second download and 1 megabit per second upload.

Terri Sewell (AL-07) and Adrian Smith (NE-03) have introduced the Revitalizing Underdeveloped Rural Areas and Lands (RURAL) Act, legislation that would help preserve jobs and encourage infrastructure development by expanding tax-exempt cooperative organizations’ access to government grants and assistance, including rural broadband grants and FEMA disaster relief.

“Our rural communities depend on reliable infrastructure, access to broadband and secure energy sources for their local economies to thrive,” Rep. Terri Sewell said. “Alabama’s rural electric co-ops provide essential broadband services in rural areas where high-speed internet is limited but essential to those areas’ economic growth. We must do more to provide high-speed internet – and the opportunities and resources that it brings – to the 22.4 million Americans living in rural parts of our country without quality internet access. The RURAL Act would ensure that these co-ops can retain their tax-exempt status when applying for grants to expand rural broadband or disaster assistance and provide these co-ops with the ability to secure the grants needed to continue to grow their renewable energy, economic development and energy efficiency initiatives.”

“Nebraska has a long tradition of relying on public and cooperative power generation to affordably meet the needs of families, farmers, ranchers, and small businesses,” Rep. Adrian Smith said. “While continuing to ensure rural electric co-ops are largely funded by their membership as a condition of their tax-exempt status, we should also ensure funds received from grants or for pole usage do not affect their tax status. Just as rural power generation and transmission were vital to rural economic growth in the 20th century, access to both power and broadband will drive our rural economies in the 21st.”

“Rural Electric Cooperatives have historically received grants from various sources to assist in providing services to their members such as renewable energy development, energy efficiency and conservation and more recently helping to deploy vital broadband service to rural Alabama communities. Recent changes in the Revenue Code create an unintended consequence for cooperatives that may jeopardize their tax-exempt status,” said Alabama Rural Electric Association President and CEO Fred Braswell. “Representative Sewell understands the importance of this to rural Alabama and its citizens. We thank her for continuing to fight for programs to help the rural cooperatives and the areas we serve.”

“Crucial community infrastructure projects in central Alabama have materialized because Central Alabama Electric Cooperative (CAEC) has successfully obtained grants. Over the years these federal, state and local allocations have funded a rural wastewater system and new entry roads in county business parks. Congresswoman Terri Sewell has introduced the RURAL Act, which offers protection to electric cooperatives and other nonprofit organizations by allowing them to maintain certain tax exemptions. Without their not-for-profit status, electric cooperatives’ ability to pursue grants will be hampered by having to include additional costs in rates,” said Central Alabama Electric Cooperative President and CEO Tom Stackhouse. “Thank you, Congresswoman Sewell, for your leadership and diligence in sponsoring the RURAL Act. Continued protection will be essential for CAEC as we embark on our rural broadband project this year.”

“As an electric cooperative that was severely impacted by Hurricane Michael in October 2018, HR 2174 will allow PowerSouth Energy Cooperative’s members to utilize FEMA grants without fear of losing our non-for-profit status,” said PowerSouth Energy Cooperative Vice President of External Affairs Horace Horn. “We are grateful for Rep. Sewell’s sponsorship of this legislation and look forward to working with her on this issue.”

The RURAL Act would amend the Internal Revenue Code to ensure tax-exempt cooperative organizations do not lose their tax-exempt status when they apply for and use certain government grants, contributions and assistance, including rural broadband grants and FEMA disaster relief.

A Senate companion measure was introduced by Sens. Rob Portman (R-OH) and Tina Smith (D-MN).

I don't know about you, but I am getting tired of calls about extended warranties, knee braces and health insurance. Especially Obamacare. You would think that after being told 10 times, pushing the button 10 times and hung up on more times than I count, they would quit calling. It's annoying. I don't buy anything from anyone who annoys me. And, I don't give my information over the phone unless I know beyond a shadow of a doubt who I am talking to and what the information is being used for.

The Digital Equity Act of 2019 creates new federal investments targeted toward a diverse array of projects at the state and local level that promote “digital equity”— a concept defined by the National Digital Inclusion Alliance as the “condition in which all individuals and communities have the information technology capacity needed for full participation in our society, democracy and economy.” The legislation was cosponsored by Senators Mazie Hirono (D-HI), Angus King (I-ME), Sheldon Whitehouse (D-RI), Amy Klobuchar (D-MN), Richard Blumenthal (D-CT), Tina Smith (D-MN), Chris Van Hollen (D-MD), Gary Peters (D-MI), and Jack Reed (D-RI) and a companion bill will also be introduced in the House of Representatives.

According to the Pew Research Center, nearly one in five teenagers in the U.S. say they have been unable to complete homework assignments due to lack of a reliable internet connection. The digital divide, also sometimes referred to as the “homework gap” as it applies to students, exacerbates existing wealth and income gaps in our communities; subsequently, many people—including those from communities of color, people with disabilities, low-income households, and rural communities, overwhelmingly impacted by the digital skills gap—are at risk of being left behind in an increasingly technology-driven world, absent intervention. To that end, the Digital Equity Act of 2019 strengthens federal support for efforts to help ensure students, families, and workers have the information technology capacity needed to fully participate in society by creating an annual $125 million formula grant program for all 50 States, the District of Columbia, and Puerto Rico to fund the creation and implementation of comprehensive digital equity plans in each State, as well as an additional annual $125 million competitive grant program to support digital equity projects undertaken by individual groups, coalitions, or communities of interest. Finally, the legislation tasks the National Telecommunications and Information Administration (NTIA) with evaluating digital equity projects and providing policymakers at the local, state, and federal levels with detailed information about which projects are most effective.

“I believe the future belongs to the connected. No matter who you are or where you live in this country, you need access to modern communications to have a fair shot at 21st century success. But today millions of American lack the broadband access that they need to meaningfully participate in the digital age. That means too many students fall into the Homework Gap, unable to complete school assignments that require high-speed internet service. It means that too many small businesses will not have the work force with the skills necessary to compete in the global economy. It means that too many communities will go without the civic and commercial infrastructure that is needed to thrive and grow. So thank you to Senator Murray for this legislation which thoughtfully addresses digital equity and seeks to expand technology opportunity for all,” said Federal Communications Commissioner Jessica Rosenworcel.

“Local and state leadership drive most efforts to bring people online with affordable Internet access and training. On the one hand, this is fabulous because trusted community relationships are essential to effective digital inclusion work. Trump Signs EO to Expand Broadband to Rural Communities



Washington, D.C. - January 10, 2017 - (The Ponder News) -- After speaking at the Farmer's Convention on Monday, the President signed an executive order to expand broadband to rural communities. This executive order directs federal agencies to remove obstacles to broadband deployment and reduce barriers to investment in broadband infrastructure. Specifically, the executive order directs agencies to evaluate the effectiveness of the application process to build out broadband infrastructure on federal property and ultimately streamline and expedite the review of these requests.

Focus on Farmers



President Trump gave a speech on Monday at the American Farm Bureau Federation convention in Nashville. The main-stream media wanted to focus on just one thing he said, (I'm sure you have all seen it on the news, about flags and the national anthem). They refused to focus on all the other stuff he said, even though the speech was nearly 40 minutes in length. What he said about the flag and the National Anthem only occurred ONCE, in a 5 second comment. That is why I refuse to give credence to the news on television. Here at The Ponder, I think it is right that we show you what you miss by watching the news on TV, and not getting your information from the sources on the internet.

After the speech, Trump signed an executive order to expand broadband to rural communities.

Farmers also talked to me about the importance of supporting rural communities in their efforts to address the opioid epidemic and supporting rural economies by developing rural broadband. “I had a good meeting with the President at the White House last week. We talked about agriculture, not only trade but the importance of a strong farm bill. Right up front, I emphasized crop insurance, so I was very pleased that the President expressed his strong support for crop insurance today during his speech to the American Farm Bureau, because it’s very important to our producers.

“The President today highlighted the importance of investing in rural America and making our communities stronger and more vibrant. He outlined the benefits of our work to provide tax and regulatory relief that enables our farmers and ranchers to grow and invest in their operations. We’ve worked hard to roll back burdensome regulations, like the Waters of the U.S. rule, which have hampered economic growth.

Washington, D.C. - January 9, 2017 - (The Ponder News) -- After his speech at the Farmer's Convention in Nashville on Monday, President Trump signed an executive order to expand broadband internet to rural communities.

“President Trump’s focus on expanding broadband to rural areas is good news for Missouri farmers, ranchers, and, most importantly, families,” Senator Roy Blunt - (R - MO) said. “Today, an estimated 61 percent of rural Missourians lack access to broadband. By ending the digital divide, we will help our agriculture industry thrive and meet world food demand. We will provide students and teachers access to new learning tools and educational opportunities. We will enable small businesses to compete in a global economy. And, we will expand access to quality healthcare through telemedicine. As a member of the Senate Commerce Committee, I’ll continue working with the administration and my Senate colleagues to bring high-speed internet to every community in Missouri.”

SPEED Act for more Available Broadband introduced in the Senate

Washington, D.C. - October 23, 2017 - (The Ponder News) -- U.S. Senators Catherine Cortez Masto (D-Nev.) and Roger Wicker (R-Miss.) introduced today the “Streamlining Permitting to Enable Efficient Deployment of Broadband Infrastructure Act of 2017” (SPEED Act). The measure would accelerate the deployment of new broadband infrastructure to both rural and urban areas by streamlining the permitting process for telecommunications equipment that is installed in locations that have already been subjected to historical or environmental reviews.

“I am proud to co-sponsor the SPEED Act because it would reduce the barriers to the development of new communications infrastructure in urban and rural communities,” said Senator Cortez Masto. “We live in an age when nearly every routine task necessitates internet access, including completing homework assignments, applying for a job, and searching for a doctor. And specifically for our rural communities, we need improved services to eliminate gaps in public safety, expand access to tele-health services, and enable more small businesses to connect with their customers. More widespread communications infrastructure will enable these benefits for Nevadans, and the rest of the country.”

“This sensible legislation would help fast-track the deployment of next-generation broadband technologies by utilizing existing public right of ways and exempting communications providers from duplicative reviews,” Senator Wicker said. “New advances in telehealth, online education, precision agriculture, and other internet applications demand faster, better broadband connections. It is time for the federal government to recognize the realities of a modern digital economy and accommodate the needs of American consumers.”

Specifically, the SPEED Act would streamline federal permitting processes that impede the quick and efficient deployment of next-generation broadband technologies, including 5G. Currently, new and replacement telecommunications infrastructure is subject to numerous, sometimes duplicative federal approvals, including environmental and historical reviews. These duplicative approvals extend to areas that have already been established as a public right-of-way (ROW), and where telecommunications infrastructure already exists.

The SPEED Act would not preempt the authority of a State or local government to apply and enforce all applicable zoning and other land use regulations on communications providers.

The SPEED Act would expedite the review process for telecommunications infrastructure and accelerate the delivery of essential broadband services by:

<li>Exempting telecommunications infrastructure from environmental and historical reviews by the Federal Communications Commission (FCC) and other federal agencies in a public ROW if previously installed telecommunications infrastructure has already undergone environmental and historic reviews for the same public ROW. Any provider exempted from these reviews must still comply with the National Environmental Policy Act and the National Historic Preservation Act;
<li>Exempting the deployment of small cells from environmental and historical reviews only if 1) they are being deployed in a public ROW and are not higher than an existing structure in the public ROW; and 2) they are serving as a replacement for an existing small cell and they are the same or substantially similar to the small cell that is being replaced;
<li>Exempting the deployment of wireless services (e.g. voice, video, or data) from environmental and historical reviews if 1) they are located in an existing public ROW and 2) adhere to tower height and guy wire requirements;
<li>Directing the Government Accountability Office to develop a report analyzing how to increase the efficiency of deploying broadband infrastructure to federal lands; and;
<li>Directing the FCC’s Streamlining Federal Siting Working Group to submit a report to Congress on its preliminary findings and recommendations for accelerating the deployment of high-speed Internet access to federal lands across the United States.

Pallone Introduces Viewer Protection Act

Washington, D.C. - July 20, 2017 (The Ponder News) --Energy and Commerce Ranking Member Frank Pallone, Jr. (D-NJ) introduced the Viewer Protection Act, (H.R. __), which would establish a Viewer Protection Fund to fully protect broadcast viewers and expeditiously get new mobile broadband spectrum into the hands of consumers. The bill would do that by ensuring enough funds exist to cover costs related to the Federal Communications Commission (FCC)’s Incentive Auction repack. Introduction of the bill comes after the FCC’s Incentive Auction Task Force announced last week that broadcasters have requested $2.1 billion – significantly more than the $1.75 billion set aside – to cover costs related to the auction.

“The FCC’s incentive auction was the second largest auction in history, and the result of years of successful work. But with an anticipated shortfall of more than a quarter billion dollars for repacking, it’s time for Congress to step in to make sure that no viewers lose their signal,” said Pallone. “I understand how important it is to have access to local news and information—especially during an emergency. That’s why the Viewer Protection Act provides additional funding and ensures consumers will understand the coming changes, so that no consumer will be left in the dark when stations change channels. At the same time, our bill will ensure consumers of mobile broadband reap the benefits of the incentive auction as soon as possible.”

American Cable Association President and CEO Matthew M. Polka issued the following statement regarding introduction of the Viewer Protection Act by House Energy and Commerce Committee Ranking Member Frank Pallone, Jr. (D-NJ):

"ACA is pleased that this bill introduced by Rep. Pallone makes more money available to the Federal Communications Commission, if needed, to prevent consumers from losing access to broadcast channels as a result of the incentive auction. ACA is particularly appreciative that the additional funds would be accessible to cable operators too so these providers have the financial support they need to continue offering the broadcast channels to their customers without interruption."
