Two COVID-19 Cases Filed Against People’s Republic of China (PRC)

New York, NY - May 05, 2020 - (The Ponder News) -- During this time of uncertainty, as the coronavirus continues to upend lives and businesses, the need for the rational and consistent application of the Rule of Law has never been more urgent. Legal Language Services’ (LLS) senior consultant, Tom McLean, Esq. and LLS’s president, Victor Hertz, reviewed two recently-filed lawsuits related to the pandemic, brought against the People’s Republic of China (PRC). These suits are representative of several similar cases, including those brought by the Missouri and Mississippi Attorneys General.

The Two Cases

Both suits against the PRC were brought under the Foreign Sovereign Immunities Act (FSIA) and, according to McLean, “appear to suffer from weak causation, scapegoating China for the pandemic.” Similar cases, such as the complaint brought by Liang Xuguang against the US Federal Government (among others), have also been filed in the PRC. LLS’s blog post – Panic, Pandemic, and the Rule of Law – examines the causation, decisions and validity of these two lawsuits.

Case 1, Alters v People’s Republic of China, is a class action asserting that the PRC acted in its own best interest to maintain its "Superpower status" and negligently failed to contain the COVID-19 virus in Wuhan. [1]

Case 2, Buzz Photos v People’s Republic of China, is an attempt by a business to recover damages arising from COVID-19-related lost sales and layoffs. [2]

Do These Cases Deserve Their Day in Court?

LLS believes everyone deserves their day in court. “Perhaps the attorneys who filed these cases know more than they let on in their complaints. If so, these cases have merit and should be heard even if President Xi and the PRC government disagree,” said McLean. He adds, “If these cases are weak and have been filed for publicity, rather than a true hope of recovering money, then they do a disservice to the United States and its judicial system. If the US judicial system works as it should, then the litigants in these cases will not prevail.”

Hertz points out that “similar litigation was filed after the 9/11 attacks, seeking damages from Saudi Arabia. Those cases were dismissed by the Supreme Court.” [3]

"It is essential that the legal profession uphold the Rule of Law when society is stressed and people feel at risk,” Hertz reiterates. “Ultimately, good litigation will produce good precedents and these cases against China will rise or fall on their own merits.”

Senate passes Kennedy and Van Hollen’s bill to kick deceitful Chinese companies off U.S. exchanges

Washington, D.C. - May 25, 2020 - (The Ponder News) -- On Wednesday, the Senate passed the Holding Foreign Companies Accountable Act by unanimous consent. Sens. John Kennedy (R-La.) and Chris Van Hollen (D-Md.) introduced the legislation to protect American investors and their retirement savings from foreign companies that have been operating on U.S. stock exchanges while flouting Securities and Exchange Commission (SEC) oversight.

“The SEC works hard to protect American investors from being swindled by American companies. It’s asinine that we’re giving Chinese companies the opportunity to exploit hardworking Americans—people who put their retirement and college savings in our exchanges—because we don’t insist on examining their books. There are plenty of markets all over the world open to cheaters, but America can’t afford to be one of them. China is on a glidepath to dominance and is cheating at every turn. I hope my colleagues in the House will immediately send this bill to the president’s desk so we can protect Americans and their savings,” said Kennedy.

“As we continue to experience the economic fallout and volatility caused by the COVID-19 pandemic, the need to protect main street investors is all the more important. For too long, Chinese companies have disregarded U.S. reporting standards, misleading our investors. Publicly listed companies should all be held to the same standards, and this bill makes commonsense changes to level the playing field and give investors the transparency they need to make informed decisions. I’m proud that we were able to pass it today with overwhelming bipartisan support, and I urge our House colleagues to act quickly,” said Van Hollen.

The Holding Foreign Companies Accountable Act prohibits securities of a company from being listed on any of the U.S. securities exchanges if the company has failed to comply with the Public Company Accounting Oversight Board’s (PCAOB) audits for three years in a row.

The bill would also require public companies to disclose whether they are owned or controlled by a foreign government, including China’s communist government.

Many Americans invest in U.S. stock exchanges as part of their retirement savings, and dishonest companies operating on the exchanges put Americans at risk. This legislation protects the interest of hardworking American investors by ensuring that foreign companies traded in America are subject to the same independent audit requirements that apply to American companies.

Sens. Kevin Cramer (R-N.D.), Tom Cotton (R-Ark.), Bob Menendez (D-N.J.), Marco Rubio (R-Fla.) and Rick Scott (R-Fla.) have cosponsored the bill.

Background:

Congress established the PCAOB to inspect audits of public companies, ensuring the information companies provide to the public is accurate, independent and trustworthy.

Currently, China’s communist government refuses to allow the PCAOB to inspect audits of companies registered in China and Hong Kong. Such companies represent a keen risk to American investors as nearly 11 percent of all securities class action lawsuits in 2011 were brought against Chinese-owned companies accused of misrepresenting themselves in financial documents.

According to the SEC, 224 U.S.-listed companies are located in countries where there are obstacles to PCAOB inspections. These companies have a combined market capitalization of more than $1.8 trillion.

In the last 10 years, the number of Chinese companies listed on U.S. stock exchanges has increased significantly, as those firms take advantage of the capital available in America.

United States Wins Dispute Finding China’s Administration of Grain Tariff-Rate Quotas Breaches WTO Commitments

Washington, D.C. - April 22, 2019 - (The Ponder News) -- U.S. Trade Representative Robert Lighthizer and Secretary of Agriculture Sonny Perdue announced today that a World Trade Organization (WTO) dispute settlement panel found that China has administered its tariff-rate quotas (TRQs) for wheat, corn, and rice inconsistently with its WTO commitments. Contrary to those commitments, China’s TRQ administration is not transparent, predictable, or fair, and it ultimately inhibits TRQs from filling, denying U.S. farmers access to China’s market for grain.

This panel report is the second significant victory for U.S. agriculture this year, and, together with the victory against China’s excessive domestic support for grains, will help American farmers compete on a more level playing field.

“This second important victory for the United States further demonstrates that President Trump will take all steps necessary to enforce trade rules and to ensure free and fair trade for U.S. farmers. The Administration will continue to press China to promptly come into compliance with its WTO obligations,” said Ambassador Lighthizer.

China’s grain TRQs have annually underfilled. USDA estimates that if China’s TRQs had been fully used, it would have imported as much as $3.5 billion worth of corn, wheat and rice in 2015 alone.

“Making sure our trading partners play by the rules is vital to providing our farmers the opportunity to export high-quality, American-grown products to the world,” said Secretary Perdue. “Today’s announcement is another victory for American farmers and fairness in the global trade system. We will use every tool available to gain meaningful market access opportunities for U.S. grains and other agricultural products.”

Background:
Upon accession to the WTO, China made commitments specific to its administration of TRQs, including the commitment to administer its TRQs in a transparent, predictable, and fair basis, using clearly specified administrative procedures and requirements that do not inhibit the filling of each TRQ. In August 2017, the United States requested that the WTO establish a dispute settlement panel to consider whether China administers its TRQs for long-grain rice, short- and medium-grain rice, wheat, and corn in a manner inconsistent with its WTO commitments.

Today’s panel report agrees with the United States that China administers its TRQs in a manner inconsistent with its Accession Protocol obligations, through its eligibility criteria, allocation and reallocation procedures, public comment process, and processing restrictions. In addition, China allocates a significant portion of each TRQ to a designated state-trading enterprise (STE) and does not subject the STE to the same rules applied to non-state trading enterprises applying for and importing grains under the TRQs. Each finding individually established that China’s TRQ measures are inconsistent with its obligations.

Compliance with WTO rules will lead to market-oriented TRQ administration and improved access for U.S. and other exporters, overall creating a more level playing field.

Dear Senators and Representatives:

On behalf of the Alliance for American Manufacturing (AAM), a partnership between the United Steelworkers (USW) and leading U.S. manufacturing companies, I am writing to express our support for the Transit Infrastructure Vehicle Security Act. This legislation would ban Federal Transit Administration (FTA) funds from being used to award a contract or subcontract to a Chinese state-owned, controlled, or subsidized enterprise.

Backed by deep government support and Beijing's "Made in China 2025" initiative, China's electric bus and rail state-owned enterprises (SOEs) are rapidly altering the U.S. competitive landscape for rolling stock manufacturing. This is having a profoundly negative impact on established, private-sector U.S. firms and jeopardizing supply chains that employ tens of thousands of American workers.

China Railroad Rolling Stock Corporation (CRRC) – a Chinese SOE – has drastically altered the competitive landscape for domestic railcar manufacturing. Since 2014, CRRC has secured major metro transit car contracts in Boston, Philadelphia, Los Angeles, and Chicago with impossibly low bids. In Boston, CRRC's bid was hundreds of millions of dollars below the next lowest bidder. In Philadelphia, another bidder was quoted as saying, "I cannot grasp how they are able to do it at that cost." There should be no doubting CRRC's strategy to establish itself in the U.S. market and to eliminate legitimate competition through any means necessary, even if it means losing substantial sums of money along the way. With deals in DC, Atlanta, and Miami within CRRC's sights, it is vital for U.S. national security, innovation, and jobs that we stop subsidizing the destruction of our domestic rolling stock manufacturing base with federal dollars.

The electric bus industry is also in Beijing's sights. BYD, or Build Your Dreams, assembles electric buses in the United States and is both influenced and subsidized by the Chinese government. BYD has been plagued by quality issues and a recent OIG investigation by the City of Albuquerque suggests that "the majority, if not all, parts were manufactured in China and shipped to the United States" – including the bus frame, chassis, walls, drive train, axels, motor, lights, seating and seat belts, and more. BYD not only aggressively undermines healthy market competition in the electric bus procurement market, it threatens to displace supply chains here in the United States with imported parts and components shipped in from China.

It is vital that the United States act to prevent the destruction of the U.S. competitive landscape for rolling stock manufacturing before it is too late. America's tax dollars should not be used to support Chinese state-owned firms seeking to undermine market competition. President Trump’s Fiscal Year 2019 budget proposal is as ludicrous as it is disturbing. After drastically increasing our unsustainable debt by adding $1.5 trillion in unpaid tax cuts for the wealthy, the president is doubling down on failed, far-right policies that slash Medicare, Medicaid, and a number of anti-poverty programs for the most vulnerable amongst us. With at least a half trillion in proposed cuts to Medicare and $250 billion stolen from Medicaid, President Trump has yet again turned his back on hardworking Americans and his dishonest pledge to preserve entitlement programs.

Rep. Rice Statement on President Trump’s Infrastructure Plan

In 1991, Congress designated I-73 as a high priority project. This morning, President Trump released his infrastructure framework that I believe will finally get this project off the ground. President Trump called on Congress to draft a comprehensive infrastructure bill that will stimulate at least $1.5 trillion in new investment over the next 10 years, shorten the process for approving projects, address unmet rural infrastructure needs, empower State and local authorities, and train the American workforce of the future. There are too many regulatory barriers preventing essential infrastructure projects from moving forward, a prime example being I-73. The permitting process for I-73 began in 2004, and due to the inefficient environmental review process we just received permits over the summer. I stand ready to work on legislation that will cut through this red tape and unleash economic prosperity through critical infrastructure investment. Delivering on the Administration’s legislative framework will help build a stronger America, and I intend to take this opportunity to invest in a stronger South Carolina.

China is Still Breaking WTO Trade Promises 16 Years Later

Washington, D.C. - December 15, 2017 - (The Ponder News) -- China's years of broken promises, non-market economy, and predatory trade practices have decimated American factory jobs and still threaten to put U.S. manufacturers out of business 16 years after it joined the World Trade Organization (WTO).

"Over a decade later and the U.S.-China state-of-play hasn't changed much," said Scott Paul, president of the Alliance for American Manufacturing (AAM). "China is still making promises it doesn't intend to keep and demanding even more access to our markets. We're living in a 'China first' world, and if our leaders don't act, our domestic factory jobs will continue to disappear."

Beijing has done little regarding economic reform since 2001 when the country joined the WTO. For example, the Chinese government requires intellectual property transfers from foreign companies operating within its borders, subsidizes companies that flood global markets with cheap imports, and skirts international trade law.

Meanwhile, Chinese President Xi Jingping has demanded China be considered a "market economy," a designation that eases trade rules based on the principle that a country's economy is open rather than managed by the state. The United States has six criteria outlining a market economy, and China fails to meet a single requirement.

"China has shown its unwillingness to meet its commitments, and unless we insist it do so, the next generation of industry will not be made in America," Paul said. "The White House has voiced valid criticism of the WTO and should continue fighting for a fair dispute system. Concurrently, the administration should follow-through on open Section 232 steel and aluminum imports. American jobs are at stake, and workers deserve action now."

U.S.-China economic facts:

1. Chinese state firms contribute between 25-30 percent of China’s industrial output on average, although state-owned enterprises in some sectors exceed 90 percent as of 2016.
2. China’s share of the U.S. goods deficit set a new record in 2015, reaching 50 percent.
3. The cumulative U.S. trade deficit with China since it joined the WTO is over $3.5 trillion.
4. The growing U.S. trade deficit with China cost 3.2 million jobs between 2001 and 2013.
5. The ratio of Chinese imports to U.S. exports is about 4:1.
6. Seventy-five percent of new steel stock since 2000 has come from China.
7. As many as 15,000 U.S. steel and iron workers are facing layoff as a result of Chinese overcapacity, and nearly 33 percent of American steel jobs have vanished during the last two decades.
8. Over 1,000 antidumping cases have been initiated against China globally since 1995.
9. Despite promises to cut capacity, China accounted for over half the world's steel capacity from 2014-2016.
10. All 435 Congressional Districts have lost jobs to China due to Beijing’s unfair trade practices.

Broken Promises and Delayed Trade Actions Threaten U.S. Factory Jobs

Washington, D.C. - October 18, 2017 (The Ponder News) -- As presidential candidate, Donald Trump promised to label China a currency manipulator on his first day in office. But President Trump hasn't done so amid a trend of conflicting trade messages including delayed steel and aluminum imports investigations and the unbalanced trade deficit.

Those mixed messages took center stage Tuesday when the Treasury Department kept China on its "watch list," according to its semi-annual Report on the Foreign Exchange Policies of Major Trading Partners of the United States.

The Department of the Treasury issued this Report on developments in international economic and exchange rate policies and submits it to Congress pursuant to the Omnibus Trade and Competitiveness Act of 1988, 22 U.S.C. § 5305 and Section 701 of the Trade Facilitation and Trade Enforcement Act of 2015.

“Treasury is actively working to make sure that American workers and companies can compete on a level playing field and succeed. This Administration remains vigilant to ensure that trade is free, fair and reciprocal with our partners. We will continue to monitor foreign exchange policies for unfair currency practices which adversely impact all Americans.” stated Secretary of the Treasury Steven T. Mnuchin.

Treasury has established criteria specified in the Trade Facilitation and Trade Enforcement Act of 2015 (the "2015 Act") that determine whether enhanced analysis is necessary. Pursuant to the 2015 Act, Treasury has found in this Report that no major trading partner met the criteria for the current reporting period.

Similarly, based on the analysis in this Report, Treasury also concludes that no major trading partner of the United States met the standards identified in Section 3004 of the Omnibus Trade and Competitiveness Act of 1988 for currency manipulation in the first half of 2017. Notwithstanding, Treasury has not re-examined previous reporting periods.

Additionally, U.S. Department of the Treasury established a "Monitoring List" of major trading partners that merit close attention to their currency practices. Treasury finds that five major trading partners warrant being placed on the Monitoring List for special attention: China, Germany, Japan, Korea, and Switzerland.

The findings and recommendations of the Report are intended to combat potentially unfair currency practices and support the growth of free and fair trade. The United States cannot and will not bear the burden of an international trading system that unfairly disadvantages our exports and unfairly advantages the exports of our trading partners, whether through imbalanced macroeconomic policies or unfair trade barriers. Treasury is committed to aggressively and vigilantly monitoring and combatting unfair currency practices.

Said Alliance for American Manufacturing (AAM) President Scott Paul:

"The president campaigned on China's predatory trade practices and the massive trade deficit, but when given the chance to make real change, he just delays.

"I appreciate Treasury's hat tip surrounding the massive trade deficit with China, but until that gap shrinks, it won't mean much to America's factories.

"Meanwhile, our workers are suffering. President Trump shelved the Section 232 steel and aluminum imports investigation and prompted a flood of imports.

"At least two steel mills in Pennsylvania are facing layoffs amid soaring steel imports. The Chinese government has done almost everything possible to bolster its own steel and manufacturing industries at the expense of our own, and it is becoming a make or break point for U.S. steel makers.

"American factory voters were promised a pinch-hitter. Trump will fill that position when he steps up to the plate and restores factory jobs through steel imports and trade deficit action."

Paul shared expanded remarks on China's trade practices before a House Ways and Means subcommittee on U.S. trade relations in the Asia-Pacific late last week.
