Investigations into Improper PPP Funding for Planned Parenthood Urged by Lawmakers

Pierre, SD - May 30, 2020 - (The Ponder News) -- U.S. Sen. Mike Rounds (R-S.D.) joined a number of his colleagues in two different letters urging full investigations into improper Paycheck Protection Program (PPP) funding for Planned Parenthood. The first letter, led by Sen. Tom Cotton (R-Ark.), was sent to Attorney General Bill Barr to urge the Department of Justice to investigate whether dozens of Planned Parenthood affiliates across the country applied for and received PPP loans despite knowing they were ineligible to apply.

A second letter, led by Sen. Marco Rubio (R-Fla.), was sent to Jovita Carranza, Administrator of the Small Business Administration (SBA), urging her to conduct a full investigation into how 37 Planned Parenthood affiliates applied for and improperly received a total of $80 million in loans from the PPP.

Under the statutory text of the CARES Act, organizations like these affiliates were expressly prohibited from receiving PPP funds. Additionally, the Small Business Administration confirmed last month that its standing affiliation rules apply to the new PPP, which excludes organizations like Planned Parenthood that employ its type of governance and affiliation structure and exceed the cap on total employees.

Excerpt of the letter to the DOJ: “The Paycheck Protection Program established by the CARES Act was designed by Congress to help struggling small businesses and nonprofit organizations by giving them access to low-cost loans for expenses like keeping their employees on payroll during this pandemic. It was not designed to give government funds to politicized, partisan abortion providers like Planned Parenthood. The funds in the program are not unlimited, and were depleted once already because of high demand. Planned Parenthood fraudulently taking tens of millions of dollars that were intended to help keep those small businesses and nonprofit organizations afloat cannot stand and must be addressed,” wrote the senators.

Excerpt of the letter to the SBA: “It has come to our attention that affiliates of Planned Parenthood improperly applied for, and received loans, through the program. While we appreciate the Small Business Administration’s (“SBA”) efforts to promptly cancel those loans, the circumstances under which they were made merit further investigation of possible wrongdoing,” the senators wrote. “These circumstances require a full investigation in order to determine whether there was wrongdoing, and we urge that any such misconduct be prosecuted to the fullest extent of the law. We urge that the SBA promptly open an investigation into how these loans were made in clear violation of the applicable affiliation rules and if Planned Parenthood, relevant lenders, or staff at the SBA knowingly violated the law, and that appropriate legal action be taken if so.”

The advancement of unfettered abortion openings is a bedrock position of the Democratic Party. Truth be told, party leaders have contended that such a position must be a litmus test for fitting the bill to try and keep running as a Democratic candidate for office. At any rate, they’re straightforward about their position, if deplorably off-base.

Thus, Planned Parenthood is just about a segment of the Democratic Party. It should be from that organization and the Democrats are joined at the hip. Given the activities of Planned Parenthood, that really ought to be to the Democrats’ disgrace.

A standout amongst the most hostile practices of which Planned Parenthood has been blamed has been the deal for the body parts of aborted babies. The reality of the matter is that once they’ve killed the kid, no further damage is accessible for the abortion mill to cause. However, treating dead babies like some other animal is frightful. What’s more, President Trump has had the FBI launch an examination of Planned Parenthood and claims of this disgusting demonstration. Keeping in mind that despite everything anybody question, Mr. Trump descends in favor of expert life.

Judge Strikes Down Indiana Law Against Selling Aborted Baby Parts

Indiana received bad news this Christmas season when a judge struck down part of a state law prohibiting the trafficking of aborted baby body parts.

The Indiana Lawyer reports Chief Judge Jane Magnus-Stinson of the U.S. District Court for the Southern District of Indiana sided with Indiana University researchers on Friday, arguing that most of the law was unconstitutional.

The university sued the state in 2016 after lawmakers passed a law prohibiting the acquisition, receipt, sale or transfer of aborted baby body parts. Violations would be a felony.

DOJ Investigating Planned Parenthood

Washington, D.C. - December 12, 2017 - (The Ponder News) -- The Department of Justice (DOJ) is now investigating Planned Parenthood regarding the sale of aborted baby body parts for profit. Last Friday, DV Biologics and DaVinci Biosciences, which purchased aborted baby body parts from Planned Parenthood abortion clinics, agreed to pay $7.785 million and cease all business operations in California.

Justice Department Assistant Attorney General for Legislative Affairs Stephen Boyd sent a letter to the Senate Judiciary Committee requesting unredacted documents underlying a 2016 investigation by the committee into the exchange of human fetal tissue that had been donated for research by women who got abortions.

The Senate Judiciary Committee and the House Select Investigative Panel on Infant Lives both referred Planned Parenthood and the organ procurement companies to the Department of Justice for criminal investigation and prosecution. Based on its findings, the Judiciary Committee’s report, “Human Fetal Tissue Research: Context and Controversy,” concluded that the executive branch had failed for years to exercise oversight on the tissue transfer process and created a situation where costs and fees were not properly accounted for. The report recommended that the Justice Department “fully investigate” the fetal tissue practices of Planned Parenthood, its affiliates, and three companies involved in the sale of the tissue for potential crimes.

The DOJ investigation comes as a result of the 14 undercover videos produced by the Center for Medical Progress that show Planned Parenthood officials trafficking body parts of aborted babies, flippantly negotiating prices and abortion methods to sell aborted baby hearts, lungs, livers and brains. Liberty Counsel represents Sandra “Susan” Merritt, one of the two journalists with the Center for Medical Progress, whose undercover work exposed Planned Parenthood’s barbaric practices of harvesting organs from aborted babies and selling them to organ procurement organizations, including StemExpress, LLC, Advanced Bioscience Resources, Inc. and Novogenix Laboratories, LLC., for profit. Cecil Richards, Planned Parenthood’s CEO, has admitted before Congress that the recordings were made in public places and were not confidential.

The sale or purchase of human fetal tissue is a felony punishable by up to ten years in prison or a fine of up to $500,000.

“This investigation of Planned Parenthood is long overdue,” said Mat Staver, Founder and Chairman of Liberty Counsel. “The Obama administration shielded Planned Parenthood from scrutiny. The smothered voices of innocent children cry out for justice. There is no amount of money that can bring back all the precious lives lost due to the despicable actions of Planned Parenthood and these organ procurement companies. Two of the organ procurement companies have now faced the consequences of their barbaric acts. Now it is time for Planned Parenthood to face justice,” said Staver.

Daleiden Wins Legal Victory in University of Washington Fetal Tissue Investigation

Seattle, WA - August 16, 2017 (The Ponder News) -- On August 14, 2017, in Seattle, WA, Thomas More Society attorneys have won an appeal on behalf of undercover journalist David Daleiden, against a group of University of Washington research lab employees and abortion facility personnel. The government employees and the abortion personnel are seeking to force heavy redactions in public documents about their work procuring, processing, and transferring the organs and tissue of aborted human fetuses, in connection with the school’s taxpayer-funded Birth Defects Research Laboratory.

The Washington state Public Records Act requires full disclosure, but a lower court ordered the redactions, holding that the First Amendment required them. However, a panel of the U.S. Court of Appeals for the Ninth Circuit has now reversed that decision, unanimously holding that the District Court had not provided the facts and law sufficient to make a “clear showing” that the U.S. Constitution requires the heavy censoring of these public records. Thomas More Society Special Counsel Peter Breen, who argued the appeal, explained that the order, delivered August 14, 2017, sends the case back to the U.S. District Court for the Western District of Washington, in Seattle, which must now specify and justify its decision.

“This case began when our client requested public records from the University of Washington about its publicly funded research lab,” stated Breen. “Mr. Daleiden’s broad-ranging investigation into the trafficking of aborted fetal remains led him to look into the University of Washington’s fetal tissue research and acquisition practices. He asked that names and personal contact info be redacted from the records, but the abortion advocates and government employees pressed for full censorship, even of entity names, job titles, and departments within the university. Such heavy redactions render these public documents useless for investigative purposes.”

The employees, identifying themselves legally as Jane Does and John Does, sued in August 2016, claiming they “would likely face threats, harassment, and violence” if the records were disclosed, even with names and personal contact info redacted. The District Court entered its preliminary injunction requiring heavy redactions on November 15, 2016, and the case has been stayed since then, pending the result of Daleiden’s appeal.

Senior Circuit Court Judge A. Wallace Tashima, and Circuit Judges Jacqueline H. Nguyen and M. Margaret McKeown, heard the arguments and issued the unanimous order reversing the decision by the District Court. In particular, the appellate judges criticized the lower court for misapplying case law in granting a Motion for a Preliminary Injunction.

“The Court of Appeals, by reversing this decision and remanding this case back to District Court, has prevented a serious threat to the public’s right to know how their tax dollars are being spent,” added Breen.

In Pursuit of Justice: Do Away with Planned Parenthood Gag Order!

Washington, D.C. - August 11, 2017 (The Ponder News) -- David Daleiden and The Center for Medical Progress (CMP) has petitioned the Supreme Court to appeal the unconstitutional gag order issued by Judge William Orrick III – an Obama-appointed judge with numerous explicit ties to Planned Parenthood – against the publication of undercover footage of top-level Planned Parenthood leaders. Daleiden explained his appeal by claiming there is information being suppressed that is of significant public interest and concern.

David Daleiden and his team contend the gag order restricts their First Amendment rights and was ordered at “the behest” of Planned Parenthood and the National Abortion Federation. The appeal was made weeks after Daleiden and his team was ordered to pay a $137,000 fine and held him in contempt in court. Rep. Trent Franks reacted with the following statement:

The virus has been identified as North American wild bird lineage H7N9 HPAI based upon full genome sequence analysis of the samples at the NVSL. All eight gene segments of the virus are North American wild bird lineage. This is NOT the same as the China H7N9 virus that has impacted poultry and infected humans in Asia. While the subtype is the same as the China H7N9 lineage that emerged in 2013, this is a different virus and is genetically distinct from the China H7N9 lineage.

Planned Parenthood, Foster Children, Law Enforcement, Copyright Office, Department of Education, Central America, Pre-Existing Conditions, OIRA, Postal Employees, regulations, Obamacare, ALS, EPA, and Medicare

Legislation was passed on Thursday (February 16) that eliminates an Obama Administration rule prohibiting the redirecting of Title X funding away from Planned Parenthood to health care centers that don’t provide abortions. The bill, H.J. Res. 43, uses the Congressional Review Act to eliminate the ‘midnight rule’ from the Department of Health and Human Services (HHS) that was finalized just two days before the end of President Obama’s second term. That regulation blocks states from diverting Title X family planning grants away from Planned Parenthood to community health centers, county health departments, or other providers. Congresswoman Carolyn B. Maloney (NY-12), member of the Congressional Pro-Choice Caucus and steadfast pro-choice advocate, claimed it would restrict a woman’s access to abortion.

Congresswoman Lawrence introduced H.R. 1069, “The Timely Mental Health for Foster Youth Act”, with five original cosponsors. This bill would require mental health screenings for all children entering foster care. The legislation calls for an initial mental health assessment to take place within 30 days of a child entering foster care with a comprehensive follow-up assessment if deemed necessary.

On Tuesday, Feb. 14, the Jacksonville City Council voted to amend the city’s human rights ordinances to protect gay and transgender people from discrimination.

After The Hill reported that the White House Transition Team has proposed a budget blueprint, which would eliminate the Office of Community Oriented Policing Services (COPS), Representative Sean Patrick Maloney joined local civic and law enforcement officials to call on President Donald Trump to keep his campaign promise to support our law enforcement community and refrain from eliminating the federal Community Oriented Policing Services (COPS) Office. In addition, Rep. Maloney wrote a letter to the President asking him to protect the program. The Department of Justice’s (DOJ) COPS program provides investments to allow state and local police departments to hire police officers, test new strategies, and acquire cutting-edge technology.

The House of Representatives unanimously passed H.R. 387, The Email Privacy Act. This bill requires the federal government to acquire warrants before accessing an individual’s digital content.

Congressman Tom Marino (PA-10) and Congresswoman Judy Chu (CA-27) reintroduced (H.R. 890) the Copyright Office for the Digital Economy Act or the CODE Act. The CODE Act makes several improvements to the copyright office that reflect a consensus across various industries and public interest groups.

These improvements include:

  • Housing the Copyright Office in the Legislative Branch
  • Requiring ongoing technology studies to ensure the office remains current with technology to be more user friendly which includes improving upon the searchable database
  • Establishing an advisory board representing a variety of interests and views tasked with providing the office with candid feedback on the current field of copyright to ensure neutrality and objectivity
  • Technical provisions to ensure a more seamless transition away from the Library of Congress

    Representative Thomas Massie introduced H.R. 899, a bill to abolish the federal Department of Education. The bill, which is one sentence long, states, “The Department of Education shall terminate on December 31, 2018.”

    Reps. Michael T. McCaul (R-TX), Norma J. Torres (D-CA) and John R. Moolenaar (R-MI), Eliot L. Engel (D-NY), and Albio Sires (D-NJ), introduced a resolution in the House of Representatives to reaffirm the United States Congress’s commitment to fighting corruption in Central America.

    The resolution states that efforts to fight corruption must remain at the center of U.S. policy in Central America, that the Mission to Support the Fight against Corruption and Impunity in Honduras (MACCIH) and the International Commission against Impunity in Guatemala (CICIG) are important contributions to these efforts, and that the governments of Honduras, Guatemala, and El Salvador should cooperate with MACCIH and CICIG and the Attorneys General of the region.

    Representative Paul Mitchell (MI-10) introduced the OIRA Insight, Reform, and Accountability Act (H.R. 1009) to strengthen congressional insight and accountability over the regulatory process by putting the Office of Information and Regulatory Affairs (OIRA) into statute.

    Representatives David B. McKinley, P.E. (WV-1) and Gerry Connolly (VA-11) introduced H.R. 942, the Postal Employees Appeal Rights Amendments Act to expand U.S. Merit Systems Protection Board (MSPB) appeals rights to mid-level U.S. Postal Service Management. Under current law, approximately 7,500 USPS employees do not have this protection.

    U.S. Representative Martha McSally introduced legislation to mandate federal agencies report to Congress about regulations that did not comply with the Congressional Review Act (CRA). According to the text of the CRA, regulations that did not comply with mandated reporting requirements may be subject to overrule by Congress with majorities in both chambers.

    Congressmen Seth Moulton (D-MA) and Peter King (R-NY) re-introduced The ALS Disability Insurance Access Act, bipartisan legislation they spearheaded to ensure that amyotrophic lateral sclerosis (ALS) patients are provided vital support and benefits in a more timely manner. The legislation would waive the Social Security Disability Insurance (SSDI) five-month waiting period for people living with amyotrophic lateral sclerosis (ALS), commonly referred to as Lou Gehrig’s Disease.

    Congressman Markwayne Mullin (OK-2) introduced H.J.Res. 59, a Congressional Review Act (CRA) joint resolution that blocks the Environmental Protection Agency’s (EPA) Accidental Release Prevention Requirements: Risk Management Programs under the Clean Air Act Rule (RMP rule).

    The Congressional Review Act, passed in 1996, allows Congress to vote to overturn any regulation during a period of 60 days after the regulation was created. Regulations created at the end of the Obama Administration are subject to be overturned, so long as it is within the 60-day “in-session” period of Congress.

    Congressman Tim Murphy (R-PA) and Congressman Ron Kind (D-WI) reintroduced bipartisan legislation to improve the Medicare Secondary Payer (MSP) statute and clarify its application to the Medicare Prescription Drug (Part D) program.

    The Secondary Payer Advancement, Rationalization, and Clarification (SPARC) Act, replaces ambiguous and uncertain Part D MSP requirements with a simplified, commonsense approach that provides beneficiaries with improved access to the care. The legislation also allows Part D Prescription Drug Plans to recover prescription drug cost deficits more quickly from primary payers.
