Student group files suit against Arkansas State for limiting speech to 1% of campus

Washington, D.C. - December 15, 2017 - (The Ponder News) -- Alliance Defending Freedom attorneys filed a federal lawsuit Wednesday against Arkansas State University on behalf of the organizers of a student organization, Turning Point USA, to challenge the constitutionality of the ASU five-campus system’s restrictive speech policy. Among other things, the policy limits speech to roughly one percent of the Jonesboro campus.

“Public universities are supposed to be the marketplace of ideas, but those marketplaces can’t function properly when university officials stifle the ability of students to engage in free speech,” said ADF Senior Counsel Tyson Langhofer. “Arkansas State’s speech policies contain provisions that the courts have repeatedly struck down as unconstitutional at other schools. The university can demonstrate its dedication to the free exchange of ideas by modifying its policies to comport with the First Amendment.”

When ASU student Ashlyn Hoggard and another individual with Turning Point USA—a non-partisan organization that educates students about the importance of fiscal responsibility, free markets, and limited government—recently attempted to set up a table outside the student union to generate interest in forming a chapter on campus, an administrator immediately stopped them, citing the university’s speech policy.

That policy unconstitutionally restricts speech activities to small zones on campus that total about one percent of the campus, requires advance permission for students to use the speech zones, and gives university officials free reign to restrict the content and viewpoint of student speech.

“Instead of fostering a marketplace of ideas, Arkansas State is unconstitutionally limiting exposure to ideas,” said ADF Senior Counsel Casey Mattox, director of the ADF Center for Academic Freedom. “Today’s college students will be tomorrow’s judges, legislators, and voters, and with its current policies, Arkansas State is communicating to that generation that the First Amendment doesn’t matter.”

Ethan Nobles, one of more than 3,200 attorneys allied with ADF, is serving as local counsel in the lawsuit, Turning Point USA at Arkansas State University v. The Trustees of Arkansas State University, filed in the U.S. District Court for the Eastern District of Arkansas.

The Free Speech Fairness Act

Washington, D.C. - October 18, 2017 (The Ponder News) -- Alliance Defending Freedom recently sent a letter to congressional leaders on behalf of more than 4,000 religious leaders to inform Congress of the results of a new scientific poll showing that 91 percent of pastors want the freedom to speak freely from the pulpit without the threat of government penalties.

The LifeWay Research poll of 1,000 Protestant pastors, conducted Aug. 30 to Sept. 18, shows that 91 percent agree that “pastors should have the right to speak freely from the pulpit without the fear of being penalized by the government.” In addition, 73 percent agree that “Congress should remove the IRS’s power to penalize a church because of the content of its pastor’s sermons.” The poll has a margin of error of approximately 3.2 percent.

“America’s pastors don’t need a federal tax agency to police their sermons,” said ADF Legal Counsel Christiana Holcomb. “Churches and their pastors have a constitutionally protected freedom to decide for themselves what they want to say or not say. This poll demonstrates that religious leaders don’t want to be burdened by the continual threat of an IRS investigation and potential penalties based simply on what they say from the pulpit.”

“As our letter to Congress explains, the Free Speech Fairness Act would bring the law into conformity with the First Amendment and restore free speech to our nation’s churches,” Holcomb added. “It will fix the Johnson Amendment, a restriction enacted in 1954 that was never intended to affect churches but has been used to intimidate them ever since.”

The Free Speech Fairness Act allows statements to be made in the ordinary course of a 501(c)(3) organization’s regular and customary activities, so long as the organization does not incur more than minimal incremental costs. Thus, the legislation respects free speech without allowing tax-exempt organizations to purchase political ads for or against a candidate for public office. It was introduced in the House by Reps. Steve Scalise (R-LA, 1st) who is Catholic, and Jody Hice (R-GA, 10th), who is a Southern Baptist pastor, and in the Senate by Sen. James Lankford, (R-OK), who is co-chair of the Congressional Prayer Caucus.

“For over sixty years, Section 501c(3) of the Tax Code (the ‘Johnson Amendment’) has forced churches to surrender First Amendment freedoms in exchange for a tax status and empowered federal bureaucrats to dictate what pastors may not say from their pulpits…,” the ADF letter states. “It’s time for Congress to restore a pastor’s right to free speech. The Free Speech Fairness Act does just that. This bill stops the IRS from being speech police, and allows pastors to speak—or not speak—as their conscience requires. America’s pastors have asked for this legislative fix, and you have the opportunity to restore their First Amendment freedoms by including this bill in tax reform.”

According to a Family Research Council Issue Brief, The Johnson Amendment is a tax provision that prevents 501(c)(3) organizations from participating in political campaigns on behalf of, or in opposition to, a candidate for public office. The Johnson Amendment is an unconstitutional restraint on free speech, and is a tool the IRS uses to threaten and censor the First Amendment free speech rights of churches, charities, and their leaders. The Johnson Amendment was passed in 1954 and since then, has caused great confusion and concern regarding what tax exempt organizations and their leaders may say about moral issues and political candidates, partly because of the IRS’s inconsistent enforcement of the law.

In fact, the IRS has even been inconsistent in individual cases. For example, the IRS investigated a tax exempt organization called Catholic Answers because it posted two e-letters questioning whether a presidential candidate who supported abortion should present himself for Holy Communion. Following its investigation, the IRS imposed a fine through excise taxes totaling $101.93 for publication of the two eletters, claiming they violated the Johnson Amendment. However, the IRS later reversed its assessment of the taxes and refunded the fine to Catholic Answers with interest, saying that the political activity was not “willful and flagrant.”

The Illinois Family Institute, which called for constituents to encourage their congressmen to support the Free Speech Fairness Act, stated in a press release, "Some of our best voices in the nation are being silenced when it comes to discussing the critical issues facing the country. It just so happens that every Sunday you can hear one of these voices speaking from the pulpit about salvation and the Bible and Jesus Christ. Unfortunately, too often those preachers fear wading onto ground that is deemed “political.”

Here’s the problem, though. These days almost everything is being made into a political issue – and that’s being done on purpose by those that wish to see an ever-growing government and an ever-shrinking private sector. When everything is politics, then issues like life, marriage, adoption, euthanasia (the list goes on and on) become off limits for discussion inside the church."

The FRC further reported, "For about a decade, pastors have willfully and flagrantly disobeyed the Johnson Amendment on Pulpit Freedom Sunday, a Sunday that is designated each year for challenging the Johnson Amendment, and sent their sermons to the IRS, inviting investigation. However, the IRS has not revoked a church’s tax exempt status for endorsing candidates or political positions from the pulpit.

In 1995, the IRS did revoke The Church at Pierce Creek’s tax exempt letter because the church purchased full-page advertisements in national newspapers. However, because churches are not required to apply for tax exempt status, revocation of the church’s tax exempt letter had no lasting effect on the church’s tax exempt status. Later, in 2005, All Saints Episcopal Church received a letter from the IRS after the pastor criticized President Bush and the Iraq war. But, in 2007, after two years of investigation, the IRS closed the investigation without revoking the IRS letter, but indicated it thought the church was wrong.

These investigations and letters regarding possible violations of the Johnson Amendment continue to have a chilling effect on free speech.

Moreover, organizations like Americans United for Separation of Church and State use the Johnson Amendment as a tool for threatening churches into self-censoring regarding political issues. During election seasons, these organizations send churches letters threatening to report the churches to the IRS if the Johnson Amendment is violated."

Specifically, the Free Speech Fairness Act addresses the shortcomings of the Johnson Amendment, which in 1954 was inserted into the Tax Code by then-Senator Lyndon Johnson. The Johnson Amendment prohibits nonprofits and churches from engaging in any activity that might be interpreted as participating in, or intervening in a campaign on behalf of, or in opposition to, a candidate for public office, including a simple oral or written statement. During the 2016 presidential campaign, President Trump frequently expressed his desire to fix the Johnson Amendment.

Lankford (R-OK) introduced the Free Speech Fairness Act (S.264) on February 7, 2017, as "a bill that gives nonprofits and houses of worship the freedom to speak about government or electoral activity without the threat of retribution from the Internal Revenue Service".

“The federal government and the IRS should never have the ability to inhibit free speech,” said Lankford. “The Free Speech Fairness Act is needed to prevent government intrusion and suppression of free speech by removing a restriction on speech that has existed since 1954. The First Amendment right of free speech and right to practice any faith, or no faith, are foundational American values that must extend to everyone, whether they are a pastor, social worker or any charity employee or volunteer. People who work for a nonprofit still have constitutional rights to assembly, free speech, and free press.”

This bill applies to all entities organized and operating under section 501(c)(3) of the Tax Code. But this legislation would not turn nonprofits and churches into political action committees. The legislation is specifically crafted to maintain the prohibition against 501(c)(3) organizations contributing money to candidates or campaigns.

New Mexico: Comments on Anti-Free Speech Measures Ignored

Albuquerque, NM - October 7, 2017 (The Ponder News) -- Concerned Veterans for America (CVA) released a digital ad focusing on New Mexico Secretary of State Maggie Toulouse Oliver’s refusal to acknowledge and consider the individual comments of hundreds of New Mexicans opposing her anti-free speech measure.

After several public hearings, the Secretary’s office received over 750 comments from citizens opposed to her rule, which will force citizens to publicly list personal information in order to support a cause in the state. However, Secretary Oliver refused to count these comments individually because they were submitted using CVA’s digital tool, which allowed New Mexicans to submit official comments to her office opposing the measure. This was not a distinction the Secretary chose to draw after the first round of public comments, when several citizens submitted comments from a form letter that favored her measure.

“Government officials abusing their power to shut out the voices who disagree. This is exactly why we need to protect freedom of speech,” the ad states. The group urges New Mexicans to take action and oppose the measure by contacting the Secretary’s office.



Concerned Veterans for America (CVA) Policy Director Dan Caldwell issued the following statement:

“Secretary Oliver has shown she is willing to do whatever it takes to limit free speech in New Mexico – even silencing the citizens she was elected to protect. It is startling to see her ignore hundreds of New Mexicans who have every reason to oppose this deeply flawed measure. We share the concerns of citizens who believe the Secretary is overstepping her authority by ignoring New Mexico’s legislative process in an attempt to force this rule into law.”

CVA released a coalition letter of 29 individuals representing 14 different organizations, including former New Mexico Governor Gary Johnson, to abandon her measure.

Governor Martinez vetoed S.B. 96, a similar anti-free speech measure that passed the legislature in April. CVA led a coalition of eleven different organizations and sent a letter to Governor Martinez asking her to reject the measure.

Earlier last year, CVA started “Defend the First,” a project dedicated to beating back threats against free speech at the state and federal level.

85 percent of Americans support free speech for all, even the unpopular, 63 percent oppose political violence by Antifa

Washington, D.C. - September 6, 2017 (The Ponder News) -- A new public opinion survey conducted by McLaughlin and Associates found the vast preponderance of those polled favors the constitutionally guaranteed right to freedom of expression—and rejects the notion that some should be denied that right. This finding confirms that of a recent Rasmussen poll. Together, these distinguished pollsters’ data represent a powerful warning for government officials, lawmakers and activists intent on restricting free speech if, in their view or others, it gives “offense.”

Key results of the McLaughlin survey conducted last week included the following:

  • By a margin of 85 percent to 8 percent, respondents said that, in the aftermath of the riots in Charlottesville, Virginia, last month, “all Americans are entitled to free speech,” not “just some of us.”
  • 84.9 percent of respondents regarded “freedom of speech as a fundamental right.” Only 9.3 percent thought “it should be restricted if it offends some people.”
  • 63 percent opposed the violent leftist group Antifa’s attempts to silence those whose speech it disagrees with, while only 21 percent supported Antifa.
  • A plurality of 42.8 percent opposed the use by internet companies of a list compiled by the Southern Poverty Law Center (SPLC) that accuses “many mainstream conservative groups” of engaging in “hate speech.” Only 31.8 percent supported such use.

  • Frank J. Gaffney, the president of one of those conservative groups, the Center for Security Policy, responded to the latest poll by observing:

    “Americans clearly understand the dangers associated with attempts to censor speech and other forms of expression. Today, it might be someone else who is being silenced. Tomorrow, it may well be you. And, to the extent that organizations funded by the likes of radical leftists like George Soros—including the Southern Poverty Law Center and Antifa—are allowed to act as the arbiters of who is allowed to communicate, about what and how, it’s just a matter of time before many millions of us are gagged.

    “The Left and the Islamist allies it enables have clearly crossed a line,” Gaffney continued. “Organizations like the SPLC, the Anti-Defamation League and the Council on American-Islamic Relations are engaged in political warfare pure and simple, aimed at denying their opponents’ free speech rights in academia, in the media, on the internet and in the public square. Politicians—and most especially Republican ones—acquiesce to such anti-constitutional conduct at their own electoral peril.”

    Indeed, the wake-up call to public office-holders offered by the McLaughlin and Rasmussen polls on free speech could hardly be more timely. After all, in April 2017—even before the bloodletting in Charlottesville spawned relentless, bipartisan demands for limiting “offensive” expression—the U.S. Senate unanimously approved S.Res. 118, co-sponsored by Sens. Marco Rubio, Dianne Feinstein and Kamala Harris. It was described as “a resolution condemning hate crime and any other form of racism, religious or ethnic bias, discrimination, incitement to violence, or animus targeting a minority in the United States.”

    Animus is a sweeping term that can include such highly subjective sentiments as hostility, ill-feeling and strong dislike. The resolution also called for federal investigation of not just hate crimes but “hate incidents” and “hate threats,” both undefined. A counterpart resolution is awaiting action in the House of Representatives, as are actual bills with names like the “NO HATE Act” in both the Senate and the House.

    Speaking of Soros and his ilk, the McLaughlin poll also found that by a nearly two-to-one margin, 48.5 to 26.3, respondents agreed that President Donald Trump should not employ “subordinates who can be shown to be colluding with George Soros, Barack Obama or others associated with them to undermine President Trump’s administration.” Among Trump voters, the spread was even wider, 67.6 percent to 18.4 percent.

    The Center for Security Policy strongly agrees with the prevailing sentiments documented in the McLaughlin and Associates poll. It calls on every American who loves freedom to exercise their First Amendment rights. That should, among other things, entail insisting that their lawmakers uphold freely sworn oaths to “defend the Constitution against all enemies, foreign and domestic.”

    Americans for Limited Government President Rick Manning today issued the following statement in response to a poll by Center for Security Policy/Eagle Forum/McLaughlin & Associates showing overwhelming support for the First Amendment and free speech rights:

    “At a time when the First Amendment is under unprecedented assault by the institutional left, the American people have proven once again that they are not willing to trade their essential liberty to avoid being potentially offended, with 85 percent unequivocally supporting free speech rights for everyone, including those they disagree with. Particularly telling is the result that nearly two-thirds of Americans are opposed to the radical Antifa movement, which supports and engages in violence against those they disagree with.

    “The fact that the First Amendment maintains broad suppport across America clearly shows that freedom runs through the very DNA of the American people, and those who seek to undermine basic freedoms or provide aid and comfort in that effort, do so at their own political peril.

    “Private companies like Google, Facebook, Twitter and Paypal need to proceed cautiously as they consider becoming arbiters of appropriate speech on the Internet, because if Americans believe that they have relinquished their neutrality, they will lose their dominance to market alternatives.”

    CVA URGES ACTIVISTS TO ATTEND HEARING ON SECRETARY OLIVER’S UNCONSTITUTIONAL ANTI-FREE SPEECH MEASURE

    Santa Fe, NM - September 3, 2017 (The Ponder News) -- New Mexico Secretary of State Maggie Toulouse Oliver will hold a hearing on her revised, unconstitutional anti-free speech measure in Santa Fe. The hearing will give citizens the opportunity to share their opinions about the measure.

    Secretary Oliver recently announced revisions to her formerly-proposed measure forcing citizens who support causes to list their names and personal information publicly – leaving them open to harassment and intimidation. This effort represents a massive overreach by Secretary Oliver, who does not have the authority to implement such drastic changes to New Mexico’s laws.

    Concerned Veterans for America (CVA) Policy Director Dan Caldwell issued the following statement:

    “Secretary Oliver is circumventing the legislative process to push forward a measure that would inhibit the First Amendment rights of citizens. It’s important that New Mexicans are given the opportunity to voice opposition to this deeply flawed and unconstitutional measure. We’ve seen an overwhelming response to Oliver’s rule from New Mexicans who have serious concerns about the impact it would have on their right to free expression. This measure will limit open debate in New Mexico and we encourage citizens of the state to stand up for their rights today.”

    After Secretary Oliver released her revised measure, CVA launched a digital tool that allows New Mexicans to submit comments to her office.

    In July, CVA joined a coalition of 29 individuals representing 14 different organizations that submitted a letter to the Secretary asking her to end her attack on free speech in New Mexico. Former New Mexico Governor Gary Johnson was among the signers urging the Secretary to abandon her measure.

    Earlier this year, Governor Susana Martinez vetoed S.B. 96, a similar anti-free speech measure that passed the legislature in April. CVA led a coalition of 11 different organizations and sent a letter to Governor Martinez asking her to reject S.B. 96. The group also launched a targeted digital campaign, including a tool which allowed New Mexico constituents to contact Governor Martinez directly via email, Facebook, Twitter, and phone to warn her about the dangers of S.B. 96.

    Last year, CVA launched “Defend the First,” a project focused on protecting the free exchange of information and ideas at the state and federal level.

    CCV SUPPORTS GOODMAN/BRENNER CAMPUS FREE SPEECH ACT

    Columbus, OH - September 3, 2017 (The Ponder News) -- Citizens for Community Values, an Ohio Christian advocacy group that defends free speech and religious freedom, participated in a press conference held by Ohio State Representatives Wesley Goodman & Andrew Brenner today announcing their intention to introduce the Campus Free Speech Act. The proposal will protect the free speech rights of students on public universities throughout Ohio.

    According to research conducted by the Foundation for Individual Rights in Education (FIRE), which maintains an exhaustive list of incidents of free speech violations on campus, “freedom of speech is under continuous threat at many of America’s campuses, pushed aside in favor of politics, comfort, or simply a desire to avoid controversy.”

    “Colleges and universities are supposed to be the marketplace for ideas,” said Aaron Baer, President of Citizens for Community Values. “Unfortunately, throughout the country, many students and student organizations are not given the opportunity to participate in open and honest discussion. The Campus Free Speech Act ensures all university speech codes respect the first amendment rights of Ohio students.”

    According to FIRE’s ratings, 11 universities in Ohio have speech codes that restrict protected expression or, by virtue of their vague wording, could too easily be used to restrict protected expression. One university has codes that clearly and substantially restrict freedom of speech.

    The Campus Free Speech Act restates and codifies a student’s right to “engage in free expression.” It guarantees to members of the campus community, “clear, content neutral rules for conduct of expression.” The bill requires public universities to adopt and promulgate a policy saying, “it is not the proper role of a state institution of higher education to shield individuals from expression.”

    The Campus Free Speech act also codifies current Constitutional free speech law by limiting the university’s authority to segregate expression from certain places and audiences. It specifically states that “Offense or irritation taken to the content of speech shall not be considered an actionable harm under any circumstances.”

    More Opinion from House Members on Charlottesville

    House Representative Vicky Hartzler (R-MO, 4th) made a heartfelt statement about the violence in Charlottesville, saying, “Over the past few days America has witnessed the disturbing events in Charlottesville and the racism and violence that continues to inflict harm on our nation. It breaks my heart that today's young generation is still having to witness this unAmerican way to settle disagreements. Racism is not acceptable in our society in any form and should not be tolerated. It is one thing to have disagreements on the validity of historical monuments but violence is not the answer. It cannot be tolerated. This is not representative of America or the values that we hold dear.”

    I appreciate how she refused to name either side as sole culprit. Of course, not everyone had the same view. House Representative Alcee L. Hastings (D-FL, 20th) shot back, "Today’s comments by President Trump were completely appalling. What took place in in Charlottesville was an act of domestic terrorism, not a two-sided affair." I'd like to ask Mr. Hastings if he was there at the rally, or did he speak to anyone at the rally to make this assumption. Just because there where White Nationalists present did not mean that there weren't black bigots taunting and instigating them, throwing feces, urine and spraying pepper spray.

    "The President has lost all moral authority to lead this nation," he continues. It takes a lot of morals to look at both sides of an issue before deciding which bandwagon to jump on. "By continuing to stand with white supremacists promoting the abhorrent, anti-democratic ideology of inequality, injustice, and fascism, President Trump is fueling the fires of hate." Nowhere did Trump say he stood with white supremacists. What he said was that the violence was the responsibility of BOTH sides, and BOTH sides need to be held accountable (not in those exact words). "This is completely outrageous, and every single elected representative to Congress, regardless of party, must hold him to account." Go ahead, and when you do, make sure you bring the unedited version of the Youtube video in which Trump speaks to the press about Charlottesville.

    House Representative Brian Higgins (D-NY, 26th) made his viewss known by saying, “Over the past several months, a regular barrage of words and actions coming from those entrusted to lead have demonstrated disrespect for women, refugees, transgender service members and others based on race. We are witnessing a dangerous and dismissive attitude toward some people as less accepted and less valued than others. This display of intolerance is hurtful to individuals and the noble principles that genuinely make our nation great.

    “I am proud to call Buffalo -- the ‘City of Good Neighbors’ -- my home. As a country and as humans we could all benefit from being more neighborly. Each of us face our own struggles but they are better overcome when we are united rather than divided. Each of us bring our own strengths as individuals but we are wise to recognize we are significantly stronger together.

    “Genuine leadership doesn’t embolden hate; instead, it should promote kindness and understanding. These exhausting distractions tear us apart, preventing us from working together and making real progress. We need less confrontation and more collaboration, fewer outbursts and more outcomes, and less heat and more light.”

    Promoting kindness and understanding does not mean shutting out the voices of those who are different from us. It means being willing to listen to what they have to say, even if you don't like them, and finding a way to accommodate that won't hurt either side of the issue, and may even help both. THAT, Mr. Higgins, is what TRUE leadership does. Demonizing someone who thinks differently than you do doesn't do anything to help the relationship. The next step after demonization is extermination, and if you would look at history and learn from it, you will see the truth in what I have just said. But, I digress, most of those who think like you are for getting rid of any reminders of that history.

    House Representative French Hill (R-AR, 2nd) condemned what happened by saying, ""During World War II, my father-in-law helped to liberate Buchenwald concentration camp. He bore witness to Nazi terror – a terror that started with an ideology of hate and superiority based upon race and creed. He and so many other Americans and Allies fought against that ideology, which was an affront to American values and continues to have no place in our civil society. I reject, in the strongest terms possible, the speech of hate and bigotry of white supremacists and others. It's repugnant and un-American. I condemn acts of domestic terror as the tools of cowards. Let's pray for civil discourse in our country, and my thoughts are with the community, those hurt, and those grieving over loss and injury."

    My granddaddy was one of 300 soldiers who rode in a ship to Normandy. He fought for freedom so everyone, including his wife (who he encouraged to get her high school diploma, so she could better help with the war effort at home), could have the opportunity to better themselves and the world around them. When it came time to come home, there were only 73 men from the same ship who survived. He fought the war every day of his life since then. I would not be here today if he hadn't survived -- and I will not let his sacrifice be in vain by picking and choosing who has rights regardless of race, creed, religion, color or nationality, and that includes those who wish to preserve their heritage...even if I don't agree with their views. The First Amendment was not written for popular opinion holders.

    House Representative Jim Himes (D-CT, 4th), who obviously has no idea what the President said, retorted, "White supremacy in any form has no place in our society, our politics or our civil discourse. It takes surpassing ignorance, total moral bankruptcy and a pathetic sense of entitlement to have marched with the KKK and neo-Nazis in Charlottesville. Period, full stop, and I am shocked I need to say so, much less to the President of the United States.

    "I condemn the violence in Charlottesville and the hateful ideology behind the late night march and the daytime rally, and I stand aghast with the rest of the nation and leaders in both parties at the President's equivocation on this fundamental principle of decency. The President betrays the ideals and legacy of the country he leads - a country which paid with the lives of millions of its people to defeat white supremacy and Nazism."

    While I agree with Himes about the characterization of those who marched with the KKK, I would like to extend that same characterization to the BLM group who decided that the KKK didn't have First Amendment rights and disrupting their Freedom of Assembly, which is also a First Amendment right. As far as what he said about the President, the President did not betray anything. He is not going to condemn one without condemning the other, and he is working to make those guilty of breaking the peace accountable on BOTH sides.

    Lincoln Memorial vandalized with graffiti, park police say

    National Park Police (NPS) said they are working to remove graffiti from the Lincoln Memorial that was discovered before dawn on Tuesday.

    "[Expletive] law" was written in red spray-paint on one of the columns.

    A monument preservation crew is using a mild, gel-type paint stripper that is safe for use on historic stone, CBS affiliate WUSA-TV reports. The crew will evaluate after each application, but treatments will be applied as necessary until all of the graffiti is gone.

    Another act of vandalism in silver spray paint was discovered on a Smithsonian wayfinding sign in the 1400 block of Constitution Avenue, the NPS told WUSA-TV.

    Congressman Curt Schrader stated on a Facebook post: "The racist scenes from Charlottesville last weekend were incredibly disturbing and have absolutely no place in our society.     Congressman Bill Flores (R-TX, 17th) put in his 2-cents worth by stating, "The bottom line is that white supremacists and neo-Nazis are evil and should be stopped. It is time for Americans to stand united as a nation to counter hatred and division of any kind."
    While his statement did say "hatred and division of any kind", it still maintained the focus that the white suprmacists were the only ones at fault for what happened in Charlottesville.

    Congressman Denny Heck (D-WA, 10th) is calling for the firing of Steve Bannon. "Actions speak louder than words, Mr. President. Fire Steve Bannon as I asked you to do Saturday morning, and show us you are serious about fighting the ugly extremism and racist ideology of the KKK, neo-Nazi groups, and other white supremacist hate groups," He said in a Facebook post calling for leadership. He, true to form, forgot to mention that there are those in congress who sympathize with Black Lives Matter.

    Local residents protest Virginia violence

    A group of local residents came together to make protest the violence that horrified the country this weekend.

    More than a dozen demonstrators gathered in front of the U.S. Post Office at 3318 S. 74th St. in Fort Smith on Sunday in response to the death and injuries that took place in Charlottesville, Va. on Saturday. A car plowed into a crowd of people peacefully protesting a white nationalist rally, killing one person and injuring at least two dozen more. The white nationalists gathered to protest plans to remove a statue of the Confederate Gen. Robert E. Lee.

    A helicopter crash that killed the pilot and a passenger later Saturday afternoon outside the town was also linked by Virginia State Police to the rally.

    Sunday’s event, which began at 3 p.m., was organized by Indivisible Fort Smith & Western Arkansas. Those involved held up signs with phrases that spoke out against racism and hatred as people drove by on South 74th Street, some of whom honked their horns in approval. Other demonstrators took to chanting, shouting slogans such as “No more hate,” “No more Charlottesville,” and “Let’s make a difference” to all who passed by.

    Upon returning to the nation’s capital, Congressman Denny Heck (WA-10) added his support to three bills that prevent President Trump’s harmful executive order from being administered by the United States government.

    If passed, the Statue of Liberty Values Act (SOLVe Act) would prevent the executive order from having any force of law and prohibit any federal funds or fees from being used to carry it out. The Freedom of Religion Act states that the United States could not bar foreigners from coming to the United States on the basis of their religious beliefs. The No Religious Registration Act would stop the government from creating or using a database of religious affiliation for the purpose of surveillance or of classifying U.S. citizens, lawful permanent residents, and visa seekers.

    The U.S. House of Representatives passed Congresswoman Jaime Herrera Beutler’s bipartisan bill to permanently extend a decades old fishery management agreement that has been vital to Washington state’s Dungeness crab fishery. The bill passed overwhelmingly by a vote of 388-0.

    Congressmen Jody Hice (GA-10) and Steve Scalise (LA-01) introduced H.R. 781, the Free Speech Fairness Act, which would amend the U.S. tax code to restore free speech for 501(c)(3) organizations including churches, nonprofits, and educational institutions, so long as they are (1) made in the ordinary course of the organization’s regular and customary activities in carrying out its tax-exempt purpose, and (2) any expenditure related to this are de minimis. A companion bill, S.264, was introduced by Senator James Lankford (R-OK) in the Senate.

    The House passed H.J.Res. 40, a resolution to disapprove of the Social Security Administration’s (SSA) rule to share information with the National Instant Criminal Background Check System (NICS) on individuals who receive Disability Insurance benefits. Following passage of the resolution, Congressman French Hill (R-AR, 2nd) released the following statement:

    “Having a disability and seeking help through the federal government should not be a factor in considering whether or not someone is mentally capable of owning or purchasing a firearm. This rule from SSA serves no real purpose other than to limit the Second Amendment rights of the American people, and I am confident the administration and Congress will be able to reverse this ill-conceived rule.     U.S. Representative Richard Hudson (NC-08), author of bipartisan legislation that passed the House with a veto-proof majority and aimed to strengthen vetting of Syrian and Iraqi refugees, released the following statement on President Trump's exceutive order on refugees:

    "At a time of grave security threats, President Trump is right to pause the flow of refugees from countries where terrorism is rampant until we can properly vet them and implement additional screening for individuals traveling to and from these countries. The facts are President Obama's own intel official told us ISIS is trying to infiltrate the refugee program and his Homeland Security Secretary and FBI Director told us we can't properly vet all of these refugees. I do have concerns that the executive order has caused confusion for those with green cards and will work with my colleagues and the administration to clarify it."

    Water, Power, and Oceans Subcommittee Ranking Member Jared Huffman (D-CA) and House Natural Resources Committee Ranking Member Raúl M. Grijalva (D-AZ) sent a letter to President Trump today urging him to rescind the “one in, two out” executive order on federal rules issued earlier this week and an earlier memorandum instituting a regulatory freeze. These two actions have the combined effect of preventing the National Marine Fisheries Service (NMFS) from opening or closing commercial and recreational fishing seasons in federal waters; making in-season adjustments to conservation and management measures; or implementing new or revised fishery management plans without first seeking a waiver from the Trump administration.
