Serrano Introduces Legislation to Require Public Inspectors’ Evaluation of Local Transportation Projects




Washington, D.C. - February 8, 2019 - (The Ponder News) -- Congressman Jose E. Serrano (D-NY, 15th) has introduced legislation to guarantee that local transportation projects are evaluated by public inspectors rather than private companies. The Safety, Efficiency, and Accountability in Transportation Projects Through Public Inspection Act of 2019 would require public employees who are members of the community to perform inspections and other related essential public functions on all state and local transportation projects. The bill is intended to promote public safety, prevent the waste of transportation funds, and guarantee that projects are delivered in a timely manner. This legislation seeks to ensure that the public has someone who is working on their behalf, rather than companies who are more concerned about their bottom line. The bill is being cosponsored by Congresswoman Yvette Clarke, Congresswoman Jenniffer González-Colón, Congresswoman Nydia Velázquez, Congresswoman Sheila Jackson Lee, Congressman André Carson, and Congressman Stephen Lynch.

“This legislation is necessary to ensure the public’s safety in the construction of local transportation projects. Community residents and the public, in general, need a representative to make sure that private transportation construction contractors are acting in a safe, responsible manner. Using private companies to oversee the work of other private companies creates potential conflicts of interest that undermine worker and public safety, increase costs, and delay project completion. This bill prevents these problems by requiring a government employee to oversee all state and local transportation projects to ensure safety and accountability,” said Congressman Serrano.

Congressman Cleaver Applauds Passage of Water Infrastructure Bill


Washington, D.C. - October 15, 2018 - (The Ponder News) -- Congressman Emanuel Cleaver II (D-MO, 5th) applauds the congressional passage of S.3021, America’s Water Infrastructure Act, commonly referred to as WRDA. This bill would give the Army Corps of Engineers the authorization to begin navigation, flood control, storm damage and other water infrastructure projects across the country. The U.S. House of Representatives passed its version of the bill, H.R. 8, by a vote of 408-2 on June 6, 2018. House and Senate committee leaders negotiated a compromise bill, which became S. 3021. Now the bill will go to the President for his signature.

“This is an effort that spans several years in the making. I’ve worked with my Republican colleagues to make sure that language was included to ensure smooth coordination of the two major parts of our local Kansas City Levees project. I’m glad we could work together to support this project and make sure several Kansas City areas are protected from flooding ,” said Congressman Cleaver.

The bi-partisan bill would include several important elements:

• Extend annual authorizations for dam and levee safety activities through fiscal 2023.

• Authorizes $110 million a year for watercraft inspections in the Columbia, Missouri, Colorado, South Platte, and Arizona river basins to prevent the spread of invasive aquatic species into those watersheds.

• Authorize $75 million to the Corps to conduct a 10-year pilot program to award single contracts for multiple hurricane and storm damage reduction projects in an area.

• Authorize $125 million to be used in each of fiscal 2020 and 2021 for state public water system supervision programs.

• Establishes a task force on stormwater infrastructure funding.

• Authorizes $225 million in Fiscal Year 2019 and in 2020 for grants to states for projects to prevent combined sewer overflows and address stormwater.

Congressman Cleaver has been an advocate for improving flood control projects in the Kansas City area under WRDA for many years. With recent appropriations and the WRDA bill, several flood control projects in the Kansas City area will have enough funding to be completed.

• Turkey Creek Basin is fully funded and expected completion is in 2020.

• Dodson Industrial District (Blue River Basin) is fully funded and will be completed in summer of 2020. This project will provide 500-year flood protection for 1,500 people and $380 Million in property for local businesses.

• Swope Park Industrial Area was fully funded this year and will be completed in 2022. The new bridge over the levee will provide safe passage for over 400 people who work in the area.

• Kansas City Levees was fully funded with the supplemental appropriations package earlier this year. This legislation would be the second WRDA measure to be enacted under the process established by the 2014 Water Resources Reform and Development Act.

In 1991, Congress designated I-73 as a high priority project. This morning, President Trump released his infrastructure framework that I believe will finally get this project off the ground. “Early this morning, members of Congress approved a 2 year budget package that funds government and provides critical disaster relief to the hurricane affected areas including the U.S. Virgin Islands. This funding comes after long protracted discussion and substantial negotiation in both the Senate and the House. Our office is grateful for the work that Senator Chuck Schumer (D-NY) engaged in on our behalf with Senator Mitch McConnell (R-KY) and the support of Governor Mapp and his team to make this happen.

“While the funding does not include the full amount or all of requests of the Virgin Islands it will help us substantially in the rebuilding efforts. We worked very hard to see that the Virgin Islands be provided with additional Medicaid funding for the territory’s urgent health needs. The islands are provided with $142 million in additional funds through September 2019, with a 100% federal match for these new funds. The measure also provides the Virgin Islands with five years of significant additional funding through a higher rate of rum excise tax revenue paid to the Virgin Islands treasury – at $13.25 per proof gallon (from $10.50).

Congresswoman Plaskett cautions the Virgin Islands government and its people that this advancement in our rebuilding needs to be taken in context with last month’s Tax Cuts and Jobs Act Bill. “We must be aware that the new tax laws are likely to have the unintended consequence of providing a disincentive to companies operating in the Virgin Islands due to foreign tax treatment. Additionally, there will be lost revenue to the General Fund due to reduction in individual tax brackets, along with the lack of reimbursement to the Earned Income Tax Credit and the Child Tax Credit. Tax experts predict that those losses can range from a hundred million to hundreds of millions of dollars each tax year.”

“The bipartisan budget agreement reached by Senate leaders this week is a long-awaited step to address a number of outstanding funding priorities. It fulfills the fundamental obligation of Congress to keep the government open and paves the way for the delayed passage of our twelve appropriations bills. For too long, Congress has lurched from crisis to crisis, passing short-term spending patches but failing to address the sequestration-level spending caps that hobble economic investments, threaten our national security, and make realistic budgeting impossible.

In addition to making dollar for dollar increases in the defense and non-defense budgets above sequestration levels, this agreement contains much-needed relief for millions of families still recovering from natural disasters—including $125 million for ongoing Hurricane Matthew recovery efforts in North Carolina. It also reaffirms our commitment to fight the opioid crisis, secures billions to improve our nation’s infrastructure, and makes critical investments in our nation’s veterans, healthcare, and education programs.

Unfortunately, Republican leadership in the House has done nothing to advance bipartisan legislation to protect the hundreds of thousands of Dreamers facing uncertainty thanks to President Trump. His decision to rescind the DACA program, and then blow up the bipartisan proposal to fix the problem that he created, forced Dreamers squarely in the middle of the shutdown battle. What’s worse, the President has yet to learn his lesson, just this week calling for another government shutdown to advance his mass-deportation agenda.

My colleagues in the Senate have received assurances by Majority Leader McConnell of an imminent vote that includes DACA, but Speaker Ryan has continued to cater to the extreme wings of his caucus, lacking the political courage to put legislation on the floor. His promise to only put a bill on the floor that President Trump publicly supports is particularly disgraceful. No Speaker should yield our legislative prerogative to the President, particularly this President on this issue. Without assurances in the House similar to those given in the Senate, I cannot vote to support this budget package and let Republican leadership once again kowtow to a President who believes his power cannot be checked.”

    Portman has led efforts in Washington to streamline the federal permitting process. Recently, the Trump administration has begun to use the tools authorized by Portman’s Federal Permitting Improvement Act, which helps streamline the federal infrastructure permitting process to boost our economy and create jobs. The bill was enacted into law last Congress as Title 41 of the Fixing America’s Surface Transportation Act (FAST-41). Two weeks ago, the Trump Administration and the state of Louisiana entered into the first memorandum of understanding between the federal government and a state to facilitate the infrastructure permitting process for a project covered by this new law. FAST-41 requires that one agency serve as the lead agency for covered projects; all agencies involved in covered projects develop a coordinated permitting timeline at the start of the process; and agencies post the permitting timeline and updates to it on an online Permitting Dashboard throughout the permitting process for each covered project. Last September, Portman chaired a Permanent Subcommittee on Investigations (PSI) hearing on how permitting reform, like FAST-41, will create good-paying jobs across the country.

    “Throughout his campaign and his first year in office, President Trump made countless promises to put forward a bold plan to put Americans to work repairing and modernizing our crumbling public infrastructure.     On Trump Administration Proposed USDA Budget

    Rural America deserves a better budget. By cutting essential programs for rural businesses, housing, and more, this proposal severely weakens USDA Rural Development’s ability to support rural communities. I also have many questions about the Administration's alarming SNAP proposal, which would terminate SNAP nutrition education and make it harder for recipients to access a wide variety of healthy foods.

    I am concerned by how farmers would fare under the proposed budget due to the reductions in funding for important conservation programs and farm loans. And while I am glad to see a funding increase for the National Organic Program to improve enforcement of the organic label, I’m troubled by the way this budget simultaneously suggests cutting other programs that support two of the fastest-growing agricultural markets—organic and local food.

    In so many ways, this proposed budget for USDA—with its nearly 25 percent cut to discretionary programs—looks much like the damaging plan that the Administration put forth last year. Thankfully, the House Appropriations Committee worked in a bipartisan way to restore much of that funding in legislation it passed through the Committee last year, and I am optimistic we can do so again.

    "While I support trade policies that strengthen American manufacturing and will put this nation on a fair playing field internationally, I am disappointed in the overly harsh ruling of Section 201 tariff remedies against imports of residential washing machines. Along with Secretary Ross, I attended the groundbreaking of LG Electronics’ $250 million home appliance manufacturing facility in Clarksville, TN last summer.     Rep. Payne, Jr., Responds to Trump Administration‘s Claim that No Deal Exists for Funding of the Gateway Project

    Newark, NJ - January 6, 2017 - (The Ponder News) -- Rep. Donald M. Payne, Jr., released the following statement after the Trump administration claimed the federal government never agreed to fund 50 percent of the Gateway Project, one of the nation’s most important multi-year, multi-billion-dollar infrastructure projects.

    “On December 29th, the Trump administration announced another petulant attack on the tri-state area,” said Rep. Donald M. Payne, Jr. (D-NJ-10). “For years, New Jersey, New York, Amtrak, and the federal government have cooperated to make the Gateway Project a reality. The Gateway Project is a multi-billion-dollar expansion and enhancement of the railroad that connects New Jersey and New York. The plan for Gateway's financing is centered on the principle of federal-state cooperation, but the Trump administration now says that the ‘50/50’ agreement is ‘non-existent.’ Trump has a long history of reneging on business deals, but the Gateway Project is not just another golf course. I am confident officials who led the Department of Transportation just one year ago will set the record straight.

    “This is not a partisan issue, and it should not be written off as merely a project of local concern. New Jersey Governor Chris Christie, a Republican, and New York Governor Andrew Cuomo, a Democrat, have come together in good faith to demonstrate that the states are ready and willing to put up billions of dollars to make Gateway a reality. The assets Gateway will restore and enhance are Amtrak properties: the bridges, the tunnels, the rails, all of it. I will remind the administration that Congress created Amtrak to maintain the nation’s passenger railroad infrastructure and service. The Gateway Project will create thousands of jobs, pump money into the economy, and increase rail capacity along Amtrak's Northeast Corridor.

    “I am disheartened by the Trump administration’s attack on our region, coming only days after enacting a tax bill that disproportionately hits homeowners in New Jersey. This one-two punch makes it glaringly apparent that this President has no interest in rebuilding America's infrastructure or putting Americans back to work.”

    Frelinghuysen to FTA: Gateway/Hudson Rail Tunnels are "national infrastructure priority"

    Washington, D.C. - January 5, 2017 - (The Ponder News) -- U.S. Congressman Rodney Frelinghuysen (NJ-11), Chairman of the House Committee on Appropriations, is writing to federal transit officials that the Gateway/Hudson River Tunnels projects are a “national infrastructure priority” that needs to be done.

    In a letter dated January 4, 2018 to FTA Deputy Administrator K. Jane Williams, Frelinghuysen wrote, “A project of this size and scope requires investment from all stakeholders and your vision too! I strongly encourage the Administration to support my state and New York in this effort.”

    “I believe it is unrealistic for the Administration to expect the most important infrastructure project in the country to move forward without full participation and investment from the Federal Transit Administration (FTA) and Department of Transportation (DOT).”

    Frelinghuysen’s letter was prompted by recent correspondence from Williams to New York state officials in which she denied the existence of a funding agreement for the first phase of the project.

    “It is …imperative we pursue Gateway to ensure millions of Americans continue to access this vital economic Northeast Corridor that enables safe transportation of more than 800,000 daily riders, from Washington to Boston, in an area that supports approximately 20 percent of the nation’s gross domestic product (GDP). Further, this rail project serves as a critical choke point for Amtrak’s entire operation on the East Coast from Florida to Maine.

    Frelinghuysen also reminded FTA Administrator Williams, “It is the responsibility of the House Committee on Appropriations to assure that such national priorities are met.”

    API WELCOMES BIPARTISAN EFFORT TO EXAMINE ATTACKS ON U.S. ENERGY INFRASTRUCTURE

    Washington, D.C. - October 24, 2017 (The Ponder News) -- API welcomed a bipartisan letter, led by Congressman Ken Buck, R-Colo., sent today by 84 members of Congress urging U.S. Attorney General Jeff Sessions to protect against the sabotage of oil and natural gas pipelines, such as the dangerous tactics taken by extremists in October 2016 to illegally shut off several cross border pipelines.

    “Safety is our industry’s core value, and any illegal or dangerous effort to undermine safety and bring harm to the environment and communities should be prosecuted to the fullest extent of the law,” said API Midstream and Industry Operations Group Director Robin Rorick. “We take these attacks very seriously, and we welcome the bipartisan efforts in Congress to strengthen our nation’s infrastructure that delivers the energy Americans demand every day.”

    The bipartisan Congressional letter reinforces API’s efforts to engage with the Administration, including the Department of Justice, the Federal Bureau of Investigation, the Pipeline and Hazardous Materials Safety Administration, and the Transportation Security Administration, on the need for effective deterrence against the willful disruption of and damage to pipeline infrastructure.

    “A key component of securing our nation’s energy infrastructure is ensuring that law enforcement has the tools needed to prosecute those who attack it,” Rorick said. “We appreciate this bipartisan effort and look forward to working with lawmakers and law enforcement in protecting our industry’s personnel, the environment and communities across the country.”

    Walorski, Blumenauer, Fitzpatrick, Maloney Introduce Move America Act to Boost Infrastructure Investment

    Washington, D.C. - October 3, 2017 (The Ponder News) -- U.S. Reps. Jackie Walorski (R-Ind.), Earl Blumenauer (D-Ore.), Brian Fitzpatrick (R-Pa.), and Sean Patrick Maloney (D-N.Y.) on Monday introduced the Move America Act (H.R. 3912) to strengthen public-private partnerships and boost investment in America’s infrastructure. Through expanded private activity bonds and infrastructure tax credits, this bipartisan legislation would attract billions of dollars in capital and give state and local governments greater flexibility to fund critical infrastructure projects.

    “A strong American economy depends on a modern infrastructure built for the 21st century,” Congresswoman Walorski said. “Public-private partnerships are among the most cost-effective ways to revitalize our aging infrastructure and invest in our nation’s future. The bipartisan Move America Act will give state and local governments the tools and flexibility they need to leverage private dollars for the infrastructure projects most important to our communities.”

    “American infrastructure is falling apart and we’re falling behind. It is critical that we consider every approach to fixing our crumbling infrastructure,” said Blumenauer. “The Move America Act will support billions of dollars in much-needed investment to help rebuild and renew our country.”

    “This bipartisan bill will help jumpstart our local economies and create a ton of good-paying jobs for people all across the country,” said Representative Sean Patrick Maloney (NY-18), a member of the House Transportation and Infrastructure Committee. “It will help make real investments in our aging infrastructure and allow us to get a lot done by teaming up with the private sector and that’s just good sense.”

    The Move America Act would allow states to issue tax-exempt Move America Bonds to expand public-private partnerships and lower borrowing costs. Incentives for state and local governments to offer these bonds include flexible ownership and management arrangements, favorable tax treatment, and up to five years of unused bond carry-over. They would be allocated to states based on population.

    The bill would also create Move America Tax Credits to leverage additional private investment by enabling smaller states to trade in some or all of their bond allocation for tax credits at a 25 percent rate. Credits could be attached to direct investment in a project or used to capitalize state infrastructure banks or revolving funds.

    Eligible infrastructure projects include roads, bridges, airports, rail, transit, ports, freight transfer facilities, waterways, sewers, and broadband. The Move America Act would leverage $8 billion in federal funding into an estimated $226 billion worth of bond authority or $56 billion in tax credits over the next decade.

    The legislation was introduced in the Senate (S. 1229) earlier this year by Senators John Hoeven (R-N.D.) and Ron Wyden (D-Ore.).

    Congressman Serrano Sends Letter to President Trump Urging Him to Rebuild Communications Infrastructure in Puerto Rico

    Dear Mr. President:

    We write to urge you to immediately deploy all available federal assets and relevant federal agencies to Puerto Rico for the express purpose of reestablishing telecommunications services such as telephone, cellular phone, and internet services in Puerto Rico and the U.S. Virgin Islands. The situation is very dire in Puerto Rico right now and with many localities still cut off from the rest of the island, communications are key in sharing information, residents receiving aid from first responders as well as from their relatives in the 50 states, and localities being able to respond to the first aid needs of communities and receive the support necessary to prevent further loss of life.

    Currently, private telecommunications service providers are sending response teams from the 50 states and assessing the damage to the infrastructure in Puerto Rico and the U.S. Virgin Islands. While the service providers have been proactive, we believe that due to the gravity of the situation, it is necessary for the federal government to support the reestablishment of services as quickly as possible for individuals and localities throughout the islands. In short, cellular and internet connections for basic communications purposes are crucial in fulfilling basic necessities. FEMA and other government agencies such as the Office of Cybersecurity and Communications at the Department of Homeland Security’s National Protection and Programs Directorate have the mission of helping restore emergency communications networks and critical infrastructure for government, first responders, states, and localities. In addition, the Department of Defense has the capacity to provide resources and capabilities when other federal agencies are overwhelmed. We respectfully request that the full extent of these federal assets be deployed immediately to help restore individual service as well- at least until private service providers can fully restore their networks.

    The lack of communications is undermining the relief effort- especially in communities currently cut off from other parts of the island. A working cellular network is necessary in order to receive emergency services and medically treat those in need to prevent the loss of life. It is also vital in order for municipalities to communicate with Commonwealth and federal disaster response authorities in order to receive the necessary help. From roads that need to be cleared, to locating missing persons, to communicating with remote areas and maintaining the safety and security of its residents, telecommunications services are vital.

    Network restoration will also assist disaster response relief teams in narrowly tailoring aid to those areas most in need and quickly deploying assets across the island. In short, reestablishing communications in a prompt manner is crucial in order to have an effective disaster response and relief efforts.

    The people of Puerto Rico need robust assistance at this hour of great need and it is incumbent upon us to help in every manner possible. Thank you for your attention to this matter and we look forward to your response.
