Same-Sex Marriage, Immigration arrest of U.S. Citizen, NRA Alaska Governor Endorsement

For those of you who don't know, the "Respect for Marriage Act" passed the House yesterday with a total of 267 votes, 47 of which were Republican votes.

The Respect for Marriage Act repeals the Defense of Marriage Act (H.R. 3396) and ensures that marriages valid under the law of the state where they were performed are recognized for purposes of federal law and benefits. It also provides additional legal protections for marriage equality from those fighting against it while acting under the color of state law.

Carlos Rios, a United States citizen, filed a complaint in the U.S. District Court for the Western District of Washington, last week, against Pierce County and Pierce County Jail deputies, seeking declaratory relief and damages for his unlawful imprisonment and violations of his civil rights under federal and state law. He is represented in the case by the Northwest Immigrant Rights Project (NWIRP), the ACLU of Washington, and Rekhi & Wolk, P.S.

Apparently, he was arrested on a misdemeaner, charges were dropped, but immigration officials ordered him to be held for immigration violation, even though he is a U.S. citizen.

Congratulations to Roy Moore of Alabama!

When I read that Donald Trump endorsed Luther Strange, I thought I read that wrong. After all, Roy Moore, the outspoken Alabama judge against same-sex marriage, pro-2nd Amendment, and dubbed the "10 Commandments Judge" was also running for senate. How could Donald Trump go against Roy Moore?

Thank God I wasn't the only person who thought like that. Alabama agreed with me, and now Roy Moore has won the Alabama early GOP primaries.

Let that sink in, Democrats: We didn't elect Donald Trump to look good. We elected him because he was one of US. And, so is Roy Moore.

Congratulations, Judge Roy Moore!

LEGAL BRIEF TO U.S. SUPREME COURT: CAKE BAKER’S PUNISHMENT FOR MARRIAGE VIEWS IS UNCONSTITUTIONAL

Austin, TX - September 8, 2017 (The Ponder News) -- Texas Values today joined 32 state family policy organizations from across the country supporting a Colorado cake shop owner who is being forced by the government to make a cake with a specific theme: celebrating a same-sex wedding ceremony.

The Colorado government entity also required the owner, Jack Phillips, to re-educate his staff, most of whom are his family members—essentially telling them that he was wrong to operate his business according to his faith. He must also report to the government for two years, describing all cakes that he declines to create and the reasons why. As a result of this ruling, Phillips has lost an estimated 40 percent of his business.

In a friend-of-the-court brief filed for the U.S. Supreme Court case Craig v. Masterpiece Cakeshop, Texas Values argues that legal decisions against the defendant, Phillips, undermines a constitutional firewall against compelled speech and will drive from the marketplace creative professionals who dissent from state-mandated orthodoxy on matters of ‘politics, nationalism, religion, or other matters of opinion.’”

Said Jonathan Saenz, President of Texas Values:

“The First Amendment protect religious liberty and freedom of speech and by no means gives government power to compel artists such as Jack Phillips to express someone else’s message, particularly on an issue such as marriage that has been widely debated in our country. We Texans are proud of our heritage of individual liberty, and we urge the High Court to stand up for our first freedoms by upholding Mr. Phillips’s right to express himself – or to choose not to express himself – according to the dictates of his own conscience, and not based on force by the government.”

The Colorado Supreme Court declined to take the case after the state’s Court of Appeals affirmed a Colorado Civil Rights Commission decision from May 2014. That decision ordered Phillips and his employees to design custom cakes that celebrate same-sex ceremonies if the shop designs cakes for opposite-sex ceremonies

In July 2012, Charlie Craig and David Mullins asked Phillips to design a wedding cake to celebrate their same-sex ceremony. In an exchange lasting about 30 seconds, Phillips politely declined, explaining that he would gladly make them any other type of baked item they wanted, but that he could not design a cake promoting a same-sex ceremony. Phillips regularly declines opportunities to create custom cakes for events that violate his convictions, including Halloween cakes, anti-American cakes, adult-themed cakes, cakes containing alcohol, and cakes that would disparage others.

Craig and Mullins, now represented by the American Civil Liberties Union, picketed Phillips and filed a complaint with the Colorado Civil Rights Commission, which eventually ruled against Phillips. The same-sex couple was easily able to obtain their desired rainbow-themed cake for free from another nearby cake artist.

In contrast to the ruling against Phillips, the commission found in 2015 that three other Denver cake artists were not guilty of creed discrimination when they declined a Christian customer’s request for a cake that reflected his religious opposition to same-sex marriage. The commission found those bakers had the right not to create custom cakes based on the requested message.

Colorado designer may appeal ruling that won’t let her challenge law forcing her to promote same-sex weddings

Denver, CO - September 6, 2017 (The Ponder News) -- A Colorado graphic designer who specializes in designing and creating custom websites is likely to appeal a federal judge’s ruling issued Friday. The ruling doesn’t allow her to challenge a law that forces her to use her artistic talents to promote same-sex ceremonies if she creates custom websites and graphics celebrating weddings between one man and one woman. Alliance Defending Freedom attorneys represent Lorie Smith and her studio, 303 Creative.

The judge ruled that Smith and her studio can’t sue to challenge a portion of Colorado’s Anti-Discrimination Act because a request that a couple with the first names “Stewart” and “Mike” sent Smith isn’t sufficient to prove that a same-sex couple has asked her to help them celebrate their wedding. The Colorado Civil Rights Commission has construed the law to force artists like Smith to create objectionable art even though Smith happily serves everyone and decides what art to create based on the art’s message—not her client’s personal characteristics.

The law also prohibits artists from expressing any religious views about marriage that could indicate someone is “unwelcome, objectionable, unacceptable, or undesirable” because of their sexual orientation. The judge is allowing Smith to sue against that portion of the law but is holding the case until the U.S. Supreme Court rules in another ADF case, Masterpiece Cakeshop v. Colorado Civil Rights Commission, involving Colorado cake artist Jack Phillips.

“Artists shouldn’t be threatened with punishment for deciding, as artists always have, which messages they are going to promote or not promote,” said ADF Senior Counsel Jonathan Scruggs. “Because the court’s ruling allows the state to violate the freedom of artists like Lorie to make these kinds of personal decisions, she is considering appeal.”

“Every American, including artists, should be free to peacefully live and work according to their faith without fear of unjust punishment by the government,” added ADF Legal Counsel Kate Anderson. “Just because an artist creates expression that communicates one viewpoint doesn’t mean Colorado can require her to express all viewpoints. Lorie should be allowed to proceed with her legal challenge in full because it’s unlawful to force an artist to create art against her will just because the government disagrees with her beliefs.”

The lawsuit, 303 Creative v. Elenis, which ADF attorneys filed last year in the U.S. District Court for the District of Colorado, explains how the state law runs afoul of various provisions of the U.S. Constitution, including the First Amendment’s Free Speech and Free Press clauses. Specifically, the suit challenges Colorado Revised Statute § 24-34-601(2)(a). The law is the same one the commission used against Phillips and Masterpiece Cakeshop.

Kentucky told to pay attorney fees in same-sex marriage case

A federal judge has ordered Kentucky taxpayers to pay more than $220,000 in legal fees because a county clerk refused to issue marriage licenses to same-sex couples in 2015.

U.S. District Judge David Bunning on Friday ordered the state to pay $222,695 in fees to the attorneys of two same-sex couples and others who sued Rowan County Clerk Kim Davis for refusing to give them marriage licenses. He also awarded $2,008.08 in other costs. Bunning said the county and Davis herself did not have to pay.
