The draft proposal sets up a false choice between, on the one hand, updating the FCC’s maps in line with the recently-enacted Broadband DATA Act but delaying funding for several years, and, on the other hand, moving forward using the flawed coverage data, simply for the sake of moving forward quickly. But these are plainly not the only options, nor the best options; there is no reason why the FCC cannot follow the law that Congress mandated and distribute needed funding in a timely manner, with accurate data. We should not be limiting ourselves to two inadequate options, but rather looking for real solutions to deploy mobile broadband as quickly as possible.”

First, the DLC filed a complaint with the Department of Health and Human Services Office for Civil Rights (OCR) regarding the State’s Crisis Standards of Care on behalf of the agency and an individual who could be impacted, Jacob Hansen, an individual with cerebral palsy and cystic fibrosis. The guidelines’ Patient Prioritization Tool and Adult Triage Guidelines explicitly and implicitly deprioritize people with disabilities for care in violation of the Americans with Disabilities Act (ADA), Section 504 of the Rehabilitation Act (Section 504), and Section 1557 of the Affordable Care Act (ACA).

Lawrenceville, GA - April 19, 2019 - (The Ponder News) -- Last week, the House Rules Committee met to consider H.R. 2021, the “Investing for the People Act.” Representative Austin Scott (GA-08) testified about his amendment to H.R. 2021, which would have provided emergency disaster assistance funding to farmers, ranchers, and others who were harmed by 2018 natural disasters.

In October, Hurricane Michael devastated parts of South and Middle Georgia. Since then, the entire Georgia Congressional Delegation has worked to secure federal assistance for not only Georgia, but for other areas impacted by hurricanes, wildfires, flooding, and other natural disasters during 2018. Unfortunately, the Senate failed to advance disaster aid legislation due to ongoing policy disagreements. Representative Scott’s amendment was a new attempt to secure disaster aid following continued obstruction by Senate Democrats who refuse to support the compromise legislation drafted by Georgia’s Senators Isakson and Perdue.

“Georgia is the number one producer of peanuts and pecans in the United States. Our state is the second largest producer of cotton, has the fourth largest amount of total forest land area, and 24.4 million acres of available timberland for commercial use in our country,” said Congressman Woodall. “Farmers from California to New York and all the way down to Georgia work day and night to fill the refrigerators for all Americans. Each year, our farmers take enormous risks on our behalf, and as Americans, we should do everything we can to stand behind these hardworking men and women who are willing to put their family’s well-being on the line.”

ISAKSON, PERDUE ARGUE FOR SEASONAL FARMER PROTECTIONS IN TRADE AGREEMENT

Washington, D.C. - April 8, 2019 - (The Ponder News) -- U.S. Senators Johnny Isakson, R-Ga., and David Perdue, R-Ga., raised concerns with the administration’s lead negotiator for the U.S.-Mexico-Canada-Trade agreement regarding the need to protect Georgia farmers forced to compete with subsidized Mexican fruit and vegetable imports.

The senators joined a bipartisan group of colleagues in the Senate and House in a letter sent Thursday asking U.S. Trade Representative Robert Lighthizer to address the legitimate concerns expressed by Georgia’s seasonal growers and to implement new rules to defend domestic seasonal and perishable produce from unfair trade practices.

“Fair, open and reciprocal trade is essential to America’s long-term economic success,” said Isakson. “I intend to do everything I can to help facilitate a level playing field for trade and ensure that hardworking Americans have the tools necessary to address unfair trade practices. Agriculture is Georgia’s largest industry, and our fruit and vegetable farmers are currently far too vulnerable to illegal dumping and other targeted efforts that undermine their ability to cultivate and sell their products at home and abroad. As members of Congress, we’re asking that America’s farmers have a seat at the table and the ability to air their objections to unfair foreign trade practices in a fair and open way.”

“Agriculture is Georgia’s number one industry and a major reason why our state continues to be the best state in the country in which to do business,” said Perdue. “The United States’ economy has evolved since NAFTA was signed nearly 25 years ago. As the Trump administration works to get a better deal for American workers and businesses, we must ensure that farmers and growers are treated fairly and have equal access across the world. It’s critical that we gain a level playing field that will allow our agriculture industry to compete globally.”

Providing a fair process for domestic seasonal fruit and vegetable growers to access the legal means to impose anti-dumping and countervailing duties “was not just an early objective of the administration’s North American Free Trade Agreement (NAFTA) renegotiations, but was also referenced by Congress under current Trade Promotion Authority,” wrote the bipartisan members of Congress.

“The [U.S.-Mexico-Canada Agreement’s] silence on the matter is significant and concerning,” the letter continues. “We strongly insist that the administration address this issue in a way that gives confidence to all seasonal growers that the federal government can and will act to counter legitimate injury from unfair imports from Mexico or any other country.”

A possible remedy would be to enact the Defending Domestic Produce Production Act, S.16, which Isakson has cosponsored, or through appropriate administrative action to establish equally effective, enforceable and durable remedies through existing trade authorities.

The letter was led by U.S. Sen. Marco Rubio, R-Fla., and other members of Florida’s Congressional delegation. In addition to Isakson and Perdue, the letter was also signed by members of Georgia’s congressional delegation including U.S. Reps. Rick Allen, R-Ga.-12, Buddy Carter, R-Ga.-01, Sanford Bishop, D-Ga.-02, Jody Hice, R-Ga.-10, Austin Scott, R-Ga.-08, and David Scott, D-Ga.-13, along with other U.S. representatives from Florida.

Dear Ambassador Lighthizer:

We write to raise concerns regarding the lack of progress in the new U.S.-Mexico-Canada Agreement (USMCA) with respect to improved mechanisms to initiate and sustain legitimate anti-dumping and countervailing duties (AD/CVD) proceedings for trade in seasonal and perishable produce. As you know, providing a fair process for domestic seasonal fruit and vegetable growers to access genuine AD/CVD relief was not just an early objective of the Administration’s North American Free Trade Agreement (NAFTA) renegotiations, but was also referenced by Congress under current Trade Promotion Authority (TPA). The USMCA’s silence on the matter is significant and concerning.

The President has consistently argued that reducing persistent trade deficits with America’s trading partners is an important goal in the pursuit of free, fair, and reciprocal trade. The U.S. agricultural trade deficit with Mexico has risen rapidly since NAFTA came into force, driven by growing Mexican fruit and vegetable exports buoyed by significant government subsidies and unfair pricing practices, among other factors. In 2016, the U.S. faced a $5.1 billion trade deficit in agricultural goods with Mexico. Fruits and vegetables made up the largest source of Mexico’s bilateral agricultural trade surplus at $11.2 billion, nearly $2 billion more than the bilateral U.S. trade surplus of meats, dairy, grain, and oilseeds combined. While the Mexican Government has refused to include a mechanism to correct this growing imbalance in the USMCA text, we still believe the Administration must ensure that clear rules are in place to defend domestic seasonal and perishable produce from unfair trade practices.

We strongly insist that the Administration address this issue in a way that gives confidence to all seasonal growers that the federal government can and will act to counter legitimate injury from unfair imports from Mexico or any other country. This could be accomplished by enacting the Defending Domestic Produce Production Act (S. 16 / H.R. 101), or through appropriate administrative action to establish equally effective, enforceable, and durable remedies through existing trade authorities. Those remedies must able to provide relief, as necessary and applicable, across a highly diverse suite of American seasonal producers.

Domestic seasonal and perishable produce growers deserve reasonable access to trade enforcement tools that are readily available to other agricultural and industrial producers in the U.S. Such an outcome would be good for American fruit and vegetable farmers, good for American families, and good for the nation’s food security. Moreover, a successful resolution of this issue would provide important support for the USMCA within the agricultural communities we represent.

We greatly appreciate your efforts to secure the strongest trade deals possible for the United States and your commitment to protect American workers and production capacity from unfair and illegal foreign competition. Hastings Leads Letter to USDA Secretary Purdue Urging Common Sense Reforms to Livestock Indemnity Program

Dear Secretary Perdue:

We believe the United States Department of Agriculture Farm Service Agency’s Livestock Indemnity Program should implement common sense changes to the information collected from farmers prior to providing reimbursement for animals that have died as a result of adverse weather events.

The Humane Farming Association informed us that, from 2013 to 2017, USDA’s LIP issued payments of approximately $199 million to farmers and ranchers for animal deaths due primarily to adverse weather events. The total animal deaths included a staggering 277,471 livestock and 6,686,168 poultry. Despite the large amount of taxpayer dollars and animal loss involved, the LIP does not currently ask farmers applying for reimbursement to answer any questions regarding the shelter, care, or treatment provided to animals that died due to adverse weather events. Furthermore, since the cap was removed in the Bipartisan Budget Act of 2018, there is now no limit on the amount of LIP compensation that a qualifying farmer can receive.

Moreover, the Humane Farming Association informed us that many animals are provided little to no shelter and subjected to prolonged suffering and agonizing deaths that could be preventable if proper weather precautions and disaster management plans were encouraged by the FSA’s LIP. For example, in the summer of 2017 in California’s central valley, thousands of dairy cows died from heat stroke due to a lack of adequate protections from the heat such as sufficient shade, fans, and misters. In the aftermath, three counties in California declared states of emergency, because they were not able to render the dead fast enough.

When no adequate protection is put in place during adverse weather events, producers are reimbursed for dead livestock at 75 percent of the animals’ market value. We believe this represents a clear disincentive for farmers to take the necessary steps to have a disaster management plan and provide their animals with protections from adverse weather events. Without this compensation, we believe many producers would no doubt make an effort to provide for their animals. Instead, we believe massive numbers of neglected livestock are dying painfully and needlessly while taxpayers foot the bill.

For these reasons, we believe that producers applying for compensation under LIP be required to provide detailed information regarding the precautionary measures that the producer took to avoid the death of livestock during adverse weather events. We believe LIP applicants should be required to provide direct proof, including but not limited to photos, videos, or records, of preparations made to provide for the well-being of animals in their care during adverse weather events. In addition to the Livestock Death Loss Documentation required by LIP, which requires applicants to document the number and kind of livestock that died, we believe the FSA should require that applicants answer specific questions regarding the preparations that were made to protect animals from death from adverse weather events. These questions could include:

What was the producer’s disaster management plan in the case of an adverse weather event?

What steps were taken by the producer to keep animals from suffering from or dying as a result of exposure to heat, cold, or other elements?

What type of shelter did the producer provide to animals prior to the eligible adverse weather event?

What percentage of a producer’s animals did that shelter accommodate?

Were transport vehicles available to evacuate the animals out of harm’s way?

Were emergency food/water supplies available to accommodate animals that did not have access to normal food/water sources?Was veterinary assistance available to treat or humanely euthanize animals?

We believe all farm animals deserve to be given an adequate level of humane treatment and care including proper food, water, and shelter. Furthermore, we believe farmers should not be rewarded with taxpayer dollars for not providing these most basic levels of humane treatment. For these reasons, we respectfully request that, if LIP compensation is made available, the FSA should only provide it to those producers who not only put in place adverse weather protections for their livestock, but also document those protections.

Focus on Farmers

President Trump gave a speech on Monday at the American Farm Bureau Federation convention in Nashville. The main-stream media wanted to focus on just one thing he said, (I'm sure you have all seen it on the news, about flags and the national anthem). They refused to focus on all the other stuff he said, even though the speech was nearly 40 minutes in length. What he said about the flag and the National Anthem only occurred ONCE, in a 5 second comment. That is why I refuse to give credence to the news on television. Here at The Ponder, I think it is right that we show you what you miss by watching the news on TV, and not getting your information from the sources on the internet.

After the speech, Trump signed an executive order to expand broadband to rural communities.

Thune and Noem Lead Bipartisan, Bicameral Effort to Expand Sodsaver Initiative

U.S. Sens. John Thune (R-S.D.) and Amy Klobuchar (D-Minn.), members of the Senate Agriculture Committee, and U.S. Reps. Kristi Noem (R-S.D.) and Tim Walz (D-Minn.), a member of the House Agriculture Committee, today introduced companion versions of the bipartisan American Prairie Conservation Act (S. 1913 and H.R. 3939). This new sodsaver legislation, which, according the Congressional Budget Office, would save more than $50 million over ten years, would disincentivize the conversion of native sod to cropland by closing a crop insurance yield substitution loophole in all 50 states. Thune first authored sodsaver initiatives in the 2008 and 2014 farm bills for nationwide implementation.

Sodsaver, which has only been implemented in South Dakota, North Dakota, Minnesota, Iowa, Montana, and Nebraska, is a cost-saving initiative that disincentivizes, but does not prevent, farmers from converting native sod to cropland. Farmers who choose to break up native sod and convert it to cropland face a reduction in crop insurance premium subsidy assistance and a reduction in guaranteed yields of insured crops.

“By closing loopholes and applying these more effective sodsaver provisions nationwide, we can save taxpayers money, eliminate an unintended crop insurance incentive to break native sod, and protect America’s diminishing prairie grasslands that are so important to our grazing livestock producers,” said Thune. “Not only is this an example of a good-government solution, but the savings achieved by our bill could be used elsewhere in an already cash-strapped farm bill.”

“The sodsaver provision we implemented in six Midwestern states as part of the 2014 Farm Bill has successfully reduced the conversion of native sod, saved taxpayer dollars, and encouraged wildlife habitat,” said Klobuchar. “Our bipartisan legislation would extend this small, commonsense change to the crop insurance program and boost conservation efforts and savings nationwide.”

“As an avid hunter and a lifelong farmer, I truly appreciate that in South Dakota our hunting tradition is just as strong as our commitment to agriculture,” said Noem. “With the Protect Our Prairies language included, the 2014 Farm Bill has helped strike a healthier balance between production and conservation in the Prairie Pothole Region. With proven results and the prospect of additional savings for taxpayers, now is the time to expand the program nationwide.”

“I am proud to re-introduce this legislation that will conserve critical wildlife habitat while allowing farmers to manage their lands as they see fit,” said Walz. “By working together and promoting common sense conservation practices we can protect critical wildlife habitat, support our farmers, and support the hunting and fishing industry that is an integral part of our state’s economy.”

The American Prairie Conservation Act would:

Apply sodsaver’s prohibition to substitute crop insurance yields on native sod that is converted to cropland nationwide;
By requiring crop insurance premium subsidies and yield guarantees be reduced for a total of four cumulative years for any crop, close an existing loophole that allows certain noninsured crops to be planted four consecutive years with no reduction in crop insurance assistance for succeeding insured crops;

Make crop insurance assistance more reflective of production capabilities on all native sod that is converted to cropland nationwide;

Require producers who convert native sod to cropland to certify to the Farm Service Agency the number and location of acres of native sod that are converted in an existing automated crop certification system so the converted acres would be accurately tracked;

Apply to both crop insurance and the Noninsured Crop Disaster Assistance Program.

A loophole in existing sodsaver statute allows producers to plant non-insurable crops on newly converted native sod for four successive years. After the four successive-year window, producers could then plant insurable crops, such as corn, wheat, and soybeans, without any reduction in crop insurance assistance. The American Prairie Conservation Act requires four cumulative years of crop insurance assistance reductions before insurable crops planted on native sod that are converted to cropland are no longer subject to sodsaver provisions.
