OCC Proposal Could Greenlight Predatory Lending Schemes

A coalition of more than 100 organizations yesterday submitted a public comment in opposition to a proposed rule from the Office of the Comptroller of the Currency (OCC) that would make it easier for payday and other high-cost lenders to use banks as a fig leaf to offer predatory loans at interest rates of 100 percent APR or higher that are prohibited under state rate cap laws. This scheme is known as “rent-a-bank” or “rent-a-charter.”

“Since 2015, Americans for Limited Government has led the charge to reform the Affirmatively Furthering Fair Housing regulation to remove any requirements for localities that take community development block grants to make changes to local zoning. We are pleased that HUD Secretary Ben Carson produced a final rule that protects local zoning prerogatives while encouraging evaluation as to whether regulations have an adverse impact on housing affordability. This rightly stops the nationalization of zoning while still encouraging fair housing, once again placing primacy on cities and counties to make the best decisions for their communities. The last thing Americans needed was Washington, D.C. bureaucrats dictating zoning requirements based on Census maps, and Secretary Carson successfully ended this overreach.”

Nonresidential construction backlog has generally been trending lower since the spring of 2019, but as a practical matter, this represents little cause for concern,” said ABC Chief Economist Anirban Basu. “There are at least two reasons for this. First, backlog reached a record high of 9.5 months in March 2019, buoyed by seasonal factors and an economy that had yet to feel the full effects of ongoing trade disputes. Second, for much of 2019, those who consume construction services, including developers, were faced with elevated levels of uncertainty due to America’s trade disputes with China, a rapidly softening global economy, a stock market that had suffered losses and exhibited substantial volatility in late 2018, an inverted yield curve and a weakening manufacturing sector.

This statute has the potential to chill the everyday work of immigrants’ rights advocates and service providers who often assist undocumented individuals, their families, and their communities. Wyden, Merkley Urge Increased Funding for Affordable Housing

Washington, D.C. - April 17, 2019 - (The Ponder News) -- U.S. Senators Ron Wyden and Jeff Merkley this week joined 39 of their colleagues in sending a bipartisan letter to the Senators who lead the housing subcommittee urging increased funding for the Section 4 Capacity Building program. The Department of Housing and Urban Development’s (HUD) Section 4 Program works with local community development organizations to improve affordable housing, finance small businesses, and provide for other community needs.

In their letter, the Senators wrote, “The Section 4 Program allows HUD to partner with national nonprofit community development organizations to provide education, training, and financial support to local community development corporations (CDCs) across the country. Section 4 funds are required by law to be matched 3:1 with private investments, but program funds have consistently leveraged substantially higher amounts.”

They continued, “We are disappointed that the President’s budget has slated this program for elimination after decades of successful economic and community development. Since the HUD Demonstration Act was authorized in 1993, Section 4 has proven to be a valuable and cost-effective program that has produced tangible results. Through a nationwide support network, Section 4 provides programmatic and training assistance to local organizations, ensuring program goals are met while granting the necessary flexibility to meet community-specific needs. As communities across the country continue to look for ways to expand economic development and provide affordable housing, funding for Section 4 remains critically important.”

The Senators close the letter stating, “As the Subcommittee works through the process of determining how to effectively appropriate federal funds, it is our hope that you will continue your support for Section 4 in FY 2020.”

In addition to Wyden and Merkley, the letter was signed by U.S. Sens. In 1991, Congress designated I-73 as a high priority project. This morning, President Trump released his infrastructure framework that I believe will finally get this project off the ground. Congress needs to end Obama housing rule through defund process

Fairfax, VA - January 8, 2017 - (The Ponder News) -- Americans for Limited Government President Rick Manning has issued the following statement urging Congress to defund the 2015 Obama HUD housing rule that rezones recipients of community development block grants along income and racial criteria:

“The Department of Housing and Urban Development is on the right track by delaying implementation of the Affirmatively Furthering Fair Housing assessment tool until 2020, an unworkable bi-product of the 2015 Obama housing rule that effectively puts the federal government in charge of local zoning issues. The rule cites zoning no less than six times as a basis for compliance with the regulation. The House-passed omnibus bill defunds that aspect of the regulation, and we strongly support that rider’s inclusion or expansion in the final 2018 funding bill. This is a perfect way for Congress to begin to reassert its rightful Article I constitutional prerogatives, by defunding those regulations that go far beyond the scope of federal law.”

Washington, D.C. - September 27, 2017 (The Ponder News) -- The National Fair Housing Alliance (NFHA) has settled a housing discrimination complaint with Lorgroup, LLC, DBA RE/MAX Alliance, and The Lee Garland and Rita Jensen Team (Lorgroup). The terms of the settlement will open up housing opportunities for African Americans purchasing homes in metropolitan Jackson, Mississippi. According to one analysis, Jackson is the third most segregated city in the U.S. Following allegations of housing discrimination from African Americans in Jackson, NFHA launched an investigation of how Whites and Blacks were treated when inquiring about purchasing homes. NFHA found differences in treatment based on race and filed a federal housing discrimination complaint with the U.S. Department of Housing and Urban Development against the agents and companies.

The investigation included telephone and in-person testing. Testing is an investigation tool in which similarly situated Blacks and Whites make inquiries about available housing. NFHA’s testing revealed that when potential White homebuyers sought housing in integrated and predominantly African American neighborhoods, they were steered away. Instead, White homebuyers were provided with a plethora of information and assistance to help them buy a home in a predominantly White area. Meanwhile, African American homebuyers often never even received a call back from an agent after leaving messages about purchasing a specific home in Jackson.

The differences in treatment uncovered in NFHA’s investigation are examples of how Whites and Blacks are steered to different housing opportunities based on the racial composition of a neighborhood. “Steering intentionally perpetuates residential segregation and is illegal under the Fair Housing Act,” said NFHA’s President and CEO, Shanna L. Smith. “This is why it is imperative that real estate companies work to expand equal housing opportunities for everyone. When people choose where they want to live without artificial and illegal barriers, our communities and neighborhoods are stronger, Smith continued.”

Lorgroup will pay $46,000 to NFHA, participate in fair housing trainings, and display fair housing signs in its offices. Additionally, Lorgroup has agreed to promote fair housing in the communities where it does business and to expand equal housing opportunities for all consumers. The settlement agreement will be monitored by HUD’s Office of Fair Housing and Equal Opportunity. The original complaint was filed on September 15, 2015. The settlement was signed and approved by HUD on September 7, 2017.

Charles Harris, Executive Director of Jackson-based Housing Education and Economic Develop, Inc., said of the discrimination uncovered in the investigation, “Fair housing is the law, believe it or not. But housing discrimination is still alive and well. Any person or group that violates the Fair Housing Act must face the consequences.” Smith added, “This victory should send a strong message to real estate agents in the Jackson area that racial steering will not be tolerated and that their practices are being monitored. Furthermore, African American homebuyers should expect equal treatment and services when they are buying homes. Cohen and Ross Reintroduce the Bipartisan Housing Accountability Act

Washington, D.C. - August 3, 2017 (The Ponder News) -- Congressman Steve Cohen (D-TN) and Congressman Dennis Ross (R-FL) reintroduced the Housing Accountability Act, a bipartisan bill to hold property owners of low-income housing accountable for poor living conditions. This legislation would require the U.S. Department of Housing and Urban Development (HUD) to survey tenants living in subsidized housing twice a year about property conditions and management performance and create new penalties for property owners who repeatedly fail the tenant surveys. In 2015, local and federal investigations found deplorable living conditions at several federally subsidized-housing properties owned by the Global Ministries Foundation (GMF) in Memphis, Tennessee and Jacksonville, Florida. Senators Marco Rubio (R-FL) and Bill Nelson (D-FL) introduced a similar bill in the United States Senate in January.

“I was very disturbed by the deplorable living conditions many Memphians experienced at Warren and Tulane Apartments,” said Congressman Cohen. “Congress must step in to prevent this from happening again in Memphis or anywhere else. Our legislation would hold slumlords of low-income housing accountable for neglecting their properties and their tenants. By surveying tenants directly on property conditions, residents can report any issues directly to HUD without fear of reprisal from owners and managers who have been known to threaten to evict those who try to complain.”

“No matter someone’s income or socioeconomic status, no one deserves to live in squalor,” said Congressman Ross. “Everyone deserves to be treated fairly and to live in a safe, clean home. People from all backgrounds and of all ages are living in deplorable living conditions in subsidized housing, with fear of eviction, retaliation or inaction if they make any reasonable requests or complaints to their landlords or property managers. I am proud to join Rep. Cohen and Sens. Rubio and Nelson in putting forth bipartisan legislation that will help families improve their living conditions, and give them the ability and strength to ensure their homes are up-to-code and well kept.”

Global Ministries Foundation (GMF) is a faith-based non-profit organization located in Memphis, Tennessee. In 2015, numerous media outlets reported on deplorable living conditions at GMF owned properties in Memphis. Apartment units in Memphis had holes in the walls made by rats, exposed electrical wiring, broken windows, no working light, a moldy bathroom and leaky roof. In Jacksonville, Florida, the residents at Eureka Garden, another property owned by GMF, were forced to live in uninhabitable units plagued by mold, gas leaks, water damage, and crumbling staircases.

In addition, GMF-owned properties in Memphis had a combined evaluation of 38, a failing score, but GMF continued to collect $2.3 million in rent subsidies from HUD for those buildings in 2014 and $6.3 million from its six Jacksonville properties.

GUTIÉRREZ REACTS TO SENATE INTRODUCTION OF NEW DREAM ACT

On Thursday, Sen. Lindsey Graham (R-SC) and Sen. Dick Durbin (D-IL) introduced a new version of the DREAM Act (an acronym for Development, Relief, and Education for Alien Minors). The President has pledged, through a spokesperson, to fight this bipartisan legislation that would allow immigrants who were brought to the U.S. as children to live and work here legally if they meet certain criteria. This happens as the DACA program (Deferred Action for Childhood Arrivals, the program that provides temporary deportation relief for Dreamers and allows them to work legally) is under attack by Republican leaders and it is clear the President and his team are unlikely to defend it. This could make the 800,000 people who would qualify for the DREAM Act and who currently have DACA vulnerable to deportation, especially because they have registered with federal authorities as part of the program.
