OVER $530 MILLION TO REPAIR TEXAS BRIDGES

McAllen, TX - January 15, 2022 - (The Ponder News) -- On Friday, January 14, 2022, U.S. Representative Vincente Gonzalez (D-TX, 15th) announced that the U.S. Department of Transportation’s (DOT) Federal Highway Administration (FHWA) will disperse more than $537.1 million, allocated through the Bipartisan Infrastructure Law, to renovate and enhance bridges across the state of Texas over the next five years. This is largest bridge formula program in American history.

Under the formula, Texas is set to receive $107.4 million for Fiscal Year 2022 that will create good-paying jobs and provide much needed updates to bridges across the 15th District of Texas.

“South Texans know that bridges keep our community moving in more ways than one,” said Congressman Gonzalez. “Thanks to the Bipartisan Infrastructure Law, many of the decrepit bridges within our community will be upgraded to ensure proper safety and reliability. I look forward to working with local leaders, the Texas Department of Transportation (TxDOT), and the Federal Highway Administration to ensure that our roads and bridges keep up with the growth of our region.”

According to the latest data from FHWA, out of the 1,398 bridges in the 15th District of Texas, almost 50% are considered “fair” or “poor”. The Texas Department of Transportation (TxDOT) will notice local apportionments of the $107.4 million at a later date.

The Trump administration has imposed tariffs on many Chinese imports under Section 301 of the Trade Act of 1974 and on aluminum and steel imports from nearly every country under Section 232 of the Trade Expansion Act of 1962. This has led China and many other countries to retaliate by imposing tariffs on a wide variety of American exports. Today, 161 trade associations representing businesses in every sector urged the President to temporarily suspend these tariffs.

Housing allowances under the Post-9/11 GI Bill are based on whether student veterans attend a university in person versus an online program. As colleges and universities close campuses to prevent the spread of the coronavirus, veterans on the GI Bill could lose or have their benefits cut. This bill would allow these student veterans to continue to receive full benefits even if the colleges they are attending decide to close or temporarily move classes online due to coronavirus. Senator Murray helped introduced this bill last week with U.S. Senators Jerry Moran and Jon Tester, respectively the Chairman and the top Democrat on the Senate Veterans’ Affairs Committee.

The calculated effort to suppress the minority vote during Super Tuesday is a danger to our democracy. In my home state of Texas, we heard from hundreds of minority Americans unable to vote due to too many people at too few polls and malfunctioning machines causing long lines. In California, we also saw how a lack of poll workers delayed lines for hours. This is on top of years of blatant attempts to reduce the number of polling sites in places where the Latino and African-American population is growing by the largest numbers through the gutting of the Voting Rights Act.

Supreme Court Decision OKs Rule Requiring Immigrant Self-Sufficiency, Less Dependency - Win for American People

In a well-deserved blow to an activist judge in the Southern District of New York, today the Supreme Court lifted a nationwide injunction on President Trump’s common sense, long overdue 'public charge' rule, allowing it to go in effect during the course of litigation. This is a massive victory for the Trump administration, the American people, and most importantly, preserves the public interest component of an immigration system constantly under attack by special interest judges. The rule will correct expensive and politically-driven loopholes, and uphold the clearly expressed intent of Congress that immigrants to the United States be self-reliant. That means putting back in place screening criteria that identifies and selects prospective immigrants who will be less likely to depend on government programs and become public charges. The interest of the American people is best served when immigrants selected for admission into the United States can demonstrate they are capable of providing for themselves and their dependents. While lower court litigation continues, the rule takes effect immediately. Given that the arguments against public charge are meritless, it is likely this rule change is permanent.

The U.S. Department of Agriculture (USDA) is now accepting online applications for funding through the new ReConnect Rural Broadband Pilot Program. These funds will enable the federal government to partner with the private sector and rural communities to build modern broadband infrastructure in areas with insufficient internet service. Insufficient service is defined as connection speeds of less than 10 megabits per second download and 1 megabit per second upload.

Terri Sewell (AL-07) and Adrian Smith (NE-03) have introduced the Revitalizing Underdeveloped Rural Areas and Lands (RURAL) Act, legislation that would help preserve jobs and encourage infrastructure development by expanding tax-exempt cooperative organizations’ access to government grants and assistance, including rural broadband grants and FEMA disaster relief.

“Our rural communities depend on reliable infrastructure, access to broadband and secure energy sources for their local economies to thrive,” Rep. Terri Sewell said. “Alabama’s rural electric co-ops provide essential broadband services in rural areas where high-speed internet is limited but essential to those areas’ economic growth. We must do more to provide high-speed internet – and the opportunities and resources that it brings – to the 22.4 million Americans living in rural parts of our country without quality internet access. The RURAL Act would ensure that these co-ops can retain their tax-exempt status when applying for grants to expand rural broadband or disaster assistance and provide these co-ops with the ability to secure the grants needed to continue to grow their renewable energy, economic development and energy efficiency initiatives.”

“Nebraska has a long tradition of relying on public and cooperative power generation to affordably meet the needs of families, farmers, ranchers, and small businesses,” Rep. Adrian Smith said. “While continuing to ensure rural electric co-ops are largely funded by their membership as a condition of their tax-exempt status, we should also ensure funds received from grants or for pole usage do not affect their tax status. “Rural Electric Cooperatives have historically received grants from various sources to assist in providing services to their members such as renewable energy development, energy efficiency and conservation and more recently helping to deploy vital broadband service to rural Alabama communities. Recent changes in the Revenue Code create an unintended consequence for cooperatives that may jeopardize their tax-exempt status,” said Alabama Rural Electric Association President and CEO Fred Braswell. “Representative Sewell understands the importance of this to rural Alabama and its citizens. “Crucial community infrastructure projects in central Alabama have materialized because Central Alabama Electric Cooperative (CAEC) has successfully obtained grants. Over the years these federal, state and local allocations have funded a rural wastewater system and new entry roads in county business parks. Congresswoman Terri Sewell has introduced the RURAL Act, which offers protection to electric cooperatives and other nonprofit organizations by allowing them to maintain certain tax exemptions. Without their not-for-profit status, electric cooperatives’ ability to pursue grants will be hampered by having to include additional costs in rates,” said Central Alabama Electric Cooperative President and CEO Tom Stackhouse. “Thank you, Congresswoman Sewell, for your leadership and diligence in sponsoring the RURAL Act. Continued protection will be essential for CAEC as we embark on our rural broadband project this year.”

“As an electric cooperative that was severely impacted by Hurricane Michael in October 2018, HR 2174 will allow PowerSouth Energy Cooperative’s members to utilize FEMA grants without fear of losing our non-for-profit status,” said PowerSouth Energy Cooperative Vice President of External Affairs Horace Horn. “We are grateful for Rep. Sewell’s sponsorship of this legislation and look forward to working with her on this issue.”

The RURAL Act would amend the Internal Revenue Code to ensure tax-exempt cooperative organizations do not lose their tax-exempt status when they apply for and use certain government grants, contributions and assistance, including rural broadband grants and FEMA disaster relief.

A Senate companion measure was introduced by Sens. Rob Portman (R-OH) and Tina Smith (D-MN).

You would think that after being told 10 times, pushing the button 10 times and hung up on more times than I count, they would quit calling. It's annoying. The Trump administration recently announced that it had ordered the Department of Justice (DOJ) to file with the Fifth Circuit Court Federal Appeals Court that it affirms a December 2018 ruling by a federal judge in Texas in Texas v. United States that invalidated the remaining portions of the Affordable Care Act (ACA). Because 16 states have challenged the decision, the judge’s ruling will not have any immediate effect. However, this latest action is an ominous sign the administration is determined to dismantle ACA, thereby eliminating essential health services to millions of low-income and indigent people.

Washington, D.C. - April 12, 2019 - (The Ponder News) -- Rep. David B. McKinley P.E. (R-WV), introduced the Water Quality Certification Improvement Act of 2019, which will help advance energy infrastructure projects.

This legislation will clarify Section 401 of the Clean Water Act which is part of the permitting process for pipelines and other infrastructure projects. Currently, some states have used the Section 401 certification process to prevent and delay federally permitted projects.

“Building and modernizing energy infrastructure is vital for our economy and our energy security,” Rep. McKinley said. “States like Washington and New York have been abusing this law to block coal exports and delay pipeline projects. It is critical we clarify Section 401 and stop the abuse of this law on behalf of an ideological ‘keep it in the ground’ agenda.”

In addition to McKinley, the legislation introduced today is cosponsored by Liz Cheney (R-Wyo.), Greg Gianforte (R-Mo.), Bob Gibbs (R-Ohio), Kevin Hern (R-Okla.), Doug LaMalfa (R-Calif.), and Pete Stauber (R-Minn.).

“The far-left’s politicization of the Clean Water Act has obstructed critical interstate commerce projects that produce great economic value to the West. The state of Washington halting development of the Millennium Bulk Terminal, which would export Wyoming’s clean-burning coal overseas, prevented the creation of new jobs, impeded industry’s expansion in the West, and severely undercut Wyoming’s economy under the guise of water quality. I’m proud to be a co-sponsor of the Water Quality Certification Improvement Act, which would prevent other states from taking steps that harm Wyoming’s economy,” Rep. Liz Cheney said.

Specifically, the legislation will:

  • Clarify that the scope of a section 401 review is limited to water quality impacts only
  • Clarify that states, when evaluating water quality, can only consider discharges that would result from the federally permitted or licensed activity itself – not from other sources;
  • Require states to publish clear requirements for water quality certification requests
  • Require states to make final decisions on whether to grant or deny a request in writing based only on water quality reasons; and
  • Require states to inform a project applicant within 90 days whether the states have all the materials needed to process a certification request.

    IRRESPONSIBLE BILL WOULD FORCE VA TO POTENTIALLY WASTE BILLIONS, JEOPARDIZE VETERANS’ HEALTH CARE

    Arlington, VA - March 29, 2019 - (The Ponder News) -- Concerned Veterans for America (CVA) announced its opposition to legislation to eliminate the asset and infrastructure review (AIR) mandated by the bipartisan VA MISSION Act. This bill, introduced by Sens. Rounds and Manchin, would force the VA to maintain excess and aging infrastructure and would take valuable resources away from providing the best care possible for our veterans. The AIR provision of the VA MISSION Act would create a commission to evaluate the VA’s current medical facility footprint to ensure that it is best aligned with the current needs and demands of the VA patient population across the country.

    Dan Caldwell, CVA’s executive director had this to say regarding the bill:

    “This irresponsible and misguided legislation would force the VA to potentially waste billions in taxpayer dollars to maintain VA facilities that are clearly outdated and not serving the needs of the current or future veteran population. The asset and infrastructure review is critical to protecting the VA’s ability to serve our veterans, allowing the VA to modernize and adapt as the veteran population continues to change, and ensuring the VA is spending taxpayer dollars in the most responsible way when serving those veterans. We urge the Senate to reject this bill and we hope that Senators Rounds and Manchin reconsider this counterproductive proposal.”

    Secretary Wilkie, during a Senate Veterans Affairs Committee hearing Tuesday, stressed the importance of modernizing the VA, including the importance of making sure the VA’s facilities are up to the task of caring for our nation’s veterans. He pointed out that “ more than half of the buildings [he is] responsible for age in range from over 50 years to 100 years.” And he reminded the members that it was the Senate Veterans Affairs Committee which, through the VA MISSION Act, directed the VA to conduct market assessments and create “the asset and infrastructure review commission to bring the VA up to speed where the veterans are.”

    The VA is one of the largest federal property-holding agencies, owning buildings covering more than 151 million square feet and leasing over 1,500 buildings costing more than $340.6 million annually in rent. Former VA Secretary Shulkin has testified in previous hearings that the VA has hundreds of empty or under-utilized VA buildings that cost the federal government $25 million annually to maintain.

    The VA MISSION Act – which contained the provision mandating the asset and infrastructure review –passed Congress on an overwhelming bipartisan vote and was signed into law by President Trump on June 6, 2018.

    President’s Fiscal Year 2020 Budget Fortifies DHS Operations, Supports Frontline Personnel, Secures Our Borders & Confronts Emerging Threats Release Date: March 18, 2019

    Washington, D.C. - March 19, 2019 - (The Ponder News) -- Department of Homeland Security Secretary Kirstjen M. Nielsen released the details of the Fiscal Year (FY) 2020 Budget request to Congress for DHS and its component agencies and offices. The DHS request includes $51.7 billion in discretionary funding and an additional $19.4 billion for the Disaster Relief Fund (DRF). The Budget request provides critical resources to help our frontline personnel do their jobs to secure the homeland against all threats and hazards, and it ensures DHS is able to defend Americans against emerging dangers.

    “The American people and our law enforcement personnel rightfully demand effective border security as supported by the White House budget—building the wall and giving the men and women of DHS the support, tools, and resources they need to safeguard our territory,” said Secretary Nielsen. “This year’s request also delivers landmark investments to protect America and our way of life—including by combating terrorism and homeland threats, defending our nation’s networks and critical infrastructure, facilitating and securing legal trade and travel, and so much more.”

    Border & Maritime Security
    To address the unprecedented humanitarian and security crisis at the Southwest Border, the FY 2020 budget requests $5.0 billion for the construction of approximately 200 miles of a new border wall system and over $232 million to equip our law enforcement personnel with the latest in surveillance technology. Further, over $80 million is requested to provide migrant care including medical services, general consumables and transportation. The U.S. Immigration and Customs Enforcement (ICE) funding request includes 54,000 beds to address immigration enforcement. DHS continues to support its law enforcement men and women in uniform by requesting over 1,000 combined Border Patrol Agents and Customs and Border Protection Officers, and over 1,660 ICE law enforcement and support staff. In continued commitment to safeguarding our Nation’s ports and waterways while enforcing the law on the high seas, the Department has requested $1.2 billion in funds for recapitalization of U.S Coast Guard resources.

    Cybersecurity & Infrastructure Security

    In an age of pandemic malware and network instructions, the Budget requests $1.3 billion for programs such as Federal Network Protection, Proactive Cyber Protection, and Infrastructure Security, which will allow DHS to safeguard the federal government’s civilian information technology systems against cybersecurity risks. It also supports the maturation of the Department’s new Cybersecurity and Infrastructure Security Agency (CISA).

    Transportation Security
    The FY 2020 Budget goes further to invest in the security of the traveling public. The Transportation Security Agency (TSA) continues to experience airline passenger volume growth at airport checkpoints nationwide. The funding request for TSA supports an additional 700 Transportation Security Officers (TSO) contributing to a total of more than 46,600 TSOs, the highest level in history. Additionally, $221 million is requested for new equipment to effectively detect smaller and more artfully concealed threats within checked or carry-on bags in response to an evolving threat landscape.

    Emergency Management & Recovery
    In keeping with a policy of “Relentless Resilience,” the Budget proposes crucial resources to enhance the Federal Emergency Management Agency (FEMA). A funding request of $28.5 billion, which includes $19.4 billion for the Disaster Relief Fund, ensures FEMA continues to provide the requisite support to disaster survivors by increasing their capacity to take effective and practical steps to help themselves, their families, and their communities. And it funds FEMA’s transformation into a more responsive agency focused on helping Americans better prepare for the worst.

    BPC Launches New Initiative to Develop Long-Term Solutions to Funding Federal Infrastructure Needs

    The Bipartisan Policy Center today announced that former Reps. Bill Shuster (R-PA) and Joe Crowley (D-NY) will lead a new Great American Rebuild Initiative to identify long-term mechanisms to finance the Highway Trust Fund. Their work will focus on developing potential long-term solutions to fully fund America’s critical infrastructure programs, up to and including ending the federal government’s reliance on the gas tax.

    Under their leadership, the initiative will conduct a comprehensive review of potential revenue sources and develop recommendations to improve and sustainably fund trust fund programs. This effort aims to offer solutions that are practical, politically viable, and bipartisan.

    Without new revenue sources, maintaining current spending levels will require an average bailout of general revenues of $20 billion per year. However, with increasing pressure on the federal budget—projections show federal deficits surpassing $1 trillion in 2019—forward movement on an infrastructure bill demands new, collective thinking on sustainable revenues.

    “With the greater adoption of electric vehicles and more efficient gas-powered vehicles, the gas tax is increasingly untenable as a long-term funding source. Even if the gas tax were raised by 20 cents per gallon, as some interest groups suggested, Washington would still face a long-term funding crisis. Congress can no longer avoid a comprehensive examination of the federal role in funding our nation’s transportation infrastructure and the best means to meet those obligations,” said Shuster, the former chair of the House Transportation and Infrastructure Committee.

    The launch of the Great American Rebuild Initiative comes ahead of the expiration of the FAST Act, which authorizes federal spending on roads, bridges, and other transportation infrastructure, on September 30, 2020. In addition, the Highway Trust Fund balance will approach zero in fiscal year 2021.
    “There is bipartisan agreement that infrastructure needs to be addressed, but no consensus on how to pay for those essential upgrades. Now is the time to come together and forge a new path forward to ensure our infrastructure can meet the needs of our economy,” said Crowley, a former member of the House Ways and Means Committee.
