Legislation to Limit High-capacity Ammunition Magazines Introduced in the House

Gun Organizations Urge ATF to Complete Review before Legislation is Considered

The National Shooting Sports Foundation (NSSF) and The Sporting Arms and Sporting Arms and Ammunition Manufacturers' Institute (SAAMI) today issued the following joint statement.

Our thoughts and prayers continue to be with the families and loved ones of all those killed and injured in the criminal attack in Las Vegas. The manufacture, distribution and sale of automatic firearms and their components has been stringently regulated by federal laws since 1934. We believe the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) should interpret and enforce existing laws and regulations. We call upon ATF to conduct a prompt review and evaluation of aftermarket trigger activation devices such as bump stocks to determine whether they are lawful to install and use on a firearm under the National Firearms Act of 1934 (NFA), or whether, if they have no function or purpose other than to convert a conventional firearm into an automatic firearm, they are regulated items under the NFA. We urge Congress to allow ATF to complete its review before considering any legislation so that any policy decisions can be informed by the facts and ATF's analysis.

Bump Stocks

Washington, D.C. - October 9, 2017 - (The Ponder News) -- Executive Director of Gun Owners of America (GOA) Erich Pratt issued the following statement on GOA's position on bump stocks:

"Gun Owners of America opposes a ban on bump stocks. Bump stocks were approved by the ATF during the Obama administration to help gun owners with disabilities fire their weapons.  Any type of ban will be ignored by criminals and only serve to disarm honest citizens.  Perhaps that’s why 91 percent of police believe a so-called “assault weapons” ban will have no effect or a negative effect on crime.  And given that 95 percent of cops think that a ban on large capacity magazines would be ineffective in reducing violent crime, it’s hard to imagine they would regard bump stocks any differently.

It's sad to see some Republicans quickly call for a vote on gun control, while delaying a vote on concealed carry reciprocity, H.R. 38. This is bipartisan legislation which will protect concealed carriers while they travel and which has been cosponsored by 212 law makers. If law makers want a vote on bump stocks, they should vote on reciprocity as well."

Many have called the Illinois State Rifle Association office regarding “bump stocks” and other such devices.  These devices were approved by the BATFE under President Obama and Attorney General Holder.  It is the Illinois State Rifle Association’s suggestion that the BATFE review their ruling, open up a comment period and re-address their ruling.

In response to the senseless attack in Las Vegas, the Second Amendment Foundation and Citizens Committee for the Right to Keep and Bear Arms have issued the following statement:

“The Second Amendment Foundation and Citizens Committee for the Right to Keep and Bear Arms support a productive dialogue concerning “bump stocks,” National Concealed Carry Reciprocity and the proposed Hearing Protection Act.

“We recognize that banning firearms accessories is not a solution to violent crime.”

Nelson sponsors bill to ban sale of ‘bump stocks’

Washington, D.C. - October 5, 2017 (The Ponder News) -- U.S. Sen. Bill Nelson (D-FL) has sponsored legislation to ban the sale of so-called “bump stocks” that can be used to increase the firing rate of a semi-automatic weapon, essentially converting it into a fully-automatic assault weapon.

While current law bans the sale, manufacture and transfer of most automatic weapons, the legislation Nelson filed today with Sen. Dianne Feinstein (D-CA) and others would close a current loophole in the law that allows semi-automatic weapons to be easily modified to fire at the same rate as automatic weapons.

“I’m a hunter and have owned guns my whole life,” Nelson said, “But these automatic weapons are not for hunting, they are for killing. And this commonsense bill would, at the very least, make it harder for someone to convert a semi-automatic rifle into what is essentially a fully-automatic machine gun.”

The legislation would ban the sale, transfer, importation, manufacture or possession of bump stocks, trigger cranks and similar accessories that accelerate a semi-automatic rifle’s rate of fire. While a typical semi-automatic rifle can fire at a rate of between 45 and 60 rounds per minute, a fully-automatic weapon can fire at a rate of 400 to 800 rounds per minute.

The bill makes clear that its intent is to target only those accessories that increase a semi-automatic rifle’s rate of fire. Legitimate accessories used by hunters would be exempt. The bill also contains exceptions for lawful possession of these devices by law enforcement and the government.

Menendez, 18 Senators Introduce ‘Keep Americans Safe Act’ in Wake of Las Vegas Shooting

U.S. Senator Bob Menendez (D-N.J.) today was joined by 18 Senate colleagues in introducing the Keep Americans Safe Act, common sense public safety legislation banning the importation, sale, manufacture, transfer, or possession of gun magazines that hold more than ten rounds of ammunition and are designed for shooting en masse. In what is now the deadliest mass shooting in American history, 59 people were killed and 527 injured after a gunman opened fire on Las Vegas concert-goers. According to investigators, the alleged shooter was in possession of more than 23 firearms, including several high-powered assault rifles, and hundreds of rounds of ammunition.

“How many lives need to be senselessly taken across our nation at the hands of a gun before the United States Congress wakes up and takes common sense steps to protect the public’s safety,” said Sen. Menendez. “What happened in Las Vegas is an unspeakable tragedy, but it is inexcusable for this Congress to remain silent in its aftermath. When 49 people in an Orlando nightclub were brutally slaughtered, it was time to act. When 20 young, defenseless children in a Connecticut elementary school were tragically gunned down, it was time to act. It was time to act after every mass shooting in America, and it’s time to act now after its worst. Large-capacity magazines have one singular purpose—to kill as many people as possible. They have no place in a civil society and must be banned to protect a weapon of mass murder getting in the hands of a killer.”

The Keep Americans Safe Act is cosponsored by Sens. “Limiting the size of magazines can give law enforcement an opportunity to stop a shooter who is on a rampage,” Sen. Kaine said. “We should pass this commonsense bill and other measures to curb deadly gun violence like the tragic shooting in Las Vegas this week. For too long, Congress has don’t nothing to stop these horrific events. We must do better.”

“Large-capacity magazines are not needed for sport shooting or to hunt deer; they are only meant to kill people – and they do far too often in this country. We need to do everything in our power to stop the carnage of these shootings. There are common sense steps we can take now, steps that are supported by an overwhelming number of Americans, including gun-owners, that can help break the cycle of callous disregard for the victims of gun violence,” said Sen. Cardin. “More talk and more prayers will not save lives. Only action and real changes in our federal and state laws can.”

“Large-capacity magazines exist for a single purpose: inflicting the most lethal damage possible in the shortest period of time,” Sen. Blumenthal said. There is no rational reasoning behind legalizing access to this degree of deadliness. It is long past time we ban large capacity ammunition. It is the very least we can do to keep our children, coworkers, and neighbors safe.”

“In the wake of the shooting in Las Vegas, our country has united to grieve the lives we’ve lost. But it’s also time for us to work together to stop the terrible toll of gun violence in our country,” said Sen. “Like many Americans, I was horrified that one individual could inflict so much carnage in Las Vegas this past weekend, and that he could do it in a matter of minutes,” Sen. Carper said. “Large-capacity magazines make dangerous weapons even more deadly, and we’ve had to endure the loss of too many innocent lives because of their use. It’s time for Congress to use common sense to update our gun laws, and restoring the ban on these dangerous devices is an important step toward much-needed reform.”

“The higher the bullet count, the higher the death count. Large capacity magazines are about causing mass carnage. We need to end the sale of these weapons of mass destruction before any more tragedies occur,” said Sen. Markey.

“What happened in Las Vegas is a national tragedy—and one that we seem to keep repeating. In Las Vegas, the killer was able to wound or kill nearly 600 people in less than ten minutes. We must do everything we can to prevent people from being able to accomplish so much destruction in such a short period of time,” Sen. Sanders said. “While it is too late for the victims in Las Vegas, Newtown and Charleston, it is not too late to prevent the next set of innocent Americans from becoming victims.”

“Congress must finally stand up to the gun industry and protect Americans from horrific gun violence like we saw in Las Vegas,” said Sen. Gillibrand. “These weapons are designed to kill as many people as possible as rapidly as possible, and that includes high-capacity magazines that let violent killers fire dozens of rounds without having to frequently stop and reload. We must take gun violence as seriously as we take the threat of terrorism, and I urge all of my colleagues in the Senate to support this legislation to keep our country safe.”

Full text of the Keep Americans Safe Act can be downloaded here. In addition to prohibiting large-capacity ammunition magazines, the bill includes the following provisions:

Provides limited exceptions for devices possessed before enactment, for certain current and former law enforcement personnel, for certain Atomic Energy personnel and purpose, for tubular devices that can only accept .22 rimfire ammunition, and for certain authorized testing or experimentation;

Modifies the high-capacity definition to prevent coupled or joined magazines;

Authorizes a buyback programs for high capacity magazines using Byrne JAG grants;

Requires devices manufactured after enactment to have conspicuous serial numbers and date of manufacture to help law enforcement identify restricted magazines;

Harmonizes forfeiture provisions for magazines with current law; currently FBI and ATF can seize and destroy certain firearms but not high capacity magazines.

“Large capacity magazines have no place in our communities. Hunters don't use them. Killers use them to hurt as many people as they can, as fast as they can. Large capacity magazines are a threat to all of us, and to our often outgunned law enforcement community. In addition to Las Vegas, high-capacity magazines have been used in some of the country’s most horrific mass shootings:

In Orlando, Fla., on June 12, 2016, Omar Mateen fired bullets from a 30-round assault rifle and a 17-round semi-automatic pistol into a crowded Pulse Nightclub, killing 49 and injuring more than 50 others in what was then the worst mass shooting in American history.

In San Bernardino, Calif., on Dec. 2, 2015, armed with assault rifles and other weapons, Syed Rizwan Farook and Tashfeen Malik stormed a social services center where Farook worked and fatally shot 14 people and injured at least 17 others.

In Newtown, Conn., on Dec. 14, 2012, Adam Lanza used 30-round magazines in the mass shooting that took the lives of 20 students and six adults at Sandy Hook Elementary School. When Adam Lanza was reloading his gun, eleven students managed to escape.

In Aurora, Colo., on July 20, 2012, James Eagan Holmes used a 100-round drum magazine and a 40-round magazine in the shooting that left 12 people dead and 58 wounded. His 100-round magazine jammed during the shooting, preventing even more casualties.

In Tucson, Ariz., on Jan. 8, 2011, Jared Loughner used two 31-round magazines and two 15-round magazines in the shooting that killed six people and wounded 13 more. Loughner was tackled to the ground while changing magazines and is one of many shootings – including the 1993 Long Island Railroad shooting and the 1998 Thurston High School shooting – that ended when the gunman attempted to reload his gun.

In Fort Hood, Texas, on Nov. 5, 2009, Nidal Hasan used 30- and 20-round magazines in the shooting that killed 13 people and wounded 34 more. The gun-shop owner who sold the extended magazines quotes Hasan as saying he didn’t like spending time loading magazines.

Sen. Menendez has a long history of supporting common sense gun safety measures, including closing background check loopholes, banning bump stock devices, and preventing those on the Terror Watch List from purchasing guns and explosives. He cosponsored measures to ban large-capacity magazines in the 112th, 113th and 114th Congresses.

Senator Markey Reintroduces ‘Smart Gun’ Legislation to Increase Gun Safety

Washington, D.C. - October 5, 2017 (The Ponder News) -- Senator Edward J. Markey (D-Mass.) reintroduced legislation to address the gun violence that is gripping communities across the country. The bill, the Handgun Trigger Safety Act, would improve gun safety by ensuring that only authorized users would be able to operate handguns utilizing personalization (or “smart gun”) technology. There are roughly 33,000 deaths and 79,000 injuries from gun violence each year in the United States. Rep. Carolyn Maloney (D-N.Y.) introduced companion legislation in the House of Representatives, and Senator Elizabeth Warren (D-Mass.) is a co-sponsor of the Senate legislation. In 2016, the Obama administration announced a new effort to study and expand the deployment of smart gun technology, and the Department of Justice released a report to improve and deploy the technology.

“To anyone who says that taking action now to address gun safety is ‘too soon’, it’s already too late for at least 59 people in Las Vegas,” said Senator Markey. “We need to pass commonsense gun legislation that keeps these weapons out of the hands of people who should not have them. The Handgun Trigger Safety Act utilizes technology to ensure that only authorized users can operate a gun. We have technology that requires a fingerprint to operate an iPhone; we should do the same for a handgun. Smart gun technology is smart gun safety policy.”

The Handgun Trigger Safety Act would support the use of personalization (or smart gun) technology that allows the purchaser of a gun to designate authorized user(s) who can operate the gun and would make the gun inoperable for all others. Personalized handguns are already sold overseas and have been available in the United States since 2011.

Specifically, the Handgun Trigger Safety Act would:

Authorize grants to develop and improve “personalized” handgun technology to increase efficacy and decrease costs;

Mandate that, within five years of enactment, all newly manufactured handguns must be personalized, ensuring that they can only be operated by authorized users;

Mandate that, within ten years of enactment, anyone selling a handgun must retrofit it with personalization technology before that sale can be completed; and

Provide reimbursement to manufacturers for the costs of retrofitting handguns through the Department of Justice Assets Forfeiture Fund.

SENATORS INTRODUCE “NO CHECK, NO SALE” BILL TO CLOSE LOOPHOLE ALLOWING GUN SALES WITHOUT A COMPLETED BACKGROUND CHECK

Washington, D.C. - October 5, 2017 (The Ponder News) -- Senator Edward J. Markey (D-Mass.) joined Senators Richard Blumenthal (D-CT), Chris Murphy (D-CT) and Dianne Feinstein (D-CA) to introduce legislation to close a current loophole that allows gun sales to proceed if a background check is not completed after 72 hours, even if the gun buyer is not legally allowed to purchase a gun. The gap in existing law has allowed thousands of gun sales to prohibited buyers, including the sale of the firearm used by Dylann Roof in his deadly attack at Emanuel AME Church in Charleston, South Carolina last year.

"Background checks can help keep guns out of the hands of people who should not have them," said Markey. "If you cannot pass a background check, you should not be able to buy a gun, period. As the tragedy in Charlestown made clear, giving law enforcement the time to perform a full background check could help save lives."

“No check, no sale must be the rule. When Dylann Roof walked into a gun store two years ago, he shouldn’t have been able to walk out with a weapon. But a loophole in current law allowed Dylann Roof – and thousands of others like him every year – to access weapons they are already legally ineligible to buy. Waiting for a background check, even if longer than 72 hours, is a minor inconvenience far outweighed by the benefit of keeping lethal weapons out of the hands of dangerous people,” said Blumenthal.

“If you can’t pass a background check, you shouldn’t be able to walk out of a store with a gun. As we saw in Charleston, this loophole allows dangerous people to get their hands on deadly weapons – it has literally cost innocent lives. This is a commonsense bill to give law enforcement the time it needs before a gun leaves the store,” said Murphy.

“Current law allows gun sales to proceed after 72 hours—even if background checks aren’t approved. This is dangerous loophole that could allow criminals and those with mental illness to complete their purchase of firearms even though it would be unlawful for them to possess them,” said Feinstein. “The shooter in Charleston who killed nine parishioners of Emmanuel AME Church would have failed his background check if the law had allowed it to be completed. Our commonsense proposal will ensure all background checks are completed before sales can move forward.”

When a criminal background check indicates that a firearm purchaser may have a criminal record, the Federal Bureau of Investigation (FBI) tries to determine whether the purchaser can legally buy a gun. If this process takes longer than 72 hours, gun dealers can complete the sale even though there is a heightened risk that the purchaser is legally disqualified from purchasing a gun.

The Background Check Completion Act would require a completed background check for every gun buyer who purchases a gun from a federally-licensed gun dealer.

SENATOR MARKEY JOINS BLUMENTHAL, MURPHY & SCHIFF TO INTRODUCE LEGISLATION TO GIVE GUN VICTIMS THEIR DAY IN COURT AND END GUN INDUSTRY’S LIABILITY SHIELD

Washington, D.C. - October 5, 2017 (The Ponder News) -- Senator Edward J. Markey (D-Mass.) joined Senators Richard Blumenthal and Chris Murphy (D-CT) and U.S. Representative Adam Schiff (D-CA) to introduce legislation – the Equal Access to Justice for Victims of Gun Violence Act – to ensure that the victims of gun violence are allowed to have their day in court and that the gun industry – manufacturers, sellers and interest groups – is not shielded from liability when it acts with negligence and disregard for public safety. The bill would repeal the Protection of Lawful Commerce in Arms Act (PLCAA).

In 2005, Congress passed PLCAA, which provides immunity in state and federal court from civil liability for manufacturers, distributors, and dealers of firearms, as well as their trade associations, in most negligence and products liability actions. This immunity from liability under well-established common law principles that apply to everyone else in society is unique to the gun industry. As a result, gun makers and sellers have a lesser obligation to act with reasonable care for the safety of the public. It also means that gun sellers can turn a blind eye to straw purchasers or traffickers who may buy hundreds of weapons and traffick them to others with no background check whatsoever. As most gun companies are responsible businesses, this immunity only protects the worst actors in the industry.

"It's time to repeal the Protection of Lawful Commerce in Arms Act and take away the gun manufacturers’ immunity from civil liability," said Senator Markey. "We want PLCAA to stand for Protecting Lives, Creating Arms Accountability. No other industry has this 'Get out of jail free' card when its products kill thousands of Americans each year."


“When ten Sandy Hook families courageously took the manufacturer and distributor of the AR-15 used in that horrific tragedy to court, the deceptively named Protection of Lawful Commerce in Arms Act was used as a complete barrier to their pursuit of justice. That’s because under current law – and unlike virtually every other manufacturer of consumer products – the gun industry cannot be sued by consumers who are harmed by their products,” Blumenthal said. “Our simple measure will give victims of gun violence their day in court and unlock the doors to justice —repealing the sweetheart deal that Congress granted to the gun lobby.”

“Making the gun industry immune from lawsuits effectively handed them a license to kill,” said Murphy. “Toy manufacturers are held legally responsible if their neglect or irresponsibility hurts people, so why on earth aren’t gun manufacturers? I challenge my colleagues to put the safety of our constituents ahead of the gun lobby’s interests and support this bill. Repealing gun industry immunity will encourage gun manufacturers to make safer products, and it will save lives.”

“Our nation is plagued by an epidemic of mass shootings and everyday gun violence. While not every murderous act can be prevented by any single measure, we should use a comprehensive approach that includes holding the gun industry accountable when it acts negligently, just as we do with other industries.” Rep. Schiff said. “This bill would pierce the gun industry’s liability shield by putting an end to the special protections the gun industry receives when they shirk their fundamental responsibility to act with reasonable care for the public safety.”

When Congress passed the PLCAA, its supporters argued that it was necessary to protect the gun industry from frivolous lawsuits, but that victims of gun violence would not be shut out of the courts. Senator Larry Craig, the sponsor of the legislation and at the time a member of the NRA’s board, stated during debate on the Senate floor, “This bill will not prevent a single victim from obtaining relief for wrongs done to them by anyone in the gun industry.” In reality, numerous cases around the nation have been dismissed on the basis of PLCAA even when the gun dealers and manufacturers acted in a fashion that would qualify as negligent if it involved any other product. Victims in these cases were denied the right to even discover or introduce evidence of negligence.

This legislation allows civil cases to go forward against irresponsible bad actors. Letting courts hear these cases would provide justice to victims while creating incentives for responsible business practices that would reduce injuries and deaths.

Blumenthal and Murphy Introduce Bill to Close Automatic Weapon Loophole

And, so it starts.

Washington, D.C. - October 4, 2017 (The Ponder News) -- U.S. Senators Richard Blumenthal (D-CT) and Chris Murphy (D-CT) joined U.S. Senator Dianne Feinstein (D-CA) introducing the Automatic Gun Fire Prevention Act, a bill to close a loophole that allows semi-automatic weapons to be easily modified to fire at the rate of automatic weapons, which have been illegal for more than 30 years.

“Bump stock devices are carnage force-multipliers. The searing noise of that staccato firing in Las Vegas that we have all now heard countless times should be a wakeup call to this Congress. We should come together to stop the sale of a device that is patently designed just to kill people. The bump stock device essentially circumvents the law – widely accepted – and enables law breaking. What excuse can there be for the continued sale of bump stocks? None,” said Blumenthal.

Murphy said, “Bump fire stocks skirt the law to effectively make a semi-automatic weapon mimic an illegal fully automatic weapon – that’s literally the only reason it exists. People in Connecticut know this shouldn’t even be a debate. Automatic weapons are outlawed for a reason, and the horror in Las Vegas made clear why. Congress needs to pass this bill ASAP or we will see them seized by even more mass murderers and terrorists.”

The sale, manufacture and transfer of new fully automatic weapons have been illegal since 1986. However, bump stocks, slide fire devices and other similar accessories are able to be attached to semi-automatic weapons, allowing them to reach fully-automatic rates of fire.

Semi-automatic rifles typically have a rate of fire between 45 and 60 rounds per minute. A bump stock or other similar device increases the semi-automatic rifle’s rate of fire to between 400 and 800 rounds per minute.

The Automatic Gun Fire Prevention Act would ban the sale, transfer, importation, manufacture or possession of bump stocks, trigger cranks and similar accessories that accelerate a semi-automatic rifle’s rate of fire.

The bill also makes clear that its intent is to target only those accessories that increase a semi-automatic rifle’s rate of fire. Legitimate accessories used by hunters would be exempt. The bill also contains exceptions for lawful possession of these devices by law enforcement and the government.

“We must close this loophole that allows the sale of devices to convert guns into unlawful automatic weapons meant for war zones,” said Senator Maria Cantwell - (D - WA).

“It’s past time this Congress pursued common sense policies to address the rampant gun violence in this country, and this legislation is a good place to start,” said Senator Patty Murray - (D - WA). “Like so many people I’ve heard from over the past few days, I refuse to believe the politics are just too tough to do whatever is possible to prevent another senseless, horrific mass shooting like we just saw in Las Vegas.”

“This isn’t about helping hunters or sportsmen, this is about making more money for gun manufacturers. Their sales are slumping. They need a new revenue stream. Imagine if car sales were falling and we lowered the standards of requirements to get a driver's license. We would never do that for cars. Why would we do it for something as lethal as a silencer?

“That’s why I am calling on my Republican and Democratic colleagues to come together. This is not a partisan issue. This is an issue about saving lives and repairing our communities. I have introduced a resolution that would establish a Select Committee on Gun Violence that would consist of equal numbers of Republicans and Democrats and require them to submit a report to Congress on how we can work together to prevent gun violence. We can protect 2nd Amendment rights while making our communities safer. And we can do it together as a nation and as Democrats and Republicans.

I am positive that these are not all of the statements available by House Representatives. If it seems that I have only covered Democrats' statements, it is because the Republicans are remaining silent for the most part, as usual. I do not have the time today to go through all of the statements that are not here, but this is a good start. My POV is this: It doesn't matter whether these guns are legal or not. CRIMINALS will find a way to get them and CRIMINALS kill. Period. To ban weapons of ANY kind only takes it out of the hands of law-abiding people who would never kill someone to begin with, unless it was in defense of their lives.

On Monday, October 2, Congressman David Price (D-NC) issued the following statement regarding the horrific mass-shooting in Las Vegas, Nevada.

“Last night, our country witnessed yet another senseless and despicable act of gun violence, this time at a concert in Las Vegas. Lisa and I join the American people in grieving with the families and loved ones of the more than 50 people who lost their lives and more than 400 wounded survivors of what we now know is the largest mass shooting in our nation’s modern history. And yet we are well past the point where grieving is enough—we must summon the will and courage to take concrete action to prevent future tragedies. Anything short of that is a betrayal of the thousands of Americans who lose their lives each year to gun violence, and a betrayal of our values as a great nation.”

Deadly Shooting Prompts Vigil

Washington, D.C. - October 2, 2017 (The Ponder News) -- Mayor Megan Barry, Sarah Trahern, CEO of CMA and Butch Spyridon, President/CEO, Nashville Convention & Visitors Corp have released the following statement on the horrific mass shooting in Las Vegas that has claimed the lives of more than 50 concert-goers and injured hundreds more:

“Our heartfelt thoughts and prayers are with everyone involved in the tragic event in Las Vegas, especially the victims, their families and friends, and the fans, artists and crews from our Country community in Vegas. This festival brought together people from all backgrounds united in enjoying life through music.

“Safety at all of our events is and will remain our top priority. We are constantly adjusting our event security measures year-round, partnering and consulting with experts at the federal, state and local levels through our full-time security team and the Metro Police Department. We will continue our efforts to provide the most comprehensive security possible.”

In an effort to offer Nashvillians an opportunity to show their love for the victims of this deadly shooting, a vigil is planned for Monday, October 2 at 6PM at Ascend Amphitheater. Free parking will be available at Nissan Stadium Lot R. Further details about the vigil will be announced later in the day.

Pingree Says "Enough is Enough" After Mass Shooting in Las Vegas

Washington, D.C. - October 2, 2017 (The Ponder News) -- Congresswoman Chellie Pingree released the following statement on the mass shooting in Las Vegas that has claimed 58 lives and injured more than 500.

Today, America woke to the deadliest mass shooting in modern history. The fear, sadness, and heartbreak felt in Las Vegas reverberates in our communities and leaves us wondering how we could allow this to happen once again. The 58 dead and more than 500 injured deserve more than our sympathies and sentiments—they deserve to know their lives and losses prevented another tragedy.

Last June, in the wake of the Pulse Nightclub shooting in Orlando, House Democrats demanded action on common-sense gun legislation. I sat with my Democratic colleagues on the floor of the U.S. House and said no one else should die at the hands of a reckless gunman because of Congressional inaction. Republicans blocked our effort and never allowed for debate on the bill. More than a year later, the nation is reeling from the most devastating mass shooting in modern history with no sign of a safer tomorrow.

Four out of five Americans support universal background checks, so why won't Congress listen to their constituents and pass a bill to prevent weapons from getting into the hands of irresponsible gun owners once again? Recently, House Republicans have pushed to take up bills that would reduce restrictions on silencers and allow greater access to armor piercing bullets. Not only are these bills completely out-of-touch, they would make it more difficult to know where gunshots are being fired and put law enforcement officers in danger.

Enough is enough.

Unless Congress stands on the side of public safety to pass common-sense gun legislation now, what happened in Las Vegas today could happen anywhere in America tomorrow. I urge Speaker Ryan to allow a vote on legislation that would help prevent future mass shootings immediately.

Pelosi Sends Letter to Speaker Ryan Calling For Immediate Creation of Select Committee on Gun Violence, Passage of King-Thompson Background Check Legislation

The epidemic of gun violence in our country continues to challenge the conscience of our nation.

Today, our nation woke up to news of the worst mass shooting in our history, claiming the lives of at least 58 innocent men and women in Las Vegas. Nearly 12,000 Americans have been killed by guns in 273 mass shootings in 2017 – one for each day of the year. On average, more than 90 Americans lose their lives to gun violence every day, a daily toll of heartbreak and tragedy in communities across America.

Congress has a moral duty to address this horrific and heartbreaking epidemic. Charged with the solemn duty to protect and defend the American people, we must respond to these tragedies with courage, unity and decisive action.

First, Congress must pass the bipartisan King-Thompson legislation to strengthen the life-saving background checks that keep guns out of the wrong hands. But this is only a first step.

I urge you to create a Select Committee on Gun Violence to study and report back common sense legislation to help end this crisis. According to early news reports, the shooting claimed the lives of at least 50 people, surpassing the 2016 mass shooting in Orlando, Florida and making it the deadliest mass shooting in American history.

“My thoughts are with the victims of this senseless tragedy, their friends and families, and the City of Las Vegas. Much like the shooting in Orlando, these innocent Americans were doing something many of us have done, attend a concert. This attack was an act of terror and no one should have to experience a tragedy like the one that unfolded in Las Vegas.

“Members of Congress have the power to do something and we must do more than hold a moment of silence. We said never again after the shootings in Newtown, Charleston, San Bernardino, Orlando, and so many others. “This morning we learned yet another horrific act of gun violence had occurred in America; the deadliest mass shooting in our nation’s history. We grieve the tragic loss of over 50 innocent lives and extend our sympathies to all of the families and friends of the victims of the massacre. We pray for the more than 500 individuals who suffered injuries and those who are still waiting to hear from loved ones during this time of shock and horror. We thank all first responders who bravely rushed to the scene to rescue those in peril and prevent further casualties.

“The carnage that occurred breaks our hearts and confounds our minds. Additional counseling and supportive mental health services should be made available for all concert-goers, first responders, and the entire Las Vegas community. While we do not yet know all of the details, including the gunmen’s motive, we refuse to accept gun violence. Together we must act boldly to stop this epidemic and prevent tragedies. Our hearts remain with the city of Las Vegas and all Nevadans today.”

Napolitano serves as a Vice Chair of the House Democratic Gun Violence Prevention Task Force. She was appointed to the Task Force following the tragic shooting in Newtown, CT in 2012 to address mental health as a component of gun violence prevention. D.C. REQUESTS EN BANC FEDERAL COURT HEARING ON SAF’S WRENN CCW CASE

Bellevue, WA - August 29, 2017 (The Ponder News) -- The District of Columbia has filed an appeal with the U.S. District Court of Appeals requesting an en banc hearing in a case recently won by the Second Amendment Foundation that struck down the “good reason” requirement for obtaining a concealed carry permit.

The case is Wrenn v. District of Columbia.

“The Second Amendment Foundation expected the City of Washington, DC to file this appeal in an attempt to try to overturn our court victory that said their virtual ban on the right to carry a firearm for self-protection was unconstitutional,” said SAF founder and Executive Vice President Alan M. Gottlieb.

SAF has been battling the city over this issue for some time. The city has strenuously resisted these legal efforts, arguing in its latest petition that the city is “unique” because of its dense population that includes “thousands of high-ranking federal officials and international diplomats.” But earlier this summer, the District Court of Appeals majority opinion is that the “good reason” restriction violates the Second Amendment rights of citizens living in the district.

“They have no intention of complying with any court decision that supports the right to keep and bear arms,” Gottlieb said. “It took the Heller decision to force them to allow a gun in your own home for self-defense. It took the Palmer decision, another SAF case, to force them to repeal their total ban on carry and now they are kicking and screaming about losing the Wrenn decision.”

Gottlieb maintains that even if the District is “unique,” the citizens living there still retain their right to keep and bear arms under the Second Amendment. The city’s “good reason” requirement makes it far too easy to deny all but a few people their rights on the flimsy grounds that average citizens never have a good enough reason. The court recognized this problem and ruled against the District’s requirement, he noted.

“Municipal stubbornness cannot be allowed to outweigh the constitution,” Gottlieb said. “A civil right should not be subject to bureaucratic neurosis.”
